system of legal documents and professional guidance was built synchronously; the number of public servants in the archives field has increased in number and quality, basically meeting the work requirements set out; Through multilateral and bilateral international cooperation, Vietnam archives has many opportunities to participate in international activities to exchange and access to new issues in archives management In addition to the achieved results, the state management of archives still has some shortcomings such as: The lack of stability in the organization of the local archives, the records of some agencies is not well organized; records formed in the operation of state agencies have not been implemented in accordance with the Law on Archives; the status of unsolved, cumulative documents that have not been classified or revised are still very common; Many valuable records are in a state of deterioration or loss in agencies and organizations from the central to local levels Some provisions of the Archives Law of 2011 are not reasonable; The quality of some guidance is not high, not yet complying with the principle of centralized and uniform management in the work of archives, and there is still a lack of administrative sanctions in the archival field The policies for for public employees working in archives is in need to change Besides, the process of international integration and the achievements of the public revolution Industry 4.0 has affected archives such as the appearance of electronic documents, big data requiring employees of the archives must have a background in information technology and foreign languages New issues for the operation of archiving in our country such as electronic filing, transfer and management on the electronic document network, insurance of archives, declassification of archives is still a matter that has not been properly addressed In the process of international integration, the search for reasoning, learning, acquiring the achievements of the state management of archives of the countries in the world has an important significance Therefore, it is necessary to seriously study the new public management model and consider the possibility of applying a new public management model in the state management process of archives in Vietnam for archives’ work organize and enforce effectively to improve the effectiveness, efficiency and reduce violations in storage Given that rationale, the researcher embarks upon the research "State management of archives in Vietnam today", with hope to make more theoretical and practical contributions to archives state management in Vietnam Research objectives and tasks 2.1 Research objectives The dissertation is aimed to clarify the state management of archives (SMA) in a scientific manner; judge the SMA practice in Vietnam; and recommend a set of solutions to the renewal of SMA modality so as to improve it Thereby, the dissertation will help improve the quality and effectiveness of public administration in Vietnam in general and archives management in particular 2.2 Research tasks To provide an overview of the international and domestic practice of SMA research, thereby pointing out issues that need further study within the dissertation scope To provide a systematic theory in SMA and the possibility to apply New Management into archives in Vietnam To provide an analysis and judgment of SMA practices in Vietnam To propose solutions for renovation of SMA to improving SMA quality and effectiveness in Vietnam in the future Research objects and scope 3.1 Research objects The research object of the dissertation is defined to be the SMA activities in Vietnam 3.2 Research scope - Research contents Research into the substance, form, method for SMA Research into SMA theories, models in the world, and SMA activities in some typical countries Research into SMA planning; the law on archives; organizational structure and civil servants in archival field; the management of scientific research, application of science and technology in archival work; results of training and retraining civil servants and archives; inspection and handling violations of law, international cooperation - Spatial scope Research into state administrative agencies in Vietnam - Temporal scope Domestic state management of archives since 2011 (the year in which the Law on Archives was enacted) to the present (2019) Research hypotheses Archives are important for providing information for socio-economic development and management activities, national defense and security SMA in Vietnam currently has some limitations The research and application of a synchronous, science-based solution system of new public management and practice will help the state management of archives meet the requirements set in the new context Questions to be answered include: Why we need to carry out SMA? How should SMA be organized in Vietnam? What are the achievements and limitations of SMA in Vietnam? What factors affect SMA? What are the views and solutions to improve the state management of storage in Vietnam today? Research methods 5.1 Research methodology The dissertation adopts dialectical materialism and historical materialism as methodology; is based on the theoretical foundation of Marxism-Leninism and Ho Chi Minh's thought; views and guidelines of the Communist Party of Vietnam on building a socialist rule-of-law of the people, by the people and for the people 5.2 Research methods Literature and practice review, interviews methods are used as a means to gather and classify data and materials about international and domestic SMA as a way to form primary data for the dissertation Qualitative and quantitative comparison and analysis are used study the nature of problems so as to form secondary data Based on these findings, PEST analysis tool is