tài Ngày nay, với phát triển vũ bão khoa học kỹ thuật giới, người quan tâm đến nhân tố sở hữu trí tuệ (SHTT) ngày lớn sâu sắc Trong giao dịch thương mại quốc tế, bên xem xét nhiều đến hàm lượng SHTT đơn vị hàng hóa Do vậy, đăng ký bảo hộ quyền SHTT, đặc biệt quyền sở hữu công nghiệp (SHCN) tất yếu khách quan tổ chức, cá nhân xu hội nhập kinh tế quốc tế Tuy nhiên, việc bảo hộ quyền SHCN nói chung bảo hộ sáng chế nói riêng mang tính lãnh thổ, nghĩa giá trị văn cấp có hiệu lực nước cấp Vì vậy, thực tế đặt là, muốn bảo hộ sáng chế quốc gia nào, chủ sở hữu sáng chế cần phải đăng ký bảo hộ độc quyền sáng chế quốc gia Và thị trường Hoa Kỳ thị trường tiềm mà nhà kinh doanh Việt Nam hướng đến Thị trường Hoa Kỳ thị trường có tính cạnh tranh gay gắt, khắt khe nhạy cảm hay nói số nhà nghiên cứu ―thị trường khó tính‖ Tuy nhiên lại thị trường có sức mua cao, tạo nhiều hội kinh doanh cho nhà đầu tư Do đó, nói, khẳng định vị nhà đầu tư thị trường Hoa Kỳ bước tiến quan trọng cho trình mở rộng thị trường đầu tư quy mơ tồn cầu Bên cạnh khó khăn (nắm bắt nhu cầu thị trường, đa dạng sản phẩm, sách Chính phủ Hoa Kỳ nhà đầu tư Việt Nam (hàng rào kỹ thuật an tồn thực phẩm cao, đơi mức cần thiết …), pháp luật bảo hộ người tiêu dùng chặt chẽ, biện pháp chống khủng bố từ sau kiện ngày 11/09/2001) đã, vấp phải tiếp cận thị trường Hoa Kỳ, nhà đầu tư Việt Nam nhận thấy tiềm đầu tư lớn từ thị trường Hoa Kỳ: theo báo Đầu tư, tại, kim ngạch xuất vào thị trường chiếm khoảng 20% tổng kim ngạch xuất Việt Nam; năm 2013, Việt Nam xuất siêu sang Hoa Kỳ đạt giá trị khoảng 20 tỷ USD; năm 2014, Hoa Kỳ tiếp tục thị trường lớn quan trọng Việt Nam, dự kiến kim ngạch xuất vào thị trường tăng trưởng khoảng 10%.1 Một việc làm ưu tiên hàng đầu nhà đầu tư Việt Nam tiếp cận thị trường Hoa Kỳ phức tạp, khó tính, đắt đỏ vơ hấp dẫn đăng ký bảo hộ quyền SHTT Hoa Kỳ, có sáng chế, lẽ đăng ký sáng chế Hoa Kỳ xem giấy thông hành quan trọng, khiên bảo vệ chủ sáng chế bước giới Xuất phát từ thực tế trên, học viên cao học chuyên ngành Luật Quốc tế, học viên lựa chọn đề tài ―ĐĂNG KÝ BẢO HỘ SÁNG CHẾ CỦA TỔ CHỨC, CÁ NHÂN VIỆT NAM TẠI HOA KỲ - THỰC TRẠNG VÀ GIẢI PHÁP‖ cho Luận văn tốt nghiệp, với mong muốn làm rõ quy trình, thủ tục để tổ chức, cá nhân Việt Nam đăng ký sáng chế Hoa Kỳ, tìm nguyên nhân khiến cho số lượng đơn đăng ký sáng chế hàng năm tổ chức, cá nhân Việt Nam Hoa Kỳ ít; đề xuất giải pháp để tổ chức, cá nhân Việt Nam đăng ký sáng chế Hoa Kỳ nhanh hiệu Tình hình nghiên cứu đề tài Đăng ký bảo hộ quyền SHTT lĩnh vực không giới; xu hội nhập kinh tế quốc tế, vấn đề trọng, quan tâm Luật pháp nước bước xây dựng cho hệ thống bảo hộ quyền SHTT ngày đầy đủ chi tiết hơn, đặc biệt sáng chế Hoa Kỳ số quốc gia có luật sáng chế xuất giới, từ năm cuối kỷ XVIII Đó luật đồ sộ (so với nước), cộng thêm quy tắc điều chỉnh (rules) quy mơ hơn, án lệ khơng thể thiếu hệ thống Common Law vấn đề gây đau đầu cho khơng chun gia nghiên cứu Về vấn đề đăng ký bảo hộ sáng chế tổ chức, cá nhân Việt Nam Hoa Kỳ, có số viết liên quan như: viết ―Việt Nam có sáng chế Mỹ công nhận‖ TS Lê Văn Út; viết ―Việt Nam khơng có sáng chế đăng ký Mỹ năm 2011‖ TS Lê Văn Út & TS Thái Lâm Tồn; nghiên cứu ―Vì Việt Nam đăng ký sáng chế?‖ Uyên Na; http://baodautu.vn/don-song-tpp-doanh-nghiep-hoa-ky-tap-nap-den-viet-nam.html nghiên cứu ―Sáng chế Việt Nam đăng ký quốc tế q ít‖ Trúc Thịnh; Ngồi ra, có số dịch, nghiên cứu nhiều liên quan đến sáng chế Hoa Kỳ như: tác phẩm dịch ―Hiến pháp Hoa Kỳ quyền sở hữu trí tuệ‖ Th.S Nguyễn Bích Thảo, Khoa Luật Đại học Quốc gia Hà Nội… So với viết trên, Luận văn tác giả cơng trình nghiên cứu có quy mơ tồn diện vấn đề đăng ký bảo hộ sáng chế Hoa Kỳ Do vậy, vấn đề nghiên cứu không trùng lặp với cơng trình nghiên cứu khác công bố Đối tƣợng nghiên cứu phạm vi nghiên cứu đề tài 3.1 Đối tượng nghiên cứu: Luận văn nghiên cứu vấn đề đăng ký bảo hộ quyền SHTT sáng chế (được viết cách ngắn gọn đăng ký bảo hộ sáng chế) tổ chức, cá nhân Việt Nam Hoa Kỳ Qua nêu khó khăn, thuận lợi tổ chức, cá nhân Việt
