Accountability of Local Authorities (ALA) in a systematic and comprehensive manner is derived from the following reasons: First, the theory of the ALA in Vietnam has not been fully and comprehensively studied The problem has not been clarified, there are still various debates, which cannot explain the various practices of social life Second, the current legal provisions on of the ALA in Vietnam are limited, many regulations are not appropriate; the implementation mechanism the ALA has not been clearly defined; The content of legal adjustments of the ALA has not been fully regulated Third, the practice of implementing the ALA is considered to be a weak stage, especially, for the people, socio-political organizations, social organizations and mass media are still limited, the efficiency is not high Fourthly, the requirement of effective implementation of legal provisions related to of the ALA is provided in the 2013 Constitution and new legal documents Finally, the new requirement for the process of building and perfecting the socialist rule of law State; realizing socialist democracy; guarantee of human rights, civil rights; trend of globalization and international integration; the fourth industrial revolution The purpose and mission of the thesis 2.1 Purpose: To build a scientific justification for proposing views and solutions to increase the ALA in Vietnam 2.2 Tasks: To systematize, analyze and comment on domestic and foreign research projects related to the research topic; Analysis and establishment of concepts, characteristics, and classification, scientific basis for establishing accountability of local governments, legal concepts and features of accountability submission by local authorities; Systematize and analyze the content of basic law adjustments on the ALA and the factors affecting the accountability of local governments; Analyzing and assessing the current state of the law on ALA in Vietnam, recognizing the achieved results, limitations and causes; Build common awareness about accountability of local authorities and propose views and solutions to enhance the ALA in Vietnam Object and scope of the study: 3.1 Research subject Scientific views related to Accountability and ALA ALA system of relevant legal regulations; Practical implementation of the law on ALA in Vietnam; Experience in regulating ALA legislation in a country has been suggestive to Vietnam; Factors influencing ALA formulation and implementation in Vietnam 3.2 Scope of the study About space: nationwide In terms of time: it is ALA according to the Vietnamese law since 1946, focusing mainly on the current law provisions Content: is ALA under Vietnamese law, on the basis of the specialization of Constitutional Law and Administrative Law With the ALA scope of theory: contribute to supplement and clarify a number of theoretical and legal issues about ALA in Vietnam Provide more scientific evidence for the identification of opinions and solutions that individuals with authority, in particular, has meaningful implications in implementing the law on accountability in localities, in order to meet the changing requirements that are taking place today 4: Perspectives and solutions to increase accountability of local governments in Vietnam today CHAPTER OVERVIEW OF RESEARCH ISSUES RELATED TO THE THESIS 1.1 Overview of domestic and foreign research related to the topic 1.1.1 Research situation on the theoretical issues of accountability and accountability of local authorities related to the topic: There have been a number of research projects related to this issue, each work is approach under different angles and aspects, focusing on issues such as: concept, form, scope, content, classification of Accountability and ALA For foreign accountability and accountability of local government: There have been a number of works mentioning the state of state's accountability, State Administrative Agencies ( SAA), in anti-corruption, in certain content / areas… in which, ALA is mentioned at different levels Some works have mentioned the current state of the law on Accountability and ALA in Vietnam, on the basis of the provisions of the Constitution, Laws, sub-laws, as well as assessments of the implementation in Different levels 1.1.3 Research situation on issues related to views, orientations, solutions to improve accountability and accountability of local authorities: Focus on state Accountability, SAA, prevention corruption… in which, to a certain extent, the law on ALA 1.2 Comments on the research situation solutions to enhance ALA in Vietnam in the coming time 1.3 Research hypothesis and research questions 1.3.1 Research Hypotheses: The current implementation of ALA law in Vietnam is ineffective and limited The reason is that there are still many shortcomings in the theoretical issues and laws about ALA Therefore, the requirement is to continue to study systematically the theoretical issues and legal status of ALA in Vietnam, on that basis, to build up views and solutions to enhance ALA in Vietnam today 1.3.2 Research questions: How is ALA understood and what are its characteristics? How is ALA classified as appropriate? On what scientific basis was the ALA established? How is the law on ALA understood and what are its characteristics? What are the basic elements of the amendment of the ALA law? What factors affect ALA? How is ALA in Vietnam regulated by the law? Has the practice of implementing ALA in accordance with Vietnamese law been achieved and limited? What is the reason for the restriction? To strengthen ALA in Vietnam in the coming time, what opinions should be grasped and solutions to be taken? CHAPTER THEORETICAL ISSUES OF ACCOUNTABILITY OF LOCAL AUTHORITIES 2.1 Local Authorities (LA) and Accountability of Local Authorities ( ALA) 2.1.1 The concept of local authority: is an integral part of the unified state government, including the system of representative offices (People's Councils) and administrative agencies (People's Committees) or administrative agencies by local people Elected localities to perform the state management function within a certain territorial administrative boundary 2.1.2 The concept and characteristics of local government accountability - The concept of Accountability: is the responsibility of public agencies and individuals who have the authority to actively or upon request to provide information, explain and clarify the contents related to the performance of assigned tasks and powers and take responsibility for the performance of such tasks and powers according to the provisions of law - The concept of ALA: is the responsibility of public agencies and individuals who have the authority to actively or upon request to provide information, explain and clarify the performance of assigned tasks and powers and take responsibility for the performance of such duties and powers in accordance with the law - Characteristics of ALA: implementing entity is the local governmental authority established by the state, which is assigned certain 2.2 The rationale for establishing accountability of local authorities 2.2.1 Implementing the principle of people's sovereignty - the foundation for establishing accountability of local governments: as the supreme master of state power, the people must have the right to know about state agencies from from central to local levels and how the representatives who exercise power are delegated by the people 2.2.2 Implementing the principle of the assignment of authority between central and local governments - the basis for establishing the accountability mechanism of local governments: this is an important basis for establishing the local government in the process exercising the assigned authority must be accountable to the superiors, accountable to the local community and the organizations representing the community 2.2.3 Position and role of local government - the basis for building the legal basis of local government's accountability: Legislation must be institutionalized into specific tasks, powers and responsibilities, in Therefore, an ALA implementation mechanism must be established levels with the superior administrative committee or the Government Council, the General People's Councils at the same level and People's Committees at higher levels 3.1.4 Constitutional period 1992 and Law on Organization of People's Councils and People's Committees in 1994 and 2003: laws are more clearly defined, some new contents are mentioned such as: Citizens have the right to information according to regulations of the Law Chairman of the Vietnamese Fatherland Front Committee in the locality is invited to attend meetings of the People's Council and People's Committee at the same level when discussing relevant issues Press agencies have the right to request information Especially, the birth of Decree 90 / ND-CP dated 8/8/2013 regulates 12 on traffic accidents of state agencies in the implementation of assigned tasks and powers 3.2 Current situation of legal regulations on accountability of local authorities in Vietnam today 3.2.1 The subject of the explanation: they are: the People's Council, the Standing Committee of the People's Council, the Committees of the People's Council, the Supervisory Team, the Delegate Committee of the People's Council, the delegate of the People's Council, the People's Committee, the Chairman of the People's Committee, the Head of the specialized agency under the People's Committee 3.2.2 Subjects requesting explanations: they are: i) Local people, People's Council (Standing Committee of People's Council, Committees of People's Council, Supervisory team of People's Council, Delegate of People's Council, Delegate group of People's Council), People's Committee, individual who has authority (Chairman of the People's Committee, the head of a specialized agency under the People's Committee) ii) Superior state agencies and competent individuals: the Standing Committee of the National Assembly, the Ethnic Council, Committees of the National Assembly, the Supervisory Teams of the National Assembly, the Government, the Prime Minister, Ministers, and Prime Minister Head of ministerial agencies iii) The Vietnam Fatherland Front, sociopolitical organizations and press agencies 3.2.3 The content of the explanation: is the duties and powers specified for rural LA and urban LA is regulated In particular, the Council; report, make public, transparent, provide information, receive citizens, make dialogues of agencies performing the state management functions on branches and domains in the locality according 3.3 Current practice of implementing the local government's law on accountability in Vietnam 3.3.1 Implementation of accountability to the people: SIPAS index: (i) Information channel accessing regulations on administrative procedures: 73.60% of respondents access regulations on administrative procedures through civil servants at the place of submission applications, 25.19% through public listing at the place of submission, 4.92% via internet, 4.52% via relatives and friends and 0.59% through other forms (ii) Satisfied with administrative procedures: 86.99% of the respondents were satisfied with the transparent public disclosure of administrative procedures; 86.32% are satisfied with fully public administrative procedures; 87.78% were satisfied with the correct submission of documents; 86.46% are satisfied with the correct payment of fees / charges and 84.46% are satisfied with the