used to judge realities, SWOT analysis tool to assess the strengths and weaknesses of SMA in Vietnam, thereby synthesizing and coming up to conclusions and theoretical test The methods of abstraction and modeling are used to identify and define the SMA subjects, model and mechanism in Vietnam and to discover reasoning New contributions As an in-depth study of SMA, the dissertation has the following new points: Completing the theoretical rationale for SMA: Demonstrating the role, significance and effect of SMA in state power control Defining the characteristics, contents, forms and models of SMA in Vietnam Proposing the renewal of SMA solutions to improving the quality and efficiency of SMA in contemporary context and the possibility to apply New Public Management model into the SMA in Vietnam Research findings will be added to the theoretical system of SMA Realistic arguments will be helpful for the organization and management of archives, policy development and enforcement in Vietnam This is also a reference for researchers, teachers and students of SMA training institutions Dissertation composition and structure In addition to its introduction, conclusion, list of references and annexes, the dissertation is structured into four chapters: Chapter 1: Overview on the research practice of state management of archives Chapter 2: Theoretical basis for state management of archives Chapter 3: Realities of state management of archives in Vietnam Chapter 4: Solutions to improving state management of archives in Vietnam Chapter OVERVIEW ON THE RESEARCH PRACTICE OF STATE MANAGEMENT OF ARCHIVES 1.1 Research works relevant to state management of archives (SMA) 1.1.1 Domestic research relates to New Public Management The theory of New Public Management was born in the 1980s of twentieth century in developed countries, primarily in the UK and USA New public management is considered as an essential part of management thought or management doctrine based on ideas formed from the private sector and applied to the public sector There are a number of the research works on state management " Measuring and evaluating the efficiency of state management Achievements in the world and applications in Vietnam " (2012), Nguyen Dang Thanh, "Understanding American Public Administration, Theory and Practice " (2012), Nguyen Dang Thanh and Nguyen Huu Hai, " Public Management "(2013) by Bui Huy Khien , Nguyen Thi Van Huong, " Human resource management in public sector: Theory and experience of some countries " (2015), Nguyen Thi Hong Hai, Nguyen Thi Thanh Thuy, Le Thu Hoai, Ministry-level scientific research project " New public management and application to Vietnam's administration " (2010) by Nguyen Van Dung, " Decentralization of state administrative personnel management in Vietnam today " (2016) by Hoang Mai, The authors mentioned the origin, new public management concepts and theories and application of new public management models in the United States The authors also explained that the issue of new public management must be a universal key, a model for all The authors introduced the application of public management model in countries and solutions to most successfully apply the characteristics of the new public management model to specific conditions of Vietnam Leaders, policy makers and researchers must thoroughly study the characteristics of the new Public Management model as well as draw lessons from the countries that successfully applied or failed this model, then determine the level of application of each administrative reform solution under the new Public Management model to the practical conditions of Vietnam accordingly The above works are important sources for the author to study new public management model in the state management of archives in the current context 1.1.2 Domestic research relates to SMA Some authors (Van Tat Thu, Nguyen Văn Tham, Duong Van Kham, Nguyen Canh Duong, Tran Hoang, Vu Thi Minh Huong, Nguyen Manh Cuong, Vu Thi Thanh Thuy) have referred to state management of archiving during their works The authors mention the definition of archives, state management of archives, the role of state management of archiving The authors also focused into some contents of state management of archives such as issuing the law on archives; building organizational structure and a system of civil servants in archives; organizing the management of scientific research, application of science and technology in archives; inspecting, examining, settling complaints, denunciations and handling violations of the archival law as well as a number of issues related to the current situation and solutions for state management of archives This is a valuable document referenced by the author during the writing of the dissertation Those research has provided an overview of the formation and development process of state management on archives in Vietnam today 1.2 International research works relevant to SMA 1.2.1 International research relates to New Public Management The research work "Civil service systems in Asia" (2001) by Burns, John P, Bowornwathana, introduces practice and compares civil service systems of some Asian countries The book "Civil service reform" (1996) by Constance Horner, Patricia w Ingraham, Ronald P Sanders, refers to the trend of public service reform, which mainly apply the achievements in the private sector into public The book “ The New Public Management and Public Management Studies” (2017) by Ewan Ferlie introduces new public management, public management models in countries around the world, analyzing achievements and limitations of public management models in countries Author Erik Hans Klijn I from Eramus Rottedam University, Netherlands with the article " New Public Management and Governance: A Comparison" analyzed on the basis of comparing the