For the performance of public administration in a modem state based on the rule of law, trative procedure law plays an important role On the one hand, it shall provide for an effective

and efficient functioning of public administration, On the other hand it shall ensure that trative action is strictly in line with the rule of law and respects the rights of the citizens, thus

adminis-‘minimising public administration-related conflicts and offering solutions to solve them

construe-tively These are demanding requirements Vietnam is planning to cope with them in a Law on

Administrative Decisions that is currently prepared The conference aims to support this process

by reflecting and discussing problems, solutions and experiences in Vietnamese, French andGerman law It ill in particular focus on the legal figure of the "administrative decision"/"admi-nistrative act", which is crucial but understood in a different way in al three administrative law

systems.

‘The conference is part of the German-Vietnamese Law Days 2013 within the

German-Vietna-mese Rule of Law Dialogue

AND ISSUES NEED TO BE DISCUSSED FOR THE PREPATION OF A.

‘LAW ON ADMINISTRATIVE DECISIONS

1 The current state of making administrative decisions through some

cases

Case I: The authority to issue an administrative decision

‘On July 2011, Mrs, Le Thi Kim Khoa, reside at 56/1 Pham Thai Buong.street, district 4, Vinh Long city brought action to administrative court against

Mr Pham Van Dau, chairman of the People’s Committee of Vinh Long

yrovince,who reduced the city planning from 30m to 18m, benefiting Mr Pham

Van Dau at the cost of causing damages for Mrs Khoa She also sued for

damage caused by inadequate compensation and the 180 million VND loss

caused by the evacuation of her Thien Tan restaurant.

The court held that the claim on administrative decision no

1431/QD-UBND invalid on the ground that the decision is not a relevant subject for an administrative court; the court also refused the two claims on damage and loss.

‘Case 2': The resonableness of administrative decision

The project to build Vong Canh Resort (Thua Thien Hue) with capital investment up to 4.9 million US dollars, had its groundbreaking ceremony on

January 29" 2005, The project is brought to a halt due to negative feedbacks

from experts regarding its non-compliance with provisions on the preservation

of cultural and environmental heritage issued by the People’s Committee The

project was also objected by local community on the ground that once built, it

will ruin Hue's skyline with tall hotels.

Case 3°: The lack of transparaney in issuing administrative decision

On November 30" 2007, Tu Liem district issued a decision enacting the reclaiming of 1730 square metre of land in Khu Trung, Xuan Dinh, Tu Liem for urban planning purpose On the basis of Tu Liem district's decision, the

People’s Committee of Hanoi city issued administrative decision no

874/QD-UBND on September 23” 2008 on “Reclaiming 2936 square metre of land

within the area of Xuan Dinh village then transferring to the People's Committee of Xuan Dinh village to put on auction for urban planning purpose”

‘The People’s Committee of Hanoi city issued administrative decision no.

874/QD-UBND without notifying affected households The affected citizens who are legal owners of the land were not consulted or notified about the issue

of the mentioned decision on urban planning.

Furthermore, from the date of issue of the administrative action (September 23" 2008) to the day the People’s Committee of Xuan Dinh village carried out the decision (December 30" 2013), the citizens were not informed of

the decision nor the urban planning on the reclaimed land.

Law of Urban Planning expressly provide that the community (not

restrict to those affected) must be consulted before any planning; the plan,

together with its drawings, models must also be announced and demonstrated on various forms of media including printed media (there’s no provisions on

notifying the decision to the enforcing body).

In short, there is no provision on current legal documents on the consulting of related bodies and affected persons in the decision making process

of the issue of an administrative decision

Case 4°, Lack of socio-economic evaluation when issuing decision on

the construction of sea ports in Vietnam

Vietnam is going to start constructing 10 combined sea ports, Until 2010, Vietnam will mobilize 60.000 billion VND for the construction project 20.500 billion VND will be allocated for the northern sea ports (including Hai Phong sea port), 14000 billion for the central sea port, 20100 billion for the southern and 2000 billion for the south west sea ports The question has been raised on whether the large scale construction of combined sea ports with a significant

‘budget allocation is really neccessary for Vietnam?

irsty, it is optimal to place a combined sea port for every 300 km of

shoreline Moreover, countries such as Japan, United Kingdom, France, China , with longer shoreline, possessing a large shipping fleets accounting for more than 10 millions deadweight tonnes (DWT), only have 5 to 10 sea ports The most noticable being Japan, with 30000 km of shoreline, wi ten times

longer than Vietnam’s, and a shipping fleet consisting of 700 vessells totaling to

12 millions DWT, only have 10 sea ports, That raised the question is it

0 sea ports, 60.000 bilon dong, 20101, Tiephong onlin, Nguyen Ngoc Tran PAD

neccessary for Vietnam to have 10 combined sea ports, being a developing country?

Secondly, there is a so-called “sea port building” trend in Vietnam at the

‘moment In some places, there are two sea ports within 50 km distance, butneither of them are fully constructed Are there any differences between the mentioned sea ports and the ones about to be constructed? What about sea ports

that aren’t listed or reported?

~ It is suggested that the plan to construct sea ports in Vietnam must be based on the results of socio-economic, environmental evaluation and also based on reports on previous sea port constructions Those results must be evaluated carefully, and must be announced publicly on various media.

= Where would the 60000 billion VND capital come from? Even if the capital is readily available, whether the authorized bodies can efficiently utilize this capital is another puzzle to solve.

The problems: Authorized bodies have little access to information that can prove the merits of an administrative action, What are the unwanted

aftermaths and solutions? Where can the required capital be mobilized? The

source of all these problems aré the current law which does not require authorized bodies to evaluate the effect of its own administrative decision.

Case 5, The validity of an administrative decision on transferring personels

On September 0S" 2007, the Prime Minister issued administrative

decision no 1163/QD-TTg on the transferring of Huu Nghỉ Viet Nam-CuBa Dong Hoi Hospital to Ministry of Health According to this act, all decisions relating to the employment, transferring of personels are to be made by Ministry

of Health On September 13° 2007, the document contain the decision has

reached the People’s Committee of Quang Binh province; and only on

September 17" 2007, reached the Health Department of the same province.

During this period, the People’s Committee and the Health Department of

Quang Binh province has issued decisions on the transferring and employing

‘some persons to the hospital in question On September 10" 2007, the chairman

of the People’s Commitee and the director of the Ministry of Health of Quang, Binh province issued an decision on transferring Mr Nguyen Dục A — a doctor

of the local hospital ~ to another hospital; at the same time employ Mr Nguyen Duc B as the director of Huu Nghỉ Viet Nam-Cu Ba Dong Hoi hospital Because this decision was issued after decision no 1163/OD-TTg came into effect, and

therefore, is in conflict with a higher decision However, when the decision on transferring personels was issued, the People’s Committee and the Ministry of

Health of Quang Binh province were not aware of the existence of decision no 1163/QD-TTg since the decision only reached the People’s Committee on

‘September 13" 2007 and the Ministry of Health on September 17" 2007 How

‘would this conflict be resolved?

2 An evaluation of the current laws on the issue of an administrative

action

‘Vietnam’s current laws on the issue of an administrative decision have the following shortcomings:

One, the lack of principles relating to an administrative decision:

Vietnam's Administrative Law is currently lacking principles that can be applied to the decision making process of an administrative act As a result, we can neither build a legal foundation regulating the actions of administrative

bodies nor restrict them to a certain code of conduct;

In our legal system, there is an absence of rules that expressly provide for obligations, authority, drafting and issuing process, requirements to issue a legal decision, the effect of said decision and responsibilities of relevant bodies,

organizations and persons

The current administrative law is also not very transparent on the public issuance of an administrative decision, information confidentiality, access to documents, effects of a decision The law does not provide either solutions for cases of decision issued due to ultra vires, failure to comply with administrative

procedure or other procedures such as to extend, recall or dismiss an

administrative decision

Two, the lack of provisions requiring the consultation of relevant bodies, organizations, persons in the decision making process:

Vietnam Administrative Law currently does not require the involvement

of certain parties nor require the exclusion of certain parties in the decision process before issuing an administrative decision,

Three, the lack of procedural requirements for the issue of an

‘administrative decision:

~ The issue of an administrative decision is a complex process regulated

by a number of inconsistent law At the moment, each branch of law such as Land law, Urban Planning law or Housing law has its own provision on how to issue an administrative decision relating to its field;

~ Suggestions from citizens are usually neglected;

~ The authorized bodies don’t have enough grounds to review the legality and the seriousness of the illegality of an administrative decision.

Four, the lack of provisions on requirements and legal consequences of conferring powers in the issuing of an administrative decisio

‘There is no articles of law that provide expressly the requirements and consequences of conferring power and conferring power in the issue of an administrative decision The abuse of conferred powers usually results it

unclear authority and responsibilities of conferred bodies and persons.

To be specific, Vietnam administrative law does not have provisions on the principles, requirements of conferring powers, the person to whom power is conferred and his responsibilities; legal consequences of conferred power In legal practice, power is conferred to a body However that body continues to confer that power to another body and so on This leads to a complex

administrative process affecting the transparency and security of administrative and legal proceedings This is also one of the reason for the ineffectiveness of ìetnam)s administrative actions.

Five, unplanned administrative decisions due to the lack of evaluation Many administrative decisions are impractical due to the fact that the law does not require an evaluation of the their possible impacts, leading to some arbitrary decisions, wasting national budget and leading to civil unrest.

‘Six, the lack of requirements for information disclosure relating to the issue of an administrative decision:

‘The rights on publicize or not publicize an administrative decision directly affecting citizens lie soly on the administrative body with the authority to issue the decision in question As a result, there are usually discrepancies in an

administrative decision, or the abuse of power to “withhold” or “sell” information.

In conclusion, there is an absence of legal instruments regulating many

aspects of the issue of an administrative decision such as legality, transparency, evaluation, leading to many administrative conflicts and contradictions.

Environment Law, Adoption Law, Administrative Penalty Law ), their

provisions are varied and not in harmony ~ as in not following a set of principles

ơn how to issue an administrative decision.

To be specific, not all fields have legal instruments providing for the procedure how to issue an administrative decision For example, regarding protecting rights of other parties in the licensing process, some fields have strict and elaborate provisions ( i.e the construction/repair licensing process requires

‘an authorization documents of an administrative body; land use licensing requires the consultation of possible affected parties.) while other fields have little to no legal instruments (i.e the law recognizes citizens’ right to water, however, water use licensing law does not requires the consultation of citizens

in the area in question; mining minerals/dangerous minerals licenses are granted

without consulting the community at the mining area ) Regarding administration decision, not all fields have provisions on the extension and recall

of an administrative act.

The lack of a set of principles regulating administrative

leads to the infringement of rights and privileges of concerned

‘words, the current law does not protect the legal rights and privileges of citizens,

In practice, the decision making process of an important administrative

affecting many citizens (urban planning, construction license for large factories, sea ports, train stations, harbours ) usually overlooks either the consultation of

citizens or the evaluation of the impacts that a decision may have This leads to the recall or dismissal of administrative decisions (je the construction of Posco factories or Thong Nhat Park) resulting in expenses and reduced trust ingovernment

3.1 How to improve the legal provisions on the issue of an

administrative decision

To improve the legal systems on the issue of an administrative decision, the authors have the following suggestions:

(1) Clarify the term “administrative decision";

(2) Identify bodies authorized to issue an administrative decision;

(@).Transparency rules regarding the procedures to issue an

administrative decision;

(4) Express clauses on the consultation of affected parties in the decision

making process before issuing an administrative action;

(5) Clauses on the publicizing the content of an administrative decision:

It is necessary to have legal instruments to protect the freedom of

information disclosure of citizens Those instruments must provides the responsibilities of administrative bodies to disclose information to citizens so the

people can supervise the actions of said bodies.

(6) Ensure the impartialness of an administrative decision by excluding

parties with interests:

To ensure an administrative action is just and practical from the decision

‘making phase to the issuing phase, the law needs to expressly prevent the

participation of parties with interests from the process To be specific,

‘essential to exclude parties with direct interests and obligations to the decision,

‘Moreover, guardians/representatives of the mentioned parties also needs to be excluded

(7) Clauses on access to documents:

Administrative bodies should be required to let concemed parties have access to documents related to the issue of an administrative decision if access

to documents is necessary for the parties to protect their legal rights.

OF course, administrative bodies are not required to grant access to

documents if the access interferes with the decision making process, negatively affects public interests, or if the access may leaks confidental personal information.

(8) Clauses on the issue of an administrative decision based on conferred

powers:

+ Requirements to confer powers;

+ Basic principles of conferred power;

+ Subjects eligible to receive conferred power;

+ Procedures to confer powers;

+ Legal obligations of person conferring powers and person receivingpowers in various administrative processes

(9) Clauses on the obligations to announce administrative decisions to concerned citizens An administrative action should come into effect only whenconcerned parties are notified of the decision:

It is essential to provide that an administrative decision should only come into effect the moment concerned parties are notified of the existence of the

decision,

(10) Clauses on the grounds an administrative decision become null and

void:

- If the law expressly provides that the administrative decision must be issued under the form of a license/certification and an administrative action does

not comply with this;

~ Ifthe administrative decision is issued by an unauthorized bodies;

~ Ifthe administrative decision requires the enactment of an illegal action,

or the decision itself is impossible to execute.

(11) Clauses on extension

It is necessary to provide the following principles when extending an

administrative decision:

~ The administrative decision must have a duration, and must be eligible

for extension as provided by laws.

- The extension of an administrative extension must balance between public interest and legal interest of concerned parties;

~ The administrative body/person issuing an administrative decision is the

one authorized to recall the decision in question;

- The requirement and criteria to determine the extension of an

administrative decision must be evaluate without bias;

- The extension must be through the issue of another administrative decision, and this decision must also be issued when the extended decision is still in effect (before the expiry date of the decision that it extends);

- The extended duration must not exceed the original duration, The

number of extensions allowed should not be excessive and must be expressly provided by laws.

(12) Clauses on rules on how to recall an illegal administrative decision

It is necessary to expressly provide the following principles when recalling an administrative decision

~ An illegal administrative decision’s effects can be recalled or partially

recalled An administrative decision which created rights and interests (beneficial decision) can only be partially recalled.