deadline for handling their jobs (iii) Satisfied with the receipt and processing of comments, feedback and recommendations: 97.96% highest, 41.89% PAPI Index: (i) Public , 15 transparency in decision-making: has improved significantly Land acquisition is always a sensitive issue, but denunciations, not arising too many complicated hot spots 3.3.2 Implementing the accountability of the People's Committee to the People's Council: Questioning and answering questions: gradually improved, becoming more and more practical Many provinces and cities have combined questioning and thematic supervision in a number of areas to make the questioning activities concentrated, clarify many problems on a large scale, offering many practical solutions Reviewing the work report of the People's Committee at the People's Council: the meeting report is meticulously prepared, adhering to the provisions of law, documents of superior state agencies, in accordance with the resolution of the People's Council at the same level and local practice The explanation at the explanation session of the Standing Committee of the People's Council: enhancing the role of the Standing Committee of the People's Council, the Board of the People's Council, supported by the voters and the people, partly meeting the aspirations and expectations of the voters Help the Standing Committee of the People's Council, committees, delegates group and provincial People's Council deputies have a basis to supervise the implementation of promises 3.3.3 Performing accountability within local state administrative agencies: make good publicity and transparency of contents as prescribed by law Publicizing the above legal policies 17 3.4 An assessment of the current state of the law on accountability of local governments in Vietnam 3.4.1 Current situation of local government's (LA) due diligence regulations: General assessment: Initial legal basis for LA to perform due diligence; affected by many factors of politics, economy, culture, society including the legal regulations on LA's organization and operation, the tendency to increase autonomy for LA; The legal content has been increasingly clear and complete Limitations and shortcomings: is provided scatteredly in many different legal documents; mainly refers to the accountability when required, the accountability when deeming it necessary has not been specified; mainly emphasizing the responsibility to comply with the regulations on the right implementation, the accountability mechanism associated with work performance has not been mentioned much; The current legal regulations still have many shortcomings; ALA as a unified institution is not clearly specified 3.4.2 Current practice in implementing the law on accountability of local governments in Vietnam: General assessment: accountability to the people: positive changes have been made; accountability of the People's Committee and competent individuals to the People's Council: has positively impacted the operation of state agencies in the locality, creating a certain change in the process of organizing and implementing tasks , power; accountability within the State's administrative agencies: there has been a clear shift through publicizing administrative procedures, providing information to the press, and dialogue of LA; accountability for superior state agencies: ensuring the timely provision of information, meeting the requirements of direction and administration; accountability to the 18 Vietnam Fatherland Front and the mass media: many comments and recommendations after monitoring were received and responded to by functional agencies, with appropriate adjustments; accountability in anti-corruption has achieved encouraging results Limitations and weaknesses: Access to information about public services via the internet is still too low compared to the goal of building egovernment and applying information technology; land publicity and transparency are still limited; the level of contact between the people and the government is still very limited; the questioning and answering activities have not met the requirements; the explanation at the Standing meeting of the People's Council still has many limitations; reporting to the People's Council was sometimes not focused, avoiding difficult and complicated problems; The abuse of information security, lack of publicity and transparency with the people and internally is still happening in many places 3.4.3 Causes of limitations and weaknesses: i) Lack in legal provisions on ALA ii) legal regulations on accountability at the Standing meeting of People's Council are not specified on many contents iii) Shortcomings in the legal regulations on LA's organization and operation related to LA iv) the guiding documents on LA's organization and operation were not timely issued v) openness and transparency in the organization and activities, as well as in a number of contents / areas of operation of LA agencies are still limited vi) the provisions on accountability in anti-corruption still reveal limitations vii) Inadequate awareness of agencies, organizations and individuals, especially the head of accountability and implementation viii) the supervision, inspection and control of the implementation of the law on ALA have not been given due 19 attention by agencies, organizations and leaders ix) results of metrics indicators for PAPI, PCI, SIPAS… have not been institutionalized, aiming at binding responsibility to LA CHAPTER VIEWPOINTS AND SOLUTIONS TO STRENGTHEN THE ACCOUNTABILITIES OF LOCAL AUTHORITIES IN VIETNAM TODAY 4.1 The current view of increasing accountability of local authorities in Vietnam 4.1.1 Consistent with the Party's viewpoints, lines and guidelines on enhancing