không công nhận Bitcoin loại tiền ảo, hay tiền mã hoá tương tự khác, tiền tệ hay phương tiện toán hợp pháp Việt Nam Cụ thể, thực đạo Thủ tướng Chính phủ “tăng cường quản lý hoạt động liên quan tới Bitcoin loại tiền ảo tương tự khác (gọi chung tiền ảo)”, Thống đốc Ngân hàng Nhà nước Việt Nam (NHNN) ban hành “Chỉ thị số 02/CT-NHNN biện pháp tăng cường kiểm soát giao dịch, hoạt động liên quan tới tiền ảo” ngày 13/4/2018 Thống đốc Ngân hàng Nhà nước Việt Nam (NHNN) ban hành “Chỉ thị số 02/CTNHNN biện pháp tăng cường kiểm soát giao dịch, hoạt động liên quan tới tiền ảo” Tại Chỉ thị này, Thống đốc NHNN yêu cầu “các TCTD, tổ chức cung ứng dịch vụ trung gian tốn khơng cung ứng dịch vụ tốn, thực giao dịch thẻ, cấp tín dụng qua thẻ, hỗ trợ xử lý, toán, chuyển tiền, bù trừ toán, chuyển đổi tiền tệ, thực giao dịch toán, chuyển tiền qua biên giới liên quan tới giao dịch tiền ảo cho khách hàng phát sinh rủi ro rửa tiền, tài trợ khủng bố, gian lận, trốn thuế” “Mặt khác, TCTD, tổ chức cung ứng dịch vụ trung gian toán tăng cường rà soát, báo cáo kịp thời giao dịch đáng ngờ có liên quan tới tiền ảo; rà sốt tổ chức, cá nhân có giao dịch mua bán, trao đổi tiền ảo, tổ chức có hoạt động xử lý giao dịch mua bán, trao đổi tiền ảo có biện pháp xử lý đảm bảo tuân thủ quy định pháp luật phòng, chống rửa tiền, chống tài trợ khủng bố quản lý ngoại hối” Tuy nhiên, thấy rằng, thị trường tiền mã hoá ngày phát triển với tốc độ nhanh chóng với đa dạng hố loại tiền mã hố tăng trưởng mạnh quy mơ thị trường quy mô giao dịch sử dụng tiền mã hoá, thúc đẩy lan toả phổ biến tiền mã hố phạm vi tồn cầu Tổng giá trị vốn hoá thị trường đồng tiền mã hố (crytocurrencies), tính tới tháng 4/2017, đạt 27 tỷ USD, tăng gấp lần so với đầu năm 2016 (Hileman Rauchs, 2017), tiếp tục tăng trưởng lên đến 150 tỷ USD, tăng 800% vòng tháng đầu năm 2017 (Thái Hồng, 2017) Uớc tính ngành tiền mã hố tồn cầu, có khoảng 5.8 triệu tới 11.5 triệu ví tiền mã hố sử dụng có khoảng 2.9 tới 5.8 triệu người có tần suất sử dụng ví tiền mã hố cao (Hileman Rauchs, 2017), cho thấy mức độ ứng dụng tích cực đồng tiền mã hố giao dịch tốn Ngồi đồng tiền mã hố Bitcoin thống trị thị trường tiền mã hoá với giá trị vốn hoá thị trường lớn, loại đồng tiền mã hoá khác ETH, XMR, …, ngày tăng trưởng số lượng, quy mô mức độ phổ biến, chia sẻ thị phần với Bitcoin (Hileman Rauchs, 2017), góp phần đáng kể vào phát triển mở rộng thị trường tiền mã hố tồn cầu Với tồn phát triển tiền mã hoá thời gian gần đây, đặc biệt tiền mã hóa phát triển tảng blockchain công cộng (public blockchain) số lượng quốc gia kinh tế công nhận tồn tiền mã hoá cân nhắc cho phép sử dụng tiền mã hoá kinh tế quốc gia dần gia tăng, rõ ràng tiền mã hoá phát triển thị trường tiền mã hoá tương lai trở thành xu hướng thay lựa chọn quốc gia, bao gồm Việt Nam, đặc biệt kinh tế Việt Nam nói chung thị trường tài Việt Nam nói riêng ngày hội nhập sâu rộng vào thị trường khu vực quốc tế Do đó, việc nhận định tác động tiền mã hố, cụ thể tiền mã hóa phát triển tảng blockchain công cộng (public cryptocurrencies) kinh tế xu hướng phát triển tiền mã hố tương lai Việt Nam đóng góp phần quan trọng vào việc định hình quan điểm ứng xử Việt Nam tiền mã hoá thời gian tới dài hạn Xuất phát từ vấn đề nêu trên, đề tài “Những tác động xu hướng phát triển tiền mã hoá ứng xử pháp lý: Kinh nghiệm quốc tế gợi ý sách cho Việt Nam” lựa chọn nghiên cứu Tổng quan nghiên cứu Từ năm 1990, “tiền kỹ thuật số” (Digital currencies) tạo để đáp ứng yêu cầu thương mại hiệu (Sloan, 2000; Plassaras, 2013) Định nghĩa tiền tệ kỹ thuật số đưa Ủy ban Basel giám sát ngân hàng (BCBS), đề cập đến thiết bị đầu cuối toán trả trước để lưu trữ giá trị tiền tệ, mà chuyển giao thiết bị điện tử có kết nối Internet (BCBS, 1998) Tiền tệ kỹ thuật số tài sản lưu trữ dạng điện tử mang đầy đủ đặc điểm loại tiền truyền thống gồm: Thước đo giá trị, phương tiện trao đổi cất trữ giá trị Tiền tệ kỹ thuật số khơng có biên giới địa lý trị; giao dịch thực đâu giới Một dạng phổ biến tiền kỹ thuật số tiền mã hoá - “Crypto currencies” hay “Cryptocurrencies” Tiền mã hóa ám phát triển cơng nghệ, sử dụng cơng nghệ mã hóa việc bảo mật thơng tin thơng qua việc chuyển hóa thơng tin sang dạng khơng đọc giải mã người sở hữu thông tin cung cấp khóa bảo mật (Houben Snyers, 2018) Cryptocurrency (tiền mã hoá) giao thức mật mã hay hệ thống mã hoá phức tạp dùng để chuyển hoá liệu nhạy cảm nhằm bảo tồn giá