characteristics of the new public management model and governance model The author argues that, while the new public management model applies many elements of the market economy, the state governance model focuses on solving the complex problems of the economy and the tendency of cooperation between public service providers The book "To Serve and to Preserve: Improving Public Administration in a Competitive World" (2000) by S Chiavo-Campo and PSA Sudaram (Asian Development Bank is a fairly comprehensive research work on regarding new public management In the practical conditions of Vietnam, the research works of foreign authors are feasible suggestions such as promoting decentralization, empowering local governments 1.2.2 The international research works related to SMA In general, the researchers have mentioned state management of archives including the theoretical state management of archives, current situation and challenges in the future Book "Modern Archives: Principles and Techniques” (1956) by Theodore Roosevelt Schellenberg, a famous study of an American is about the archival practices of the United Kingdom, France and the United States The article "The Future of Archives and Recordkeeping: A Reader" (2011) by Duncan Birrell, mentioned the challenges of archival work in the 21st century and propose approaches to the development of the work l advantages of a storage perspective readers The book "Archives and Recordkeeping: Theory into practice " by (2013) Caroline Brown provides an overview of the contents of the archival work, from the concept, the implementation in practice as well as the impact of the archives on social life The author also assesses the impact of information technology on archives, the management of electronic document trends and the application of information technology in archives 1.3 Research findings 1.3.1 International and domestic research works can be referred into the dissertation The findings through the research works as follows: Firstly , the research works have come up with a general system of theoretical SMA such as management concept, archives, state management concept; principles of SMA, factors affecting SMA of countries in the world as well as in Vietnam Secondly, the authors describes a number of aspects related to the SMA in Vietnam today, evaluating the advantages and disadvantages of SMA in Vietnam today Thirdly , the authors have raised a number of views and solutions on SMA such as improving the system of state management documents on archiving, management organization, training, foster the capacity of civil servants and archives in the archival field in Vietnam today 1.3.2 Issues need to be further studied Firstly , the research works related to the dissertation topic have not clarified SMA fully, systematically Secondly, the works have not not yet fully assessed the status of SMA in Vietnam at present, especially the period after 2011 in the context of the implementation of the Law on Archives in 2011 until now Thirdly , the works have not given the overall solution for SMA in the current conditions in Vietnam Chapter THEORETICAL BASIS FOR STATE MANAGEMENT OF ARCHIVES 2.1 Concepts of SMA In this research work, the concept of management is defined as follows: management is the impact of managers to achieve the goals and request on certain based on objective law The concept of state management: activities of the state power, using state power to regulate social relations State management is considered a functional activity of the state in social management and can be considered as a special functional activity New public management concept: a vision, a doctrine, a set of management techniques that are transformed from the private sector to the public sector Definition of archives: There are many different interpretations of archives Archives are understood to be consistent with (1) records, (2) an archiving agency, storage (3) archives operations ( 4) archives work Many documents, scientific papers related to archives as one of these understandings Within the scope of this dissertation, due to the diversity of archives terms with many different interpretations mentioned above, to limit and unify the thorough understanding of the terminology archived in the dissertation, based on the total results The author considers the concept of archiving as follows: Archiving is an area of state activities including all the theoretical, practical and legal issues related to the organization of science, preserve and organize the effective exploitation and use of archives in service of national interests, agencies, organizations and individuals State management: is an activity of state power, using state power to regulate the social relations arising in the field of archives The dissertation analyzes the role of SMA in ensuring information for management activities, improving work efficiency, meeting the requirements of organizations and individuals; protecting the confidentiality of information related to agencies, organizations and individuals and promoting regional exchanges and international integration 2.2 The requirements of New Public Management to SMA The dissertation explored the concept of new public management, stating the need for innovation in SMA in Vietnam The application of a new public management model has been set for the SMA following basic requirements: Firstly, ensuring the effectiveness; Secondly, building a flexible mechanism, minimizing procedures; Thirdly, strengthening decentralization; Fourthly, partial privatization of state activities ; Fifth, applying market factors to best serve citizens; Sixth, applying corporate management methods; Seventh, applying achievements of the 4.0 industrial revolution in SMA Content of SMA The dissertation focuses on the construction and improvement