The organization and enforcement of social insurance law is still limited, but there are no studies that mention the enforcement of social insurance law for women in rural areas of the North Central provinces In the past time, the issue of human rights, equal rights and the right to ensure social security for women in rural areas; the enforcement of social insurance law has been studied by the management agencies and scientists, but so far there has not been a complete and comprehensive study on the enforcement of social insurance law for women in rural areas, villages in the North Central provinces, Vietnam From the above reason, it can be seen that the topic "Enforcement of social insurance law for women in rural areas of the North Central provinces, Vietnam" as the topic of doctoral dissertation in Theory and history of the State and law is urgent and has theoretical and practical significance Purpose and mission of the study 2.1 Purpose of the study On the basis of clarifying the theory and practice of Enforcing social insurance law for women in rural areas of the North Central region, the dissertation presents opinions and proposes solutions to ensure the enforcement of social insurance law for rural women in the North Central provinces, Vietnam for the coming period 2.2 Misson of the study To achieve the above purpose, the dissertation has the following missons: Firstly, study and evaluate the general situation of study in the country and abroad; draw out the issues that have been studied and issues for the dissertation that need further research Secondly, study the theoretical basis for Enforcing social insurance law for women in rural areas, including: concepts, characteristics, roles, legal content, forms of law implementation; evaluate the effectiveness of forms of Enforcing social insurance law for women in rural areas of the North Central region Regarding the point of view, it is necessary to consider women in rural areas as one of the weak and disadvantaged groups in society Accordingly, it is necessary to thoroughly grasp the point of view: Enforcing social insurance law for women in rural areas of the provinces North Central region associated with effective implementation of social policies and social security of the Government; the proportion of laborers in the fields of agriculture, forestry, fishery and administrative work is high; low level of education, untrained workers account for a high proportion; economic conditions facing many difficulties; the working environment is not safe; working hours per day is higher than that of men As a participant in social insurance, women in rural areas are divided into two groups: - Group of subjects participating in compulsory social insurance - Group of subjects participating in voluntary social insurance 12 2.1.2.2 Characteristics of the area where social insurance law for women in rural areas is implemented The implementation area of social insurance law for women in rural Vietnam is a rural area with some characteristics such as: The natural land area is quite large, with rich and complex topography and geology Infrastructure is not synchronized, basic social services are more limited; on reforming social insurance policy 2.3.2 Legal guarantee conditions The legal guarantee conditions are considered in: (1) the perfection of the legal system on the rights and responsibilities of the subjects; (2) the perfection of the law on organizational apparatus 2.3.3 Conditions for economic assurance and quality of social insurance service 2.3.3.1 Economic security The more the economy expands and the per capita income rises, the more opportunities the state has to boost employee contributions and social insurance benefits, and vice versa 2.3.3.2 Insurance service quality assurance The quality of social insurance services is reflected in the payment of benefits that are right, sufficient, timely, and convenient for beneficiaries; The methods for implementing social insurance are comprehensive, open, transparent, and consistent with the process The quality of social insurance services is contingent upon the adaptability of the contribution 14 relationship and the provision of complete, timely, and accessible information 2.3.4 Conditions for subject communication and awareness 2.3.4.1 Communication assurance Women in rural regions are still unaware about social insurance; their willingness to join in social insurance is low, so communication is even more vital in implementing the social insurance law for this demographic 2.3.4.2 Confirmation of the subject's perception This is a necessary prerequisite for the law on social insurance to be implemented effectively Employees' legitimate rights and interests are protected when subjects are fully aware of their legal responsibilities 2.4 ENFORCEMENT OF SOCIAL INSURANCE LAW FOR WOMEN IN RURAL SOME COUNTRIES IN THE WORLD AND REFERENCE VALUE FOR VIETNAM 2.4.1 Enforcement of social insurance law for women in rural areas in some countries around the world In order to obtain synchronous and feasible solutions in the enforcement of social insurance law for women in rural areas of the North Central provinces of Vietnam, in the study content of the dissertation, the task of study and practical experience is determined implementation of laws for farmers (including women in rural areas) in some countries