Code: 62 31 02 04 Full name of PhD candidate: Le Thi Hang Training course: K31 (2015-2018) Supervisor(s): Assoc Dr Lai Quoc Khanh; Assoc Dr Ly Viet Quang Training institution: Ho Chi Minh National Political Academy Summary of the new findings of the thesis Ho Chi Minh's constitutional thought is a system of comprehensive and profound views on constitutional issues in Vietnam, from roles, subjects, constitutional content and conditions, with the core content of building democratic constitution That thought is result of a process of exploring and studying constitutional ideas and movements in the world as well as observing and experiencing real life through many countries around the world, closely associated with requirement of domestic and international practical situation The process of formation and development of Ho Chi Minh's constitutional thought was divided into two main periods The period before 1945 was a period of contacting, learning progressive constitutional thought in the world, forming basic views on constitutional issues The period from 1945 to 1969, Ho Chi Minh's constitutional thought was realized and in the process of directing to develop the constitution, he had supplements suitably with the actual situation of country The content of Ho Chi Minh's constitutional thought includes: view of the constitutional role in national sovereignty declaration, political identity and establishment of the state's legitimacy, recognition and creation of mechanisms to ensure human rights; view on the supreme subjects of constitutional rights and methods of implementing the constitutional right of the people; the view of state power organization according to the principle of collective rights, and at the same time absorbing the suitable elements of right decentralization thought to achieve the highest goal is to establish the Democratic Republic - the state based on a democratic basis, recognizing the people's ownership, democratic enforcement, democratic expansion for all classes of the people;