of the law on archives; Building organizational structure; Managing the training and retraining of archivists and public employees; management of scientific research, application of science and technology in archival work; Inspecting, examining and settling complaints and denunciations and handling violations of the law on archives; emulation and commendation in archives and international cooperation on archives 2.4 Factors affecting SMA In order to improve the effectiveness of the SMA in Vietnam, it is necessary to consider and evaluate the factors affecting this work, namely: Guidelines, policies and regulations, State management apparatus on archives, Capacity, qualifications of the contingent of civil servants, Requests for access to information of people and organizations increase, Progress of science, technology and Requirements of international integration 2.5 SMA experiences in some countries and the lessons for Vietnam From the model and experiences of SMA of countries in the world, we can apply in Vietnam: - Firstly, regarding the position of the archiving agency: In many countries, archives agency is under the highest executive body such as the Office of the President, the Prime Minister and the Office of the Government In the process of streamlining the apparatus of Vietnam, it is possible to reorganize following this model, in order to strengthen the position of the state management archives agency - Secondly, on the function of the state management agency in charge of archives: The archives of the countries in the world perform two functions: state management in the field of archives and direct management of national archives Currently, Vietnam also follows this model, however, due to the existence of a parallel system of the Party archives, it is necessary to consider and consolidate the archives, possibly refer to the model of the archival establishment - Thirdly: It is necessary to consider the organization and operation of the attached agencies and organizations with the advancement of electronic document management while incorporating traditional management of paper documents - Fourthly, many countries have laws and regulations that define the centralized and unified management role of the National archives Vietnam can learn experiences in organization and management policies for archives; authority of archives inspectors; prohibited acts and fines; time limit for submission of documents for archival and historical archives; time limit for access to archives subject to state secrets and private secrets; value of archived authentication; bringing archives abroad These are issues that need to be approached by the trend of international economic integration in Vietnam In particular, Vietnam's archival management agencies can learn the experience of other countries in issuing violations, a tool to ensure the effectiveness and efficiency of SMA Besides, implementing electronic government management can be learned Chapter REALITIES OF STATE MANAGEMENT OF ARCHIVES 3.1 Realities of SMA in Vietnam from 2011 to now This chapter analyzes of SMA in Vietnam, focusing on the following activities: Planning, Improving the law; Building organizational structure; Managing the training and retraining of archivists and public employees; management of scientific research, application of science and technology in archival work; Inspecting, examining and settling complaints and denunciations and handling violations of the law on archives; emulation and commendation in archives and international cooperation on archives 3.2 Findings about implementation of SMA 3.2.1 Advantages 10 Firstly, the awareness of leaders at all levels about the value and importance of archives has been significantly improved Over the past years, the leaders of the Party and the State have paid special attention to archives National Assembly Chairwoman Nguyen Thi Kim Ngan visited the National Archives Center III on July 26, 2018 and at the opening ceremony of the Exhibition on President Ho Chi Minh at the headquarters of UNESCO in Paris, France on March 31, 2019 Prime Minister Nguyen Xuan Phuc presented at the exhibition on the occasion of the 990th anniversary of Thanh Hoa Deputy Prime Ministers Truong Hoa Binh and Vu Duc Dam have worked with archives agencies and provided instructions to promote the value of archives and electronic documents Besides, with the strengths of information technology and social networks, people have known about the archives, the value of archives and increased exploitation to serve social needs Secondly, the implementation of SMA has initially brought into effect and effectiveness The National Archives Ordinance No 34/2001 / PLUBTVQH10 of April 4, 2001 of the National Assembly Standing Committee affirmed that "the archives are the heritage of the nation" In order to carry out the task of archives management, a quite comprehensive and synchronous system of documents on archives has been issued, providing an important legal basis to build, consolidate and develop archives in our country Many legal documents have entered into emerging issues related to the socialist-oriented market mechanism such as the Law on Archives 2011 and a number of Decrees Property ownership issues (Clause 3, Article of the Law on Archives), management of personal documents, families, lineages ( Article of the Law on Archives), sale and purchase agreements documents (item c, Clause 3, Article of the Law on Archives), matters of deposit of documents and historical archives (Clause 2, Article 25 of the Law on Archives), the time limit for declassification of documents for confidential documents, documents related to individuals (Article of the Storage Law)… Thirdly , the unified agencies to perform the state management of archives has been established from the central to local levels A network of historical archives (non-business units) is established at central and provincial levels The payroll of public servants and 11 employees working as archivists has been step by step strengthened; professional training and fostering were focused on and better meet the work requirements of the authorities and society in the current period Fourthly , facilities and funding for archives has been granted on key tasks such as the renovation, upgrading or construction new archive; procurement of storage equipment; training and retraining; organizing document editing, digitizing documents and applying information technology into archives Finally , the value of archives has been promoted at agencies, organizations and individuals 3.2.2 Limitations of SMA Firstly, the policy of unified management of the National Archives Font of the Socialist Republic of Vietnam has not been strictly regulated in state management documents and has not been implemented in practice with a parallel of National Archives and Communist Party's Archives That leads to difficulties for agencies Secondly , the local archives organization system is often changed and unstable; Thirdly, low archivist’s career status, low wage and salary regime not meet the needs of life; professional allowances for archives workers have not been given adequate attention, which has greatly affected the quality and performance of archivists Fourthly, in some agencies, valuable documents are being degraded, the funding for archival operations is limited Fifthly, there is a lack of important legal bases on issues such as ownership of archives, private archives, regulations for archival work in private enterprises, domestic enterprises in Vietnam Sixthly, there is still a problem of management of confidential documents' content There exists situation where ministries, branches and localities hire private enterprises to participate in the cataloging and digitalization of documents with confidentiality level, leading to the loss, and disclosure of confidential information Seventhly, the content of some documents is lack of unity between Archive Law and others Eighthly, there not exist sanctions as a way to force state agencies to act in SMA 3.2.3 Cause of limitations 12 The reason leading to the limitations is the management and state policies on the development of the archives, which still have many shortcomings and the unstable organization of the system in the locality The process of international cooperation and integration in the field of developing human resources is still lacking and has not kept up with the integration and development process of the storage industry, as well as the development of science and technology There are still many limitations in the participation of archival staff in the process of cooperation and international integration Lack of archives technical experts such as: digitizing, repairing and restoring archives, preserving electronic archives, organizing archives exhibitions, archiving media The facilities, especially the equipment for preservation are still lacking in general and need to be upgraded and developed These objective and subjective causes , if thoroughly considered, will be the basis for resolving existing problems, restricting and proposing drastic and effective solutions Chapter SOLUTIONS TO IMPROVING STATE MANAGEMENT OF ARCHIVES IN VIETNAM 4.1 Guiding viewpoints towards improving the quality of SMA 4.1.1 Improve the efficiency of the development strategy of Ministry of Home Affairs and Archival Development strategy The development strategy of Ministry of Home Affairs and Archival Development Strategy should be renovated with the focus on building up a contingent of professional, responsible, disciplined, and archived public servants Therefore, strengthening the SMA will be the solution to successfully implement the development strategies 4.1.2 SMA must meet the requirements of state administrative reform and the construction of the rule of law The overall administration reform is posed as an indispensable and urgent requirement in the nation's construction and development On November 8, 2011, the Government issued Resolution 30c / NQ-CP on the overall program of administrative reform for the period of 2011-2020 Besides identifying administrative reform tasks, including: preparation and reform of administrative procedures, reform of state administrative 13 apparatus organization, construction and improvement of the quality of the contingent of civil servants and public employees, reform of public finance, modernization of the administration Decentralization is essentially a gradual transfer of jobs and resources held by the central government to local governments at all levels in a long-term, stable manner through legal documents and by-laws to expand democracy In the tendency of decentralizing the state administrative apparatus at the central level, it will focus on policy formulation, ensuring institutional unity, solving major national problems Vietnam can apply a new public management model to increase the effectiveness and efficiency of the practical operations of local governments, such as strengthening cooperation between local authorities, renovating the quality of public service provision There is still a situation where Vietnam's state agencies have overlaps in duties and authority, lack of strategic coordination among government agencies, and there is still a group interest when issuing decisions Therefore, there should be a link in the Government, towards the common interests of the people Vietnam can also apply a responsibility management model: innovating practical activities, surveying the reaction of citizenscustomers, choosing mediating as a solution to resolving owner conflicts Another challenge in implementing administrative reform is that there is still a state of indifference and irresponsibility of the civil servants in handling the work, not defining the standards of public ethics that cause the distrust the people in the state agencies 4.1.3 Strengthen the SMA in accordance with the requirements from the industrial revolution 4.0 The dissertation presents the prospects and challenges for the SMA process in the Industry 4.0 era The Fourth Industrial Revolution (Industry 4.0) is becoming an indispensable development trend and has a profound impact on the development of all areas of social life For the archival field, based on digital technology and the integration of smart technologies, Industry 4.0 with the advent of "super automation" and digital technologies, promises to create the "breakthrough" changes the way, the process of organizing and managing archives The above-mentioned technology trend raises many problems that require preparation for professional training and retraining 14 for archives and public employees In particular, it is imperative to provide training and retraining for civil servants and officials on new issues when applying information technology in storage such as digitization and database creation for the entire document national archives; At the same time, there are emerging issues related to copyright of digital documents, the legality of digital documents, as well as network security, confidentiality and preservation of document database The recruitment of civil servants and public employees also needs to be renewed in the direction of recruiting people with information technology qualifications to both promote traditional archives management and promote access and management of electronic archives 4.1.4 Solution to apply new public management model, enterprise management model, enhance socialization into SMA From the operational perspective, public and private administration have the same criteria so it is possible to apply the same management approaches The question is which area is more effectively managed? In recent years, the private sector has shown many advantages and works effectively in an open market economy Therefore, agencies of state management need to change the thinking and management tools step to expand the scope of criticism and improve critics’ capacity Expanding the scope of criticism to cover the entire policy cycle and establishing the legal status of citizens and social organizations as independent reviewers will be the final step to complete the process Solutions to improve the SMA in Vietnam In order to improve the efficiency of state management of archiving, the author of the dissertation proposes to implement all the following solutions: The first solution is: Raising awareness of archives and the importance of archives The second solution is: Improving the system of legal documents on archives, in which it is important to amend and supplement the Archives Law No 01/2011 / QH13 and promptly issue documents on management, electronic documents The third solution is: Consolidating the system of state management agencies in charge of archives in the direction that the Government exercises unified state management of archives; Central archive management agency is responsible for advising the 15 Party; responsible to the Government for performing the state management of archives The fourth solution is: Innovating a number of issues in the state management of archives such as elaborating direction and guiding the implementation of legal documents; organization,; organize the management of scientific research, application of science and technology in archiving; management of archives and public employees; inspecting, examining and settling complaints and denunciations and handling violations of the law on archives and international cooperation on archives on managed objects in order to achieve the objective of improving the efficiency and effectiveness of management The dissertation is an intensive, comprehensive and systematic scientific research project on SMA in Vietnam Therefore, the results of research on the theory and practice of the dissertation clarify the concept and content of SMA in comparison with the state management model in other countries The dissertation has proposed solutions to complete state management in the coming time 16 Along with the development of the market economy, state management of archives is increasingly appreciated because archived information is an important information resource for management activities State management agencies on archives have achieved many achievements in preserving and promoting the value of archives Besides, the SMA also serves other needs of social life such as political activities, state management activities, diplomatic activities and many other activities in society Many of the legal documents on archival were initially introduced to new issues related to the socialist-oriented market mechanism Awareness of leaders at all levels and sectors on the position, role, importance of archives has been significantly improved The promotion of document value has been promoted, especially the publication and introduction of documents on the media network, which has made the society more interested in archiving Besides these advantages, the great achievements of the store in the renovation period still exists limitations The solutions to renovate SMA are: Raising awareness of archives and the importance of archives, Improving the legal documents, supplementing the issuance of documents for electronic document management; Consolidating the system of state management agencies; Innovating a number of issues in the SMA such as elaborating direction and guiding the implementation of legal documents, management of scientific and technological research and application;