in the world, thereby drawing out some valuable issues for reference for Vietnam The selection of countries for study is based on the criterion that the country has the same level of socio-economic development (Indonesia); The population rate in rural areas is high (China) and the social insurance policy for farmers has been established for a long time (Poland) 2.4.2 Some reference values for Vietnam From study on practical Enforcement of social insurance law for women in rural areas in some countries, the dissertation draws some reference values for Vietnam: (1) has its own social insurance policy mechanism for farmers; (2) diversify the regime under the type of voluntary social insurance; (3) flexible participation methods, social insurance premium rates; (4) voluntary social insurance organizations 15 operate independently, with the support of the State; (5) promote the responsibilities of local authorities and other organizations in implementing social insurance for farmers Chapter FACTORS AFFECTING LEGAL STATUS AND IMPLEMENTATION LAW ON SOCIAL INSURANCE FOR WOMEN IN RURAL OF NORTH CENTRAL PROVINCES, VIETNAM 3.1 FACTORS AFFECTING IMPLEMENTATION LAW ON SOCIAL INSURANCE FOR WOMEN IN RURAL OF NORTH CENTRAL PROVINCES, VIETNAM 3.1.1 Economic, cultural - social, labor - employment factors of the North Central provinces, Vietnam * Economical factors In the 2016-2020 period, the region's GRDP will increase by an average of 6.8-7% per year The economic structure has shifted in a positive direction, increasing the proportion of the industrial and service sectors However, according to economic experts, at present, the North Central region is still the economic "low-lying area" of the country The development of enterprises in this area is only 1/3 of the national average, which is not a small difficulty for the development of subjects participating in compulsory social insurance *Socio-cultural factors People in the countryside in the North Central region have the virtue of industriousness and a thrifty lifestyle If it is propagated about the meaning of social insurance, it will have an impact on the intention to participate in voluntary social insurance of women in rural areas With a good cultural tradition of "mutual love and affection" This is also a favorable factor for propaganda that the social insurance agency needs to exploit and promote * Labor factor - employment Female laborers in rural areas are a large force, the percentage of working in the CPV (including agriculture) accounts for a high proportion; 16 structure of income from agriculture, forestry and fishery activities (calculated by per capita income/month) only accounts for 14.32% This is a disadvantaged group of workers who need special support and attention from the State and local authorities to participate in the social insurance system 3.1.2 Organizational apparatus and activities of the social insurance agencies of the North Central provinces Currently, the organizational structure of the Vietnam Social Security Administration and the social insurance system in the localities of the provinces has been consolidated in the direction of modernity, professionalism, efficiency, meeting the requirements of tasks; Team capacity is improved, working style, working style and service style are constantly being renewed, which is one of the important conditions to ensure the enforcement of social insurance law for women in rural areas North Central Provinces, Vietnam 3.1.3 Status and needs of women in social insurance participation in rural areas of the North Central region, Vietnam Currently, there are about 328,214 women in rural areas participating in social insurance, accounting for 12.8% of the total female labor force In which, the number of people participating in compulsory social insurance is 212,439 people, accounting for 22% of the total female workforce subject to compulsory social insurance The number of people participating in voluntary social insurance is 115,775 people, accounting for 7.27% of the total number of female employees working in the informal sector Conducting a survey of 415 women in rural areas shows that there is a need to participate in social insurance when: there is support from the State; diversified insurance regimes; reduce the time to pay social insurance 3.2 LEGAL STATUS ON SOCIAL INSURANCE FOR WOMEN IN RURAL VIETNAM 3.2.1 Advantages of social insurance law for women in rural Vietnam The dissertation evaluates the advantages of social insurance law for women in rural areas through the following contents: (1) The subject of 17 Enforcing social insurance law for women in rural Vietnam is quite diverse Diversified, diversified and increasingly supplemented and expanded in terms of rights and responsibilities, creating a legal basis for better ensuring the right to participate in social insurance of workers in general, and of women in rural areas village in particular; (6) The regulations on inspection, examination, settlement of complaints and denunciations and handling of violations of social insurance law have been amended and supplemented to create a legal basis for more effective law application 3.2.2 Limitations of social insurance law for women in rural areas of Vietnam The dissertation evaluates the limitations of social insurance law in contents with basic limitations such as: (1) The rