Rule Định nghĩa chung - General definitions Trong quy tắc này, trừ theo nghĩa câu chúng mang nghĩa khác, danh từ dới có nghĩa nh sau: - For the purpose of these Rules, except where the context otherwise requires: a) Danh từ Tàu thuyền bao gồm tất loại phơng tiện dùng dùng làm phơng tiện vận chuyển mặt nớc, kể loại tàu thuyền lợng chiếm nớc, tàu WIG thủy phi The word vessel includes every description of water-craft, including nondisplacement craft, WIG craft and seaplanes, used or capable of being used as a means of transportation on water b) Thuật ngữ Tàu thuyền máy có nghĩa tất loại tàu thuyền chạy máy The term power-driven vessel means any vessel propelled by machinery c) Thuật ngữ Tàu thuyền buồm có nghĩa tất loại tàu thuyền chạy buồm, kể tàu thuyền đợc trang bị máy nhng không dùng máy để chạy The term sailing vessel means any vessel sail provided that propelled machinery, if fitted, is not be used d) Thuật ngữ Tàu thuyền đánh cá có nghĩa tất loại tàu thuyền đánh cá lới, dây câu, lới vét hay dụng cụ đánh cá khác làm hạn chế khả điều động tàu thuyền đó, nhng không áp dụng cho loại tàu thuyền đánh cá loại dây câu thả dòng loại dụng cụ đánh bắt cá khác mà không làm hạn chế khả điều động tàu thuyền The term vessel engaged in fishing means any vessel fishing with nets, lines, trawls or other fishing apparatus which restrict manoeuvrability, but does not include a vessel fishing with trolling lines or other fishing apparatus which not restrict manoeuverability e) Danh từ Thuỷ phi bao gồm tất loại máy bay điều động đợc mặt nớc The word seaplane includes any aircraft designed to manoeuvre on the water f) Thuật ngữ Tàu thuyền khả điều động có nghĩa tàu thuyền trờng hợp đặc biệt mà khả điều động theo yêu cầu quy tắc này, tránh đờng cho tàu thuyền khác The term vessel not under command means a vessel which through some exceptional circumstances is unable to manoeuvreas required by these Rules and is therefore unable to keep out of the way of another vessel g) Thuật ngữ Tàu thuyền bị hạn chế khả điều động có nghĩa tàu thuyền tính chất công việc mà bị hạn chế khả điều động theo yêu cầu quy tắc này, tránh đờng cho tàu thuyền khác Thuật ngữ Tàu thuyền bị hạn chế khả điều động bao gồm (nhng không hạn chế) nh sau: - The term vessel restricted in her ability to manoeuvre means the vessel which from the nature of her work is restricted in her ability to manoeuvre as required by these Rules and is therefore unable to keep out of the way of another vessel The term vessel restricted in her ability to manoeuvre shall include but not be limited to: (i) Tàu thuyền đặt, trục vớt tiến hành bảo quản phao tiêu, cáp hay ống ngầm dới nớc a vessel engaged in laying, servicing or picking up a navigation mark submarine cable or pipelines; (ii) Tàu thuyền làm công tác nạo vét luồng lạch, khảo sát hải dơng, thủy văn công việc ngầm dới nớc a vessel engaged in dredging, surveying or underwater operations; (iii) Tàu thuyền vừa hành trình vừa tiến hành nhiệm vụ tiếp tế, chuyển tải ngời, lơng thực, thực phẩm hàng hoá - a vessel engaged in replenishment or transferring person, provisions or cargo while underway; (iv) Tàu thuyền làm nhiệm vụ phục vụ cho máy bay cất cánh hạ cánh a vessel engaged in the launching or recovery of aircrafts; (v) Tàu thuyền làm nhiệm vụ rà phá bom mìn a vessel engaged in mine clearance operations; (vi) Tàu thuyền tiến hành công việc lai dắt điều chỉnh hớng a vessel engaged in a towing operation such as severely restricts the towing vessel and her tow in their ability to deviate from their course h) Thuật ngữ Tàu thuyền bị mớn nớc khống chế có nghĩa tàu thuyền máy tơng quan mớn nớc tàu với độ sâu bề rộng có đợc vùng nớc nên bị hạn chế cách nghiêm ngặt khả chệch khỏi hớng The term vessel constrained by her draught means a power-driven vessel which, because of her draught in the relation to the available depth and width of navigable water, is severely restricted in her ability ti deviate from the course she is following i) Thuật ngữ Tàu thuyền chạy có nghĩa tàu thuyền không thả neo không buộc vào bờ, không bị mắc cạn The word underway means that a vessel is not at anchor or made fast to the shore or aground j) Các thuật ngữ Chiều dài Chiều rộng chiều dài chiều rộng lớn tàu thuyền The words Length and Breadth of a vessel mean her length overall and greatest breadth k) Hai tàu đợc xem nh nhìn thấy tàu quan sát đợc tàu mắt thờng Vessels shall be deemed to be in the sight of one another only when one can be observed visiually from the other l) Thuật ngữ Tầm nhìn xa bị hạn chế có nghĩa điều kiện mà tầm nhìn xa bị giảm sút sơng mù, ma tuyết, ma rào hay bão cát nguyên nhân khác tơng tự The term restricted visibility means any condition in which visibility is restricted by fog, mist, falling snow,heavy rainstorm, sandstorm or other similar causes m) Thuật ngữ Tàu WIG tàu di chuyển nhiều phơng thức mà hoạt động phơng thức bay sát bề mặt nớc cách sử dụng hiệu ứng bề mặt - The term Wing-In-Ground craft means a multimodel craft which, in its main operational mode, flies in close proximity to the surface by utilizing surface-affect action Phần b - quy tắc hành trình điều động Part b - Rule Cảnh giới - Look-out Mọi tàu thuyền phải thờng xuyên trì công tác cảnh giới mắt nhìn tai nghe cách thích đáng, đồng thời phải sử dụng tất thiết bị sẵn có phù hợp với hoàn cảnh điều kiện để đánh giá đầy đủ tình hình nguy đâm va Every vessel shall at all times maintain a proper look-out by sight and hearing as well as by all available means appropriate in the prevailing circumstances and conditions so as to make a full appraisal of the situation and of the risk of collision Điều - Rule Tốc độ an toàn - Safe speed Mọi tàu thuyền phải giữ tốc độ an toàn để chủ động xử lý thích đáng có hiệu tránh va dừng hẳn lại khoảng cách giới hạn cần thiết hoàn cảnh điều kiện cho phép Every vessel shall at all times proceed at a safe speed so that she can take proper and effective action to avoid collision and be stopped within a distance appropriate to the prevailing circumstances and conditions Để xác định đợc tốc độ an toàn cần phải tính đến yếu tố sau đây: - In determining a safe speed the following factors shall be those taken into account: (a) Đối với tàu thuyền: - By all vessels: (i) Trạng thái tầm nhìn xa - the state of visibility; (ii) Mật độ giao thông, kể mức độ tập trung tàu thuyền đánh cá hay loại tàu thuyền khác the traffic density including concentrations of fishing vessels or any other vessels; (iii) Khả điều động đặc biệt khoảng cách cần thiết để tàu thuyền dừng hẳn lại khả quay trở điều kiện có The manoeuvrability of the vessel with the reference to stopping distance and turning ability in the prevailing conditions; (iv) Ban đêm có vầng ánh sáng đèn bờ khuyếch tán ánh sáng thân đèn tàu thuyền at night the presence of the background light such as from shore lights or from back scatter of her own lights; (v) (vi) Trạng thái gió, sóng biển, hải lu trạng thái gần chớng ngại hàng hải The state of wind, sea and current, and the proximity of navigational hazards; Sự tơng quan mớn nớc độ sâu sẵn có The draught in relation to the available depth of water (b) Ngoài tàu thuyền có sử dụng Radar phải tính đến: Additionally, by vessels with operational radar: (i) Các đặc tính, hiệu mặt hạn chế thiết bị Radar - the characteristics, efficiency and limitations of the radar equipment; (ii) Những mặt hạn chế việc sử dụng thang khoảng cách Radar any constraints imposed by the radar range scale in use (iii) Trạng thái biển, yếu tố khí tợng nguồn xạ khác ảnh hởng đến phát mục tiêu Radar the effect on radar detection of the sea state, weather and other sources of interference; (iv) Khả Radar không phát đợc tàu thuyền nhỏ, tảng băng vật khác khoảng cách thích hợp the possibility that small vessel, ice and other floating objects may not be detected by radar at a equidate range; Khả phát Radar số lợng, vị trí di chuyển tàu thuyền the number, location, and movement of vessels detected by radar; Khả danh giá thật xác tầm nhìn xa sử dụng Radar để đo khoảng cách tới tàu thuyền đến mục tiêu lân cận the more exact assessment of the visibility that may be possible when radar is used to determine the range of vessels or other objects in the vicinity (v) (vi) Điều - Rule Nguy đâm va - The risk of collision (a) Mọi tàu thuyền phải sử dụng tất thiết bị sẵn có thích hợp với hoàn cảnh điều kiện để xác định có nguy đâm va hay không Nếu cha khẳng định đợc điều phải xem nh nguy đâm va xẩy Every vessel shall use all available means appropriate to the prevailing circumstances and conditions to determine if risk of collision exists If there is any doubt such risk shall be deemed to exist (b) Nếu thiết bị radar tàu trạng thái làm việc phải sử dụng cách triệt để, thích hợp gồm quan sát thang cự ly dài để sớm phát dấu hiệu báo trớc nguy đâm va tiến hành tác nghiệp tránh va radar theo dõi cách có hệ thống mục tiêu đợc phát proper use shall be made of radar equipment if fitted and operational, including long range scanning to obtain early warning of risk of collision and radar plotting or equivalent systematic observation of detected objecst (c) Tránh việc đa kết luận dựa sở thông tin không đầy đủ, đặc biệt thông tin không đầy đủ radar cung cấp Assumption shall not be made on the basis of scanty information, expecially scanty radar information (d) Trong việc xác định có nguy đâm va hay tính đến yếu tố sau: - In determing if risk of collision exists the following considerations shall be among those taken into account: (i) Có nguy đâm va, phơng vị la bàn tàu thuyền đến gần không thay đổi rõ rệt such risk shall be deemed to exist if the compass bearing of an approaching vessel does not apprieciably change (ii) Đôi nguy đâm va xẩy quan sát thấy phơng vị la bàn thay đổi rõ rệt, đặc biệt đến gần tàu lớn, đoàn tàu kéo hay đến gần tàu thuyền khác khoảng cách gần such risk may sometimes exist even when an appreciable bearing change is evident, particularly when approaching a very large vessel or a tow or when approaching a vessel at close range Điều - Rule Hành động tránh va chạm - Action to avoid collision (a) Bất hành động để tránh va theo quy định phần này, hoàn cảnh cho phép, phải đợc tiến hành cách dứt khoát, kịp thời phù hợp với kinh nghiệm ngời biển lành nghề Any action to avoid collision shall be taken in accordance with the Rules of this part and shall, if the circumstances of the case admit, be positive, made in ample time and with the due regard to the observance of good seamanship (b) Mọi thay đổi hớng tốc độ để tránh va, hoàn cảnh cho phép, phải thay đổi đủ lớn, rõ rệt để tàu thuyền khác nhận thấy tức khắc mắt thờng hay radar Phải tránh thay đổi hớng tốc độ hai lúc cách lắt nhắt, tí Any alteration of course and/or speed to avoid collision shall, if the circumstances of the case admit, be large enough to be readily apparent to another vessel observing visually or by radar; a succession of small alterarions of course and/ or speed should be avoided (c) Nếu vùng nớc đủ rộng, cần thay đổi hớng đơn coi hành động có hiệu để tránh rơi vào tình trạng gần tàu thuyền kia, với điều kiện việc điều động phải tiến hành kịp thời, cần thiết không dẫn tới tình trạng gần tàu thuyền khác.- If there is such suffiect sea-room, alteration of course alone may be the most effective action to avoid a close-quarters situation provided that it is made in good time, is substantial and does not result in another close-quarters situation (d) Hành động để tránh va với tàu thuyền khác phải dẫn đến kết qua tàu thuyền khoảng cách an toàn Hiệu việc hành động thận trọng kiểm tra tàu thuyền hoàn toàn qua cách xa Action taken to avoid collision with other vessel shall be such as to result in passing at a safe distance The effectiveness of the action shall be carelully checked until the other vessel is finally pass and clear (e) Nếu cần thiết để tránh va hay có thêm thời gian để đánh giá tình huống, tàu thuyền cần phải giảm bớt tốc độ hay phải phá trớn tới cách ngừng máy cho máy chạy lùi If necessary to avoid collision or allow more time to access the situation, a vessel shall slacken her speed or take all way off by stopping or revering her means of propulsion (f) (i) Tàu thuyền mà theo điều khoản đòi hỏi không đợc làm cản trở qua qua an toàn tàu thuyền khác, hoàn cảnh bắt buộc, phải tiến hành điều động sớm để có đủ rộng cho việc qua an toàn tàu thuyền A vessel which, by any of these Rule, is required not to impede the passage or safe passage of another vessel shall, when required by the circumstances of the case, take early action to allow sufficient sea-room for the safe passage of the other vessel (ii) Tàu thuyền đòi hỏi không đợc làm cản trở qua qua an toàn tàu thuyền khác không đợc miễn giảm trách nhiệm tiến hành điều động, tiến gần tàu thuyền mà dẫn đến nguy đâm va, phải có quan tâm đầy đủ đến việc điều động đợc quy định điều khoản phần A vessel required to impede the passage or safe passage of another vessel is not relieved of this obligation if approaching the other vessel so as to involve risk of collision and shall, when taking action, have full regard to the action which may be required by the Rules of this part (iii) Tàu thuyền mà việc qua không bị tàu khác làm cản trở phải có nghĩa vụ chấp hành đầy đủ quy định điều khỏan phần này, hai tàu tiến đến gần dẫn tới nguy đâm va A vessel the passage of which is not be impeded fully obliged to comply with the Rules of this part when the two vessels are approaching one another so as to involve the risk of collision Điều - Rule Hành trình luồng hẹp - Narrow channels (a) Tàu thuyền luồng hẹp hay kênh đào, điều kiện thực tế cho phép đảm bảo an toàn, phải bám sát tốt mép bên phải luồng hay kênh A vessel proceeding along the course of a narrow channel or fairway shall keep as near to the outer limit of the channel or fairway which lines on her starboard side as is safe and practicable (b) Tàu thuyền có chiều dài dới 20m, tàu thuyền buồm không đợc gây trở ngại cho tàu thuyền hành trình an toàn phạm vi giới hạn luồng lạch hẹp A vessel of less than 20 meters in length or a sailing vessel shall not impede the passage of a vesse which can safely navigate only within a narrow channel or fairway (c) Tàu thuyền đánh cá không đợc gây trở ngại cho tàu thuyền khác hành trình phạm vi giới hạn luồng lạch hẹp A vessel engaged in fishing shall not impede the passage of any other vessel navigating within a narrow channel or fairway (d) Tàu thuyền không đợc cắt ngang qua luồng lạch hẹp, việc gây trở ngại cho việc qua tàu thuyền hành trình an toàn phạm vi giới hạn luồng lạch hẹp Tàu thuyền bị cắt hớng sử dụng âm hiệu nêu điều 34(d), nghi ngờ tàu thuyền có ý định chạy cắt ngang qua hớng tàu A vessel shall not cross a narrow channel or fairway if such crossing impede the passage of a vessel which can navigate only within such channel or fairway The latter vessel may use the sound signal prescribed in Rule 34(d) if in doubt as to the intention of the crossing vessel (e) (i) Trong luồng hẹp hay kênh đào đợc phép vợt tàu thuyền bị vợt điều động phép vợt an toàn, tàu thuyền có ý định vợt phải báo âm hiệu thích hợp với ý định nh quy định điều 34(c) (i) Tàu thuyền bị vợt, đồng ý phải phát âm hiệu thích hợp ghi điều 34(c) (ii) phải điều động tàu thuyền vợt đảm bảo an toàn Nếu thấy nghi ngờ phát âm hiệu nh ghi điều 34(d). In a narrow channel or fairway when overtaking can take place only if the vessel intending to be overtaken shall indicate her intention by sounding the appropriate signal prescribed in Rule 34(c) (i) The vessel to be overtaken shall, if in agreement, sound the appropriate signal prescribed in Rule 34(c) (ii) and take steps to permit safe passing If in doubt she may sound the signals prescribed in 34 (e) A vessel nearing a bend or an area of narrow channel or fairway where other vessel may be obscured by an intervening obstruction shall navigate with particular alertness and caution and shall sound the appropriate signal prescribed in Rule 34(e) (g) Nếu hoàn cảnh cho phép, tàu thuyền phải tránh thả neo luồng hẹp Any vessel shall, if the circumstances of the case admit, avoid anchoring in a narrow channel Điều 10 - Rule 10 Hành trình hệ thống phân luồng - Traffic separation schemes (a) Điều khoản áp dụng hệ thống phân luồng giao thông đợc tổ chức hàng hải quốc tế chấp nhận không giảm nhẹ nghĩa vụ cho tàu thuyền quy định điều khoản khác This Rule applies to traffic separation schemes adopted by the Organization and does not relieve any vessel of her obligation under any other rule (b) Tàu thuyền hành trình hệ thống phân luồng phải: - A vessel using separation schemes shall: (i) Đi theo tuyến đờng giao thông quy định theo hớng định tuyến proceed in the appropriate traffic lane in the general direction of traffic flow for that lane (ii) Trong chừng mực đợc, giữ hớng cách xa đờng ranh giới vùng ngăn cách hệ thống phân luồng so far as practicable keep clear of a traffic separation line or separation zone (iii) Thông thờng, phải vào khỏi tuyến giao thông đầu luồng, nhng tàu thuyền phải vào từ phía giới hạn hệ thống phân luồng, phải theo hớng tạo với hớng chung góc bé tốt normally join or leave a traffic lane at the termination of the lane, but when joining or leaving from either side shall not so at as small an angle to the general direction of traffic flow as buồm tàu thuyền đánh cá sử dụng vùng giao thông ven bờ A vessel shall not use an inshore traffic zone when she can safely use the appropriate traffic lane within the adjacent traffic separation scheme However, vessels of less then 20 meters in length, sailing vessels and vessels engaged in fishing may use the inshore traffic zone (ii) Bất kể quy định phân đoạn (d) (i), tàu thuyền sử dụng tuyến giao and inshore traffic zone when en route to or from a port, offshore installation or structure, pilot station or any other place situated within the inshore traffic zone, or to avoid immediate danger situation shall be deemed to exist when a vessel see the other ahead or nearly ahead and by night she could see the masthead lights of the other in these Rules or not impair their visibility or all-round white light on a power-driven vessel of less than 12 meters in length may be displaced from the fore and aft centerline of the vessel if centerline fitting is not practicable, provided that the sidelights are combined in one lantern which shall be carried on the fore and aft centerline of the vessel or located as nearly as praticable in the same fore and aft line as the masthead light or (c) of this Rule, such vessel shall not be required to exhibit those light when engaged in towing another vessel in distress or otherwise in need of assistance All possible measures shall be taken to indicate the nature of the relationship between the towing vessel and the vessel being towed as authorized by Rule 36, in particulat by illuminating the towline Đìều 25 - Rule 25 Tàu thuyền buồm hành neo phải trng đèn dấu hiệu đợc quy định điều - a vessel engaged in fishing, whether underway or at anchor, shall exhibit only the lights and shapes prescribed in this Rule (b) Tàu thuyền đánh cá lới rà, có nghĩa đánh cá lới vét dụng cụ đánh cá khác kéo lê chìm dới nớc phải trng: - a vessel when engaged in trawling, by