to interpret and clarify the theoretical issue of state management of FDI in industrial zones such as FDI, contents of state management of FDI, experiences of some countries on the state management of FDI in industrial zones and reference values for Viet Nam and the Northern Viet Nam key economic region; to survey, analyze and evaluate the practice of state management of FDI in industrial zones in the Northern Viet Nam key economic region, clarify the achieved results, the weaknesses and their causes; provide scientific recommendations on the improvement of state management of FDI in industrial zones in the Northern Vietnam key economic region Objects and scope of the study 3.1 Objects of the study Theoretical and practical issues of state management of FDI in industrial zones 3.2 Scope of the study The dissertation has scope of study on: - Space: in the Northern Viet Nam key economic region - Time: during the periode 2008 to 2018 (the time of Decree 15/2008/NĐ-CP came to effect); direction to 2030 - Content: The state management of FDI in industrial zones in the Northern Viet Nam key economic region has a wide scope related to many areas and scope of the dissertation focuses on the following contents: FDI in industrial zones; state management of FDI in industrial zones in the Northern Viet Nam key economic region; direction and solutions to improve state management of FDI in industrial zones in the Northern Viet Nam key economic region Methodology and Research methodology 4.1 Methodology The dissertation was studied on the basis of dialectical materialism methodology, Marxist-Leninist historical materialism, Ho Chi Minh Ideology and the Viet Nam Communist Party’s and State’s viewpoint and guidelines on FDI in industrial zones in the Northern Viet Nam key economic region 4.2 Research methodology - Method of statistics, synthesis, analysis, comparative: Use statistical data from 2008 to 2018 to collect, synthetize and analyze indicators and contents related to FDI in industrial zones in the Northern Viet Nam key economic region On the basis of aggregated data, questionnaires, sociological surveys, to analyze the good aspects, limitations, shortcomings and causes - Method of survey: Distribute the questionnaire to survey the needs of the people and at the same time reflect and evaluate the management decisions and responsibilities of state agencies and authorities towards enterprises in the area of industrial zones in the Northern Viet Nam key economic region - Method of processing results: evaluate the current real situation of state management of FDI in industrial zones in the Northern Viet Nam key economic region Scientific hypothesis, research questions 5.1 Scientific hypothesis At present, the state management of FDI in industrial zones has been implemented under a gereral mechanism throughout the country, without consideration given to the particularities of the areas, hence, state management of FDI in industrial zones in these specific areas have many shortcomings Therefore, it is necessary to ensure the state management of FDI in industrial zones in the Northern Viet Nam key economic region in the direction of attaching importance to the particularities of these areas 5.2 Research questions - Firstly, Which particularities of localities and regions should the state management of FDI in industrial zones in the Northern Viet Nam key economic region take into account? - Secondly, What the current state management of FDI in industrial zones in the Northern Viet Nam key economic region lay out for the planning and implementation of legal policies on state management of FDI in industrial zones? 5.3 Research theoretical framework (1) Follow to contents of state management of FDI in industrial zones, such as: building and executing strategies, planning of developing industrial zones; promulgating and enforcing legal documents, state policies; the inspection and supervision and organization of state management of FDI in industrial zones (2) By sectors, it should be given to promoting active management, thereby building an institutional framework from centre to appropriate local management, such as divided priority groups; short-term and medium-term priority New contribution of the dissertation - As for Theory: The dissertation has supplemented and improved the theory on state management of FDI in industrial zones on the basis of analyzing and clarifying the state management theory and reason - As for Practice: The recommendation of the dissertation are references for the actual situation of state management of FDI in industrial zones in the Northern Viet Nam key economic region as well as for regions with similar conditions The dissertation helps the agencies, organizations and individuals to properly and fully understand the values of FDI in industrial zones and state management of FDI in industrial zones, thereby forming behaviors in comformity with the law, contributing to ensuring the effectives of state management for these contents Structure of the dissertation In addition to the introduction, table of contents, conclusions, annex, list of references, the dissertation is divided into chapters: Chapter 1: Overview of research related to the dissertation topic Chương 2: Theoretical bases for state management of FDI in industrial zones Chương 3: Current real situation of state management of FDI in industrial zones in the Northern Vietnam key economic region Chương 4: Direction and Solutions for completing state management of FDI in industrial zones in the Northern Vietnam key economic region CHAPTER 1: OVERVIEW OF RESEARCH RELATED TO THE DISSERTATION TOPIC 1.1 Overview of research related to the dissertation topic in domestic and overseas - The first group encompasses research projects related to FDI corporations: (1) In the book “Foreign Investment in Vietnam: Challenge, obstacles and solutions” (2001), the author Kim Hoa analyzes the trends in the world’s foreign direct investment during 2001-2005 in Asia, showcasing the new characteristics of FDI and its role in the economic development of our country (2) In the book “FDI and Development in Vietnam: Policy Implications” (2004), the author Pham Hoang Mai, Southeast Asia Research Institute, Singapore.The research focuses on FDI during 1988-1998, in which the definition of FDI appears to be a novel concept not only in Vietnam but also in other developing countries in the region In addition, the research mentions the strengths exhibited by the region during this period, specifically, abundant labor supply, low wage rates, and a wide variety of natural resources (3) The book “Foreign invested economy in Vietnam” (2006), the author is Associate Professor Ph.D Tran Quang Lam, Master An Nhu Hai, National political publishing house The thesis of the book focuses on the economies with foreign investment; at the same time, it has a lot of content regarding the environment of foreign investment such as the concepts and basic theories about the foreign investment environment have been inherited and developed by the thesis such as Harrod Domar Theory, K Kojima Theory, and Dunning Theory, etc (4) The book “Foreign Direct Investment from Emerging markets” (2010) by the author Karl P Sauvant, Wolfgang A Maschek and Geraldine A McAllister This book is edited by Karl Sauvant et.al, presenting the extensive and detailed reviews of MNE’s rapid involvement in emerging markets globally This book brings together contributions from several areas of innovation to shed light on developments in two key issues One of them is about the new MNE's theoretical development implications, and the other is the changing of policy context toward both FDI abroad and FDI into emerging markets MNEs (5) The book “Foreign Direct Investments in Asia” (2013) by Chalongphob Sussangkarn, Yung Chul Park, Sung Jin Kang The areas of study of this project surround nine countries in the ASEAN and East Asia, in which some of them are major countries in Asia, and this study compares their policies to attract foreign direct investment - The second group encompasses research projects related to industrial zones: (1) The book “Regional social impacts of industrial parks in Vietnam” (2012) The book only focuses on investigating the positive and negative effects of industrial zones to the surrounding areas but does not focus on public administration with regards to industrial zones (2) The book “Export processing zone, industrial zone, Economic zone in Vietnam” (2012) - Prof Dr Duc Hiep Phan, National political publishing house This document introduces the establishment, development, and the operation of Export processing zone, industrial zone, Economic zone in the context of the world and Vietnam during the 1990s to 2012 In this book, the author focuses on the topics of infrastructure development, investment promotion, the operations of corporations in export processing zone, industrial zone, Economic zone, and their compliance with environmental regulations in this area (3) The book “Industrial park development strategy and management practices” (2012) - Development strategy and management practices for industrial zones The main topic of the book focuses on the following matters: (1) the strategic development of industrial zones based on the historical analysis, the establishment and the development of the economy; (2) the establishing process of industrial zones based on government policies including the location, development planning, economic contributions, challenges and future constraints of the industrial zones on the economic development of the country; (3) the proposal of some solutions for the countries that have the intentions to follow the model of industrial park development of Korea (4) The book “The development of industrial zones in the North Central Coast: the situations and solutions” (2016): Doctor Le Thi Le,National political publishing house The book provides foundational arguments and the reality of industrial zone development, selecting criteria system to evaluate the development of factors affecting the formation and development of industrial zones in the North Central region; it provides a systematic way of formation and development of these areas in the number of countries in the world In addition, there are many dissertations on related such as “State management of FDI in industrial zones and export processing zones in HaNoi”, (2008), Assos Prof Dr Tuyet Trang Thi, Binh Nguyen Dang; “State management of industrial zones in Thai Binh”, (2011), Hang Do Thi; “State management of industrial zones in Phu Tho”, (2017), Quy Nguyen Hoang, Tuan Nguyen Manh; “State management of industrial zones in Bac Ninh”, (2017), Dr Thanh Dang Dinh, Mai Le Thi; “Development of industrial zones in Bac Lieu”, (2012), Toan Vo Si…etc However, these studies have just