hai sách Kornai, cảnh sát văn hoá hỏi chuẩn bị sách không Khi nghe nói sách bàn vấn đề sở hữu, chưa rõ đầu cua tai nheo nói đại ý “đó vấn đề nhạy cảm đụng đến chất chế độ!” Tâm lí chung Song ngộ nhận nguy hại Các văn quan trọng Việt Nam không qui định Điều 12 Hiến Pháp 1946 ghi rõ “Quyền tư hữu tài sản công dân Việt nam đảm bảo” Các điều 14, 15, 16 18 Hiến Pháp năm 1959 đảm bảo quyền tư hữu nông dân, thợ thủ công, nhà tư sản công dân Hiến Pháp 1980 thực tế xoá bỏ kinh tế tư nhân kinh tế tư bản, song điều 27 bảo hộ quyền sở hữu công dân “thu nhập hợp pháp, cải để dành, nhà ở, tư liệu sinh hoạt, công cụ sản xuất dùng trường hợp phép lao động riêng lẻ” Hiến Pháp 1980 có lẽ tồi tệ xét theo khía cạnh sở hữu Hiến Pháp 1992 có cởi mở song chưa Hiến Pháp 1959 thua xa Hiến Pháp 1946 Điều 58 Hiến Pháp 1992 viết “Công dân có quyền sở hữu thu nhập hợp pháp, cải để dành, nhà ở, tư liệu sinh hoạt, tư liệu sản xuất, vốn tài sản khác doanh nghiệp tổ chức kinh tế khác;…” Ấy mà người ta sợ, ngại nói vấn đề này, chưa nói đến đất đai, hầm mỏ tài nguyên khác Về đất đai, hay nói rộng bất động sản, nguồn tài sản khổng lồ Bất động sản nguồn tài sản khổng lồ chiếm tỉ lệ lớn tổng tài sản Sử dụng liên quan đến luật đất đai quyền sở hữu nói chung phân tích kĩ lưỡng sách Hiến Pháp 1946 không đề cập đến đất đai, từ Hiến Pháp 1959 đến Hiến Pháp 1992 qui định đất đai, hầm mỏ thuộc sở hữu nhà nước Hiện Việt Nam công dân tổ chức có quyền sử dụng đất Theo luật, quyền bao gồm quyền hưởng giá trị thặng dư tài sản tạo ra; quyền chuyển nhượng, thừa kế; quyền quản lí tài sản Thực ra, tên gọi quyền sở hữu, hay quyền sử dụng chính, quan trọng nội dung Tất nhiên, ta gọi giới dùng quyền sở hữu Độc giả xem trang 60-63 sách thứ hai tủ sách để hiểu rõ khái niệm quyền sở hữu Tôi hi vọng đọc xong sách nhà lập pháp Việt Nam thay đổi lập trường vấn đề tạo luật đất đai phù hợp Đặc biệt suy ngẫm độ lớn bất động sản, vì, theo de Soto (trang 86) “bất động sản chiếm khoảng 50 phần trăm cải nước tiên tiến; nước phát triển số gần ba phần tư” Không có luật phù hợp để huy động tối đa tiềm 75% cải quốc gia thật nguy hiểm Sở dĩ phải nêu dài dòng để thấy cần phải nói, viết, bàn tranh luận vấn đề quyền sở hữu Quan trọng hơn, đóng góp quan trọng de Soto, hệ thống quyền sở hữu thiết kế tốt, tiếp cận cho tất người, với qui định pháp lí liên quan giúp thực mục tiêu: “Dân giầu; nước mạnh; xã hội dân chủ, công văn minh” Quyển sách không bổ ích cho nhà trị, nhà lập pháp, quan chức nhà nước mà bổ ích cho nhà hoạch định sách, nhà nghiên cứu khoa học xã hội, người làm công tác ngân hàng, tài chính, nhà báo, doanh