the accountability of local authorities: specifically the views and paths on innovation of the organization and operation of local agencies, autonomy and self-responsibility responsibility of local agencies; on traffic accidents in anti-corruption; building and perfecting the rule of law state; role model of the head 4.1.2 Ensure the consistency and compliance with the provisions of the Constitution, Laws and other legal documents: especially the principles of the organization and operation of the power mechanism in the political system and apparatus the state in the Rule of Law 4.1.3 Ensuring the consistency, effectiveness and efficiency agencies and control mechanisms of political organizations, sociopolitical organizations and other social organizations 4.1.4 Meeting the state administrative reform objectives at the current local authorites: administrative institutional reform of LA's organization and operation; to elaborate and perfect the provisions of 20 law on the relationship between the State and the people; perfecting the decentralized management mechanism; implementing the onedoor, one-door mechanism 4.1.5 Ensuring the implementation of socialist democracy, building an open and transparent environment: ensuring people participate in all stages of the process of making relevant decisions; promote social democratization to promote the people's mastery, the active and creative role of the Vietnam Fatherland Front and mass organizations; strengthen the legislation, uphold civic responsibility, uphold discipline 4.2 Solutions to strengthen the Accountability of Local Authorities in Vietnam today 4.2.1 Solution to perfect the law on Accountability of Local Authorities 4.2.1.1 Continue to improve and concretize legal provisions on decentralization, decentralization, and authorization for local governments: continue to improve regulations to renew the organizational model of local authorities; concretize the regulations on decentralization, decentralization, and authorization 4.2.1.2 Complete regulations related to the accountability at the meeting of the People's Council: clearly define the responsibilities before, during and after the explanation session of agencies, organizations and individuals participating in the explanation session; stipulates the form of the document when the Standing Council of the People's Council considers and approves the conclusion that the problem is explained; specifying legal consequences for implementing the conclusions of the explanation session 21 4.2.1.3 Amending and supplementing a number of provisions to improve the monitoring performance of the People's Council: amending Point c, Clause 4, Article 87 of the Law on Local Government Organization 2015; adding regulations on ensuring the right amount of questioning meeting time 4.2.1.4 Complete other legal provisions related to the Accountability of Local Authorities amending and supplementing legal provisions on anti-corruption; perfecting legal provisions on the right to access information; perfecting legal provisions in the Law on Citizen Reception; completing legal provisions in the Law on Vietnam Fatherland Front; continue to improve regulations in the Law on Supervisory Activities of the National Assembly and People's Councils; amending and supplementing a number of provisions in the Press Law 4.2.2 Solution for implementing the law on Accountability of Local Authorities 4.2.2.1 Organize the effective implementation of the state administrative reform contents in order to strengthen the accountability of local authorities: continue to effectively reform the contents of administrative reform; improving the capacity, quality and service attitude of the contingent of cadres, civil servants and public employees; implementing administrative modernization 4.2.2.2 To seriously and fully implement public and transparent contents in activities of local authorities and people's right to access information, organize: Continue to improve the efficiency of people accessing information with the activities of the government and the public administrative services provided by the government, 22 especially, effectively implementing the publicity and transparency in the activities of the local State's administrative agencies 4.2.2.3 To well perform citizen reception at state agencies in local governments: strictly comply with legal provisions on citizen reception, especially regulations on regular and irregular citizen reception; well implement the mechanism of supervision, inspection and examination of citizen reception in the locality; to promulgate plans and procedures for the inspection, examination and handling of violations in the implementation of the Law on Citizen Reception; renewing the citizen reception, enhancing the responsibilities of the Chairmen of the People's Committees at all levels and the Heads of the State's administrative agencies 4.2.2.4 Expand the participation of people and organizations representing the people in order to promote Accountability of Local Authorities: improving people's ability to access accurate and timely information; expand the scope of activities of social organizations representing the people 4.2.3 Solutions to ensure the implementation of the law on Accountability of Local Authorities 4.2.3.1 Raising awareness and responsibility of cadres, civil servants and heads of state agencies in local governments in carrying out accountability: Authorized officials and civil servants need to receive The formula focuses only on the on-demand accountability provisions For the head, it is necessary to well lead, direct, administer, inspect, supervise and urge agencies; to promulgate and organize the implementation of the internal rules and
