INTRODUCTION

The 2013 Constitution and the 2015 Law on Local Government Organization, along with the identification of our country's administrative units including three levels: Province, District, Commune and special administrative units, have stipulated the organization of government on those administrative units The centrally run city government is established on a centrally run city administrative unit This is an administrative unit equivalent to a provincial administrative unit, but

is a special administrative unit or type I (of the three remaining types of provincial administrative units I, II, III)

The centrally run city government, as its name suggests, is a level of government that is highly respected by the Central government because of its importance not only at the local level, spreading and influencing the surrounding area but also for the overall development of the country Therefore, it implies that the Central City government talks about the control, regime, and policies specific to it In essence, the Central City government is the level of government that was established in our country from Decree No 77-SL dated December 21, 1945, but is only officially regulated in the Law on Political Organization Local rights were approved by the National Assembly on April 29, 1958 Since then, in our State's constitutions, at different levels, the City level of government directly under the Central Government has been recognized

Up to now, although the Constitution and the Law on Organization of Local Government regulate the basic functions, tasks, powers and organization of centrally run city governments; The National Assembly Standing Committee and the Government have also issued documents detailing the organization and operation of the People's Councils and People's Committees of centrally-run cities, but the issue of reforming the political organization is There are still many issues raised by centrally-run city authority In some centrally run cities such as Hanoi, Ho Chi Minh City, Da Nang although a number of specific mechanisms have been identified by the National Assembly, they are still in the process of continuing to research and perfect them , or pilot In fact, in the development trend, as is known, there are some provinces of Bac Ninh, Thua Thien - Hue, Khanh Hoa In the near future, it may become a centrally run city, which also needs to have its government organization model basically determined That is related to the internal relationships of government levels, with the political system in general, and the effectiveness and efficiency of government operations at all levels in state management and public service provision in the country locality and above all the actual results of economic, socio-cultural development in the locality

The above points lead to the continued improvement of the current central city government organization, both from a research perspective, from legal regulations and in practical implementation, which is still a topic of concern interested managers, scientists and practitioners The above reality shows that studying the organization of centrally run City governments is necessary, contributing to decoding a complex issue serving development at the local and national levels There have been many general research projects on local government and urban government

in general, but research on centrally run city government has also received attention in recent years

In such a context, researching this particularly important level of government is very necessary and reasonable That is also in accordance with the spirit of Resolution No 18 - NQ/TW of the 6th Conference of the Party Central Committee (term XII) dated October 25, 2017 on "Some issues on continuing innovation, Arrange and organize the apparatus of the political system to be streamlined

and operate effectively and efficiently The resolution assesses that the organizational apparatus of the political system is still cumbersome, with many levels and many focal points; The effectiveness and efficiency of operations do not meet the requirements and tasks The functions, tasks, powers, organizational structure, and relationships of some agencies and organizations are not very clear, overlapping, overlapping The assignment, decentralization, and decentralization of power between sectors , at all levels and within each agency and organization is not reasonable, powerful and synchronous; There is still a situation of making excuses, substituting or omitting tasks, and the effective power control mechanism is not high; Disclosure, transparency and accountability are still limited Administrative reform, especially administrative procedure reform, is moving slowly, asynchronously, and has not met requirements Notably, in terms of tasks and solutions, Resolution No 27-NQ/TW dated September 9 November 2022 The 6th Conference of the 13th Party Central Committee on continuing to build and perfect the Vietnamese socialist rule of law state in the new period has proposed tasks and solutions to continue innovate the organization and operations of local government; building a state administration to serve the people, professional, rule of law, modern, effective and efficient with key contents such as: continuing to innovate the organization and operations of local government in the direction of streamlining, operating effectively and efficiently; Reasonably reduce the number of specialized agencies under the People's Committees at the provincial and district levels; innovate national governance towards modernity, effectiveness, efficiency, and focus on development management; ensure respect for the Constitution and the law, enhance transparency, accountability and people's participation; building an administration that serves the people, democracy, rule of law, professional, modern, scientific, clean, open, transparent, creating a favorable environment for people and businesses; continue to promote administrative reform, focusing on improving the quality of cadres, civil servants and public employees with three main pillars: Organizing the apparatus; civil service, civil servants; electronic administration and digital transformation; Complete local government organization suitable for urban, rural, mountainous, island areas, and special administrative-economic units; Reduce appropriate levels of government in some localities; build a local government governance model suitable for each area, associated with the development requirements of regions and economic zones; continue to arrange district and commune-level administrative units; Pilot research on arrangement of administrative units

provincial level in accordance with the overall planning of national and local administrative units; build specific mechanisms, institutions and policies to promote regional development and strong enough regional linkages to meet the requirements of socio-economic development and ensure national defense and security of the country; Promote scientific and reasonable decentralization and decentralization, coupled with increased responsibility, associated with ensuring resources and capacity to implement the law for localities and ministries; strengthen inspection and supervision; ensuring unified management of the Government, promoting the proactive, creative, and self-responsible role of each locality and ministries These contents are important directions in researching and perfecting the law on the current organization of centrally run city governments