limited in a specific province and locality (3) The report “Enhancing the effectiveness and efficiency of state management of FDI in industrial zones”, (2015), by Mr Tuan Pham Khac – head of department, the Hanoi industrial zones and export processing zones He has clearly defined the importance of FDI in general and FDI in HaNoi in particular for the national economic development, thereby, the principle of state management of FDI has been emphasizing (4) The study “Theoretical and practical basis on state management”, (2015), Assos Prof Dr Hai Nguyen Huu The book has aimed to provide additional contents of state management (5) The document from the Club of management boards of industrial zones, export processing zones in the Northern provinces and cities, it was organized in Lao Cai with the subject: “Improving the legal basis for state management in industrial zones and economic zones towards sustainable development”, (2017) The report summarizes the latest and most accurate data on the number, revenue level and development situation of FDI in industrial zones in general and FDI in industrial zones in the Northern Vietnam key economic regions in particular + For human resources: (1) The study "Solutions for improving the quality of high-quality human resources in industrial zones in Vinh Phuc province", (2013), Huy Nguyen Xuan, National Academy of Public Administration This study evaluates achievements, limitations, provides orientation and proposes major solutions to contribute to improving the content of managing high-quality human resources in industrial parks in Vinh Phuc province (2) The study “ Improving the capacity of management for human resources in industrial zones in Bac Giang province”, (2012), Van Dang Thi Khanh The study has evaluated the practical resources of state management Those are staffs who work in the organizational state management (3) The study “Decentralization of state management of industrial zones in Ho Chi Minh city”, (2005), Bon Mai Huu The study raises the general issues about industrial zones and state management of industrial zones Analyze and assess the status of management of industrial zones in Ho Chi Minh City From there, the study gives directions and proposes decentralized management for industrial zones in Ho Chi Minh City 1.2 THE CONTENTS HAVE NOT BEEN THOROUGHLY RESEARCHED AND THE CONTENTS THAT THE DISSERTATION CONTINUES TO STUDY 1.2.1 The contents have not been thoroughly researched In general, above domestic and foreign researches on FDI in industrial zones and state management of FDI in industrial zones have built up important foundations for the theory of state management of FDI in industrial zones, important orientations for the current intensive research content on state management of FDI in industrial zones Till now, there have not many researches in the area of FDI in industrial zones in Viet Nam, besides, the articles published in magazines are monograph, specialized, there is no systematic and intensive researches focusing on the contents; the region and the periode time 1.2.2 The contents that the dissertation continues to study The dissertation aims to comprehensively study the system and specifically clarifies the contents of key concepts related to the topic such as: institutional, state management of FDI in industrial zones justice, characteristics analyzing and role of state management in improving the quality of current FDI in industrial zones registration and state management in the Northern Viet Nam key economic region The content of dissertation clarifies the actual situation of state management of FDI in industrial zones, specifically the research issues by these contents of state management, such as building and executing strategies, planning of developing industrial zones; promulgating and enforcing legal documents, state policies; the inspection and supervision and organization of state management of FDI in industrial zones The dissertation recommends scientific foundation as the basis for the direction, tasks and solutions to improve the state management of FDI in industrial zones in our country, meeting the renewal requirements of the country in general and the Northern Viet Nam key economic region in particular toward the trend of international integration 10 CHAPTER 2: THEORETICAL BASES FOR STATE MANAGEMENT OF FDI IN INDUSTRIAL ZONES 2.1 CONCEPTS BASES ON FDI IN INDUSTRIAL ZONES 2.1.1 Concepts of FDI in industrial zones - The concept of FDI in VietNam can be understood in a general way as “ FDI is a form of business organization, in which one party or parties with diffent nationalities put capital and manage together bases on profits in acccordance with the laws of the host country and international practices” - The general concepts about industrial zones: “Industrial zones is a concentration of industrial enterprises specialized in manufacturing industrial goods and providing industrial production services, it has been definited geographical boundaries and noone can be lived in this areas; industrial zones can be etablished by the Goverment or the Prime Minister” - The concept of FDI in industrial zones: “Economic organizations with investing capital of forgein investors being members or shareholders to implement projects in defining geographical boundaries, specializing in production of industrial goods (manufacturing enterprises) and providing industrial production services (service enterprises), it has been etablished under the conditions, in order and procedures of Vietnamese laws, entitling preferential policies applicable to investment incentive areas.” 2.1.2 Division of FDI in industrial zones FDI in industrial zones are divided according to the following specific criteria: based on the mode of investment; based on purposal investment; based on investment relationship; based on the form of investment 2.1.3 Principle of FDI in industrial zones FDI in industrial zones have specific principle in two aspects as: Firstly, the principle of FDI in the investment country; Secondly, the principle of FDI in the host country 2.1.4 Characteristics of FDI in industrial zones 11 Analyse the salient feartures of FDI in industrial zones such as about investment objectives; about legal status; about investment structure; about operational functions; about investment space 2.2 CONCEPTS BASES FOR STATE MANAGEMENT OF FDI IN INDUSTRIAL ZONES 2.2.1 Concepts bases for state management of FDI in industrial zones From the concept of state management, state management of FDI in industrial zones have been mentioned above, the concept of state management of FDI in industrial zones can be defined as “State management of FDI in industrial zones is an organized, based on power impact of state management to control the formation and FDI’s bussiness specializing in manufacturing industrial goods and providing services for industrial production in the defining geographical areas boundaries This activities are for the purpose of the state on protecting the legal rights and the development of FDI in industrial zones.” 2.2.2 Principle of state management of FDI in industrial zones The principle of state management of FDI in industrial zones is expressed through the following in specific roles: (1) Political stability and macro-economic environment for the movement of FDI in industrial zones; (2) Create a legal environment and encourage enterprises to orient the Party's economic development policy in the socio-economic conditions of Vietnam, in accordance with international practices and laws; (3) Building and developing infrastructure, socio-economy and ensuring safety for the movement of FDI in industrial zones; 2.2.3 Purposes of state management of FDI in industrial zones - In general purposes: Improving state management of FDI in industrial zones - In particular purposes: (1) the orientation of the enterprise operating in line with the objectives of the country's socio-economic development strategy; (2) helping to screen industries that create great value-added, industries with high knowledge content, modern technologies, friendly environment ; limiting investment areas that employ many untrained labor; (3) orienting the economy to sustainable development and green growth; (4) the objective of linking FDI’s attraction strategy with strict monitoring of implementation process, implementation progress 12 2.2.4 Contents of state management of FDI in industrial zones State management of FDI in industrial zones includes the following main contents: building and executing strategies, planning of developing industrial zones; promulgating and enforcing legal documents, state policies; the inspection and supervision and organization of state management of FDI in industrial zones 2.2.5 Factors affecting the state management of FDI in industrial zones - Group of objective factors: Natural conditions; Social and economic conditions; Local human resources; - Group of subjective factors: Management capacity in the state management apparatus; Coordination among agencies in state management’s activities; Application of IT in state management’s activities 2.3 EXPERIENCE IN STATE MANAGEMENT OF FDI IN INDUSTRIAL ZONES OF SOME COUNTRIES AND SOME REFERENCE VALUE 2.3.1 Experiencd some countries Some countries have expericences on the issues as Indonesia, Malaysia and Thai Lan about the contents as improving policies; on planning policies and laws; on organizational structure; on infrastructure; on investment promotion; on technology transfer; on environmental protection 4.2 SOLUTIONS TO IMPROVE THE STATE MANAGEMENT OF FDI IN INDUSTRIAL ZONES IN THE NORTHERN VIET NAM KEY ECONOMIC REGION 4.2.1 Renewing the work of developing strategies, planning and plans for developing FDI in industrial zones in the Northern Vietnam key economic region - Encourage expansion investment instead of new establishment to take advantage of existing infrastructure and auxiliary works - Accelerate the granting of land use right certificates to FDI in the industrial 16 zones, ensuring ancillary works such as electricity, water, telecommunications, roads, - Planning and developing industrial zones in accordance with the conditions of each locality and region and in accordance with the development orientation of the country - Renewing planning work in accordance with the new provisions of the Investment Law 2014, Decree No 82/2018/ND-CP stipulating the management of industrial parks and economic zones - Reviewing and adjusting the planning on industrial zone infrastructure - Improve business environment for all investors 4.2.2 Improve legal documents related to FDI in industries zones - Research, revise and complete the Investment Law 2014 and the Enterprise Law 2014 in accordance with the requirements of socio-economic development and the context of international integration in the new period on the principle that the Investment Law is a legal basis on uniform adjustment logic - Eliminate the current differences and differences between the Investment Law 2014 and international commitments under IIAs and FTAs, especially related to Tax payment, money transfer, fair treatment and dispute resolution - Researching and promulgating the Law on Industrial Zones so far only the highest legal document is the Decree on industrial parks and economic zones - More clearly stipulating the characteristics of investment procedures and conditions for FDI investors in industrial zones - Developing coordination mechanisms among functional agencies, research institutes, scientists and relevant organizations in the process of drafting bills - Using a contingent of domestic and foreign experts to study, consult, elaborate, amend and supplement legal documents on investment - Enhancing opportunities for consultation before passing laws, promoting the process of issuing guidelines - Establishing a systematic reception committee for investors in order to give FDI investors peace of mind and settle complaints promptly in the first stage before turning into legal disputes - Build a true partnership between the state and the leaders of FDI to improve 17 quality, enhance stability and consistency in the laws and prioritize the implementation of the most important reforms, including difficult reforms, market opening etc 4.2.3 Improving policies related to FDI in industrial zones in the Northern Vietnam key economic region Solutions to meet the above requirements should carry out a number of specific issues as follows: - Develop and apply a uniform policy of connecting FDI to address weaknesses and limitations in management - Clarify the role of MPI and other stakeholders in the implementation of a comprehensive FDI connectivity program - Regardless of changes in mechanisms and policies on FDI in industrial zones, there must be a roadmap, public disclosure and previous psychological preparation for investors - Make website links between state management agencies for FDI in industrial zones Regarding the mechanism transparency, the policy should publicly announce all activities related to the FDI’s activities in the industrial zones - Comprehensively reform the current and balanced incentive policy framework by shifting to incentives based on efficiency 4.2.4 Strengthen inspection and supervision for FDI in industrial zones in the Northern Vietnam key economic region - Complete the information and data system of the Investor; to have grounds for checking and supervising the process of capital implementation of FDI at different stages - Strengthening inspection and supervision of the licensing process and post-license management of investment registration certificate-granting agencies - Practical solutions to improve the state management of FDI in industrial zones in the Northern Vietnam key economic region 4.2.5 Innovating/strengthening the organizational structure of State management of FDI in industrial zones in the of Northern Vietnam key economic region Solutions to organizational structure of state management are implemented in two 18 specific directions as follows: 4.2.5.1 Renovating organizational structure of state management - Reform the organizational structure and operational mechanism of the state management apparatus in terms of investment, in addition to reforming the whole contingent of civil servants The Government considers to the "Future model" for state management of FDI in industrial zones 4.2.5.2 Consolidating the organizational structure of the State management: - Organization of state management apparatus compact, reasonable, clear responsibilities, professional scientific work; - Clearly assign and decentralize state management from central to local levels on the basis of clearly defining the functions, tasks, powers and coordination regulations among the concerned agencies and ministries - Application of IT in state management activities 4.3 Recommendations to the National Assembly; Government and concerned Ministries and branches 4.3.1 Recommendations to the National Assembly 4.3.2 Recommendations to the Government and concerned Ministries and branches 19 CONCLUSION The study of state management of FDI in industrial zones is an important issue that requires fundamental arguments and proven facts Based on an overview of the opinions of domestic and foreign scholars combined with the observation process of state management of FDI in industrial zones in the Northern Vietnam key economic region, I have clarified the definition, the classification, the roles and characteristics of FDI in industrial zones; the definition, the roles, objectives, and the content of state management of FDI in industrial zones, analyzing subjective/objective factors affecting state management of FDI in industrial zones The thesis has affirmed that the Northern Vietnam key economic region is one of four economic regions with great potentials and advantages in attracting FDI enterprises in industrial zones The region has a large number of industrial zones, especially compared to other regions across the country However, the development in practices has not yet met the potential of the region FDI in industrial zones mainly focus on processing, assembling, and imported raw materials, and therefore, the added value is not high;