which is meant the dragging through the water if a dredge net or other the additional signals described in Annex II to these Regulation (e) Tàu thuyền đánh cá, không làm nhiệm vụ đánh cá không đợc trng đèn hay dấu hiệu đợc quy định điều khoản này, mà đợc trng đèn dấu prescribed for a power-driven vessel in Rule 23 or to the lights or shape prescribed for a vessel at anchor in Rule 30 as appropriate, exhibit three all-round green lights or three balls One of these lights or shapes shall be exhibited near the foremast head and one at each end of the fore yard These lights or shapes indicated that it is dangerous for another vessel to approach within 1000 meters hiệu âm theo quy định A vessel of 12 meters or more in length shall be provided with a whistle, a vessel of 20 meters or more in length shall be provided with a bell in addition to a whistle, and a vessel of 100 meters or more in length shall, in addition, be provided with a gong, the tone and sound of which cannot be confused with that of the bell The whistle, bell and gong shall comply with the specicfication in Annex III to these Regulations The bell or gong or both may be replaced by other equipment having the same respective sound characteristics, provided that manual sounding of the vessel underway, when manoeuvring as authorized or required by these Rules, shall indicate that manoeuvre by the following signals on her whistle - Một tiếng còi ngắn có nghĩa Tôi đổi hớng sang bên phải - One short blast to mean I am altering my course to starboard - Hai tiếng còi ngắn có nghĩa Tôi đổi hớng sang bên trái Two short blasts to mean I am altering my course to port; - Ba tiếng còi lại, tuỳ theo sụ cần thiết suốt thời gian điều động: - Any vessel may supplement the whistle signals prescribed in paragraph (a) of this Rule by light signals, repeated appropriate, whilst the manoeuvre is being carried out: (i) Những tín hiệu ánh sáng có nghĩa nh sau: - these light signals shall have the following significance: - Một chớp có nghĩa Tôi đổi hớng sang bên phải one flash to mean I am altering my course to starboard; - Hai chớp có nghĩa Tôi dang đổi hớng sang bên trái two flashes to mean I am altering my course to port; - Ba chớp có nghĩa Tôi cho máy chạy lùi three hiệu còi nh sau: - the vessel about to be overtaken when acting in accordance with Rule (e) (i) shall indicate her agreement by the following signal on her whistle - Một tiếng còi dài, tiếng còi ngắn, intention or actions of the other, or is in doubt whether sufficient action is being taken by the other to avoid collision, the vessel in doubt shall immediately indicate such doubt by giving at least five short and rapid blasts on the whistle Such signal may be supplemented by a light signal of at least five short and rapid flashes (e) Tàu thuyền đến gần chỗ ngoặt, đoạn luồng, tuyến giao thông nơi điều động tín hiệu thông báo cần sử dụng còi If whistles are fitted on a vessel at a distance apart of more than 100 meters, one whistle only shall be used for giving manoeuvring and warning signals Điều 35 -Rule 35 Tín hiệu âm tầm nhìn xa bị hạn chế - Sound signals in restricted visibility Trong hay gần khu vực tầm nhìn xa bị hạn chế, dù ban ngày hay ban đêm, tín hiệu quy định điều khoản phải đợc sử dụng nh sau: - In or near an area of restricted visibility, whether by day or night, the signals prescribed in this Rule shall be used as follows: (a) Tàu thuyền máy trớn, cách kgông phút phải phát tiếng còi dài A power-driven vessel making way through the water shall sound at intervals of not more than minutes one prolonged blast (b) Tàu thuyền máy hành trình, nhng ngừng máy hết trớn, cách không phút phải phát tiếng còi dài, tiếng cách tiếng chừng giây A power-driven vessel underway but stopped and making no way through the water shall sound at intervals of not more than minutes two