From the above presentations, the PhD student chose the topic "Organization of run city government in Vietnam" as the topic of his doctoral dissertation in law to contribute to perfecting and innovating the organization of the city current centrally run city government

- Clarifying theoretical issues about the organization of centrally run city governments in terms of position and role; mission functions; organizational model, relationships; criteria for perfecting the organization of centrally run city governments; Legislative experience on city government organization in a number of related countries;

- Evaluate the current status of centrally run city government organization in terms of roles, determination of functions, tasks, organization of the government apparatus, relationships, and operational efficiency of the government

- From theoretical awareness and the current situation of the organization of centrally run city governments in Vietnam, the thesis proposes solutions to innovate the current centrally run city government organization according to practical requirements

3 Subject and scope of research

Time of research and survey: mainly from when the Law on Organization of People's Councils and People's Committees was promulgated in 2003 to 2023

4 Research methodology and methods

The methodological basis for implementing the topic is the views of Marxism-Leninism,

Ho Chi Minh's ideology and the Communist Party of Vietnam on issues of state and law in general, the State and law of Vietnam In particular, on the organization of socialist government, local government and urban government; At the same time, modern and progressive concepts about the organization of the contemporary government apparatus

5 New contributions of the thesis

The new contributions of the thesis are shown in the following points:

Firstly, the thesis collects, compiles statistics and analyzes the main current research on the organization and operation of centrally run city governments Thereby, identifying achievements,

as well as open issues that have not been researched or where there is no consensus of opinion and concept among researchers on centrally run city government From there, we can summarize the current state of research on centrally run city governments in Vietnam and future research directions

Second, the thesis is a research work that contributes to clarifying different theoretical aspects of centrally run city government Although the centrally run city government was formed right from the time the Provisional Revolutionary Government of the Democratic Republic of Vietnam organized the local government in 1945, it has spanned many years, despite its great scope especially important for regional, national, and regional development, but from a scientific perspective, concepts, characteristics, classification, and even roles and other issues are hardly clearly defined

The issues that will be clarified by the thesis are systematic in terms of: concepts, characteristics, and roles of centrally run city governments; Comparative research with centrally run city governments in countries around the world and classifying centrally run city governments

in Vietnam; clarify the factors affecting the organization of city governments under the Central Government of our country

Third, the thesis clarifies the current state of the organization of centrally run city governments through comprehensive analysis and assessment of the organization and operations

6 Scientific and practical significance of the thesis

In terms of science, the thesis is a comprehensive, systematic research work on theoretical issues about the organization of centrally run city governments in our country in the new context The research is carried out in connection with the history of formation and development of centrally run city governments in history Therefore, the results of research on the organization of centrally run city governments in Vietnam on the one hand show the regularity of the government development process, but more importantly, also scientifically clarify the issue of change new, perfecting the organization of centrally run city government in the current context

Theoretically, there are research works that address some characteristics of urban management and urban government organization in Vietnam; industrialization and urbanization process in centrally run cities; as well as analyze a number of factors affecting the organization of urban government in centrally run cities

- Clarifying the role and functions of the city government under the Central Government

of Vietnam in terms of public administration, legal aspects and other aspects;

- Point out basic aspects of the organization and operation of centrally run city governments;

Second, regarding the current state of organization and operation of centrally run city governments:

- Research the provisions of the Law on Organization of Local Governments, the

Government's decrees specifying relevant laws and regulations of ministries, branches and

regulations of centrally run city governments about local organization and activities From there, evaluate the local government according to those regulations in terms of government model, organization and operation, relationships with advantages, limitations, defects ;

- On the basis of legal regulations on the organization and operation of the government, the thesis evaluates the central city government in terms of model, organization and operation, and implementation of relationships in practice ; In particular, the thesis focuses on examining transformations in the organization and operations of the government related to democracy, market economy, state governance, implementation of the tectonic state From that practice, The thesis points out achievements and limitations in the organization and operations of the government, and identifies the causes of those achievements and limitations

Third, regarding the thesis's proposed solutions on innovating centrally-run city governments, the thesis will focus on the following solutions:
