THEORETICAL BACKGROUND of freight forwarding

Theoretical background of Logistics

According to the provisions of Article 28 of the 2005 Commercial Law on export and import of goods, specifically as follows:

Exporting goods involves the movement of goods out of the territory of Vietnam or into a specific area within the country designated as a separate customs zone, as defined under applicable laws.

Full Container Load (FCL) is used in the international shipping industry for exporting and importing ocean freight According to Mr Tran Thanh Hai- Deputy Director of the Import-Export Department (Ministry of Industry and Trade) in Vietnam, this term is used when talking about packing goods into containers, when an owner uses up the entire space of the container to send his goods Thus, a container will have only one shipper Large businesses with a large volume of goods often pack goods using this method This method is often called "full container packing" (full container packing).

According to the FIATA (International Federation of Freight ForwardersAssociations), freight forwarding services are defined as any type of service related to transportation, consolidation, storage, loading, packaging or distribution of goods as well as consulting services or related to the above services, including customs issues, finance, insurance, payment, and collecting documents related to goods Briefly, forwarding is a collection of move goods from the place of delivery (shipper) to the place of receipt (consignee) Forwarders can perform services directly or through agents and hire services from other third parties

The person performing the delivery operation can perform one of the following tasks on behalf of the consignor or consignee:

-Organize the transportation of goods within the station and port;

-Organize loading and unloading of goods;

-Storage and preservation of goods;

-Consulting for shippers in transporting goods;

-Sign a transport contract with the carrier, charter a ship, store freight;

-Carry out procedures for sending and receiving goods;

-Carry out customs and quarantine procedures;

-Prepare necessary documents during the shipping and receiving process; -Pay;

-Receive goods from the goods owner, deliver them to the carrier and deliver them -to the consignee;

-Helping shippers in making complaints for compensation

According to FIATA's "Model Rules for Freight Forwarding Services," a freight forwarder is involved in various activities related to the carriage, consolidation, storage, handling, packing, or distribution of goods. Additionally, they provide ancillary and advisory services in connection with these activities, including:

 Declaring goods for official purposes

 Collecting or procuring payment or documents relating to the goods

Booking is a procedure in the transportation process, essentially it is the cargo owner making a reservation with the shipping company or international shipping company In case of using the service, the goods owner will get the booking form from Forwarder or can get it directly from the shipping company Once the price has been accepted, the forwarder will rely on the customer's order request - booking request to send the booking request to the booking shipping line Once the booking is confirmed, the shipping line will send the Booking confirmation form to the Forwarder The booking confirmation shows important information that the shipper must pay attention to and check carefully such as: number of containers, type of container, ship departure date, ship arrival date, ship name - trip number, departure port, arrival port , cut-off time, where to pick up empty containers, where to unload containers

A commercial invoice is a required document for the export and import clearance process It is sometimes used for foreign exchange purposes In the buyer’s country, it is the document that is used by their customs officials to assess import duties and taxes The invoice has important information such as: specific information of exporter-importer, invoice number, date of issue, shipping method, delivery conditions, payment conditions, quantity of goods and price

A **packing list**, also called a packing slip, serves as a crucial document in the transportation of goods This list meticulously details the items being shipped, facilitating efficient inspection, tracking, and handling throughout the shipping process.

Shipping instruction (SI) is the shipping/delivery instruction information from the exporter/shipper to the shipping/forwarding company Make sure the forwarder transports the goods according to the shipper's requirements. And limit the above errors on other delivery documents, especially on the bill of lading Shipping Line/Forwarder companies will require Shipper to send

SI to make a draft Bill of Lading After that, the draft will be sent to the customer to check and ask the customer to confirm the information on that Draft B/L Customers sending goods must pay attention to the SI cut-off time otherwise they may be fined or have their goods dropped

Some important information on the SI: Booking date and number, Name of designated carrier, Name of exporter (Shipper), Name of importer (Consignee) abroad, Name of goods, Quantity and type packaging, Net weight and VGM + CBM (1CBM = 1m3), Loading port, Loading port, Delivery time, Delivery location, Freight payment method (prepaid or after goods arrive ).

VGM (Verified Gross Mass) is a crucial document in import and export operations, acting as a receipt that certifies the combined mass (Gross Weight) of the container and its contents Its significance stems from the SOLAS (Safety of Life at Sea) convention, which mandates its use to ensure accurate weight information for maritime shipping, contributing to safety and efficiency in international trade.

- the convention for the safety of human life at sea, requiring the shipper to undergo VGM before the goods can be loaded on the ship VGM is for shipping companies to know the weight of cargo containers, so they can control the load and perform loading and unloading work on and off the ship.

Exceeding the allowable weight limit for shipping can lead to the rejection of goods by the carrier In such cases, the carrier may demand the removal of excess weight before loading the goods onto the vessel These measures ensure the safety and stability of the ship during transportation.

On the VGM slip there is some important information such as: Shipper name - address - phone number, Container parameters - container number, container type, largest volume, confirmation of largest volume

Customs declaration is an indispensable procedural document when exporting or importing a shipment Without this declaration, all activities related to import and export must stop The goods owner must declare details of the goods to the Customs authority Customs declaration helps state agencies make statistics and manage goods and means of import and export and is the basis for tax calculation for businesses The content in the declaration is quite a lot and complex, so it requires someone with professional expertise to be able to complete the information correctly and with all the information Contents in the declaration such as: Declaration number, inspection classification code, type code, branch code, declaration registration date; name and address of the exporter or importer; Detailed information about the shipment such as bill, storage location, loading and unloading location, means of transportation, arrival date, quantity of goods ; commercial invoice, invoice value; Taxes and tax in this part, after we enter the details of the items, the system automatically outputs them to us; section for customs system returns; notes section on customs declaration; list of goods

A bill of lading (BL or BoL) is a legal document issued by a carrier(transportation company) to a shipper that details the type, quantity, and destination of the goods being carried A bill of lading also serves as a shipment receipt when the carrier delivers the goods at a predetermined destination This document must accompany the shipped products, no matter the form of transportation, and must be signed by an authorized representative from the carrier, shipper, and receiver

A certificate of origin (CO) is a document declaring in which country a commodity or good was manufactured The certificate of origin contains information regarding the product, its destination, and the country of export.

2.5.1 Receive customer information, finalize prices a) Receive and process customer information registering for services, from forms such as email and phone THI's sales staff will receive customer information such as: Type of goods, departure port, destination port, quantity of goods, expected export time

- Based on the information provided by the customer, T.H.I staff will consider whether or not the product can be exported If the export is banned, it will be refused to avoid the company getting into legal problems later As for goods that meet the conditions, the staff will continue to advise customers to choose the type of container (if fresh goods, fresh vegetables and fruits will choose cold containers: 20'RF, 40'RH depending on the quantity of goods; general goods or For agricultural products, choose dry containers: 20'DC, 40'DC or40'HC "for bulky goods"), as well as the importing country's regulations on that item For example: food products must have a food hygiene and safety quarantine certificate, wooden products must be sterilized, etc.

- Departure port, arrival port: This is the factor that determines the shipping price because the closer the shipping distance and the shorter the shipping time, the lower the shipping cost and vice versa.

- Shipping line: depending on the incorterm that both parties agree to in the sale contract, the sales staff will advise customers on appropriate services and shipping lines.

- Estimated export time: staff depends on the time the customer needs to arrange a reasonable time

Specifically, at Minh Long DV Trading JOINT STOCK COMPANY company, there is a "plywood cabin" with a total weight of 75,200kg, volume of 1234,454 CBM. Expected date of export is February 27, 2024 and expected arrival is March 4,

2.5.2 Booking and exchanging empty containers

The sales department will base on the customer's Booking request and send the Booking request to the shipping line to make a reservation The cruise line will then confirm the successful booking to the sales department by sending Booking confirmation This Booking Comfirmation contains the following necessary information:

Port of loading: Hai Phong, Vietnam

Port of delivery: LAEM CHABANG, Thailand

Closing time VGM: 11.00HRS 24 FER

Closing time SI: 11.00HRS 24 FER

Closing time CDS: 11.00HRS 24 FER

After receiving a booking from the shipping company, the sales staff will send this booking to the customer so they can arrange packing and carry out export customs clearance procedures In this case, the forwarding department staff will monitor and coordinate with the customer to arrange for the empty container to be packed and transported to the port.

The Packing List plays a crucial role in customs clearance operations, providing detailed information on the characteristics and quantities of goods and packages By ensuring that delivery staff fully understand the nature of the shipment, it facilitates the selection of the most appropriate container for safe and efficient transportation The comprehensive Packing List prepared by THI Group serves as a valuable tool for both customs officials and delivery personnel, streamlining the clearance process and ensuring that goods reach their intended destinations in optimal condition.

- Names of woodply cabin types

VGM slip: inspects the volume of goods, this is a mandatory condition for shippers if they want containerized goods to be loaded onto the ship The documentation staff contacts the customer and urges them to prepare the VGM within the cut off time so that the staff can submit it to the shipping company, otherwise the goods will be dropped and not loaded on the ship The information in the VGM form includes:

- Container number: TEMU8416535/TXGU6896192/TXGU6767261-40’HC

- Total container weight: 29490KGS/29300KGS/27700KGS

- Name of unit and weighing address: MINH LONG DV JOINT STOCK COMPANY

The shipping clerk monitors the shipping instruction (SI) and requests customers to submit it prior to the cut-off time The SI serves as the basis for creating a draft bill of lading, which is sent to customers for verification and timely revisions if necessary The shipping line issues a draft bill of lading to T.H.I group Vietnam Company and the import forwarding company Conversely, T.H.I group issues a draft bill of lading to the shipping customer for confirmation of its accuracy.

2.5.4 Customs clearance of exported goods: a) Electronic customs data transmission:

-Yellow channel: Exemption from physical inspection of goods, documents transferred to tax calculation department to check details of documents If the application is valid, it will be transferred to the department leader for approval and customs clearance stamped (customs procedures completed) on the export declaration -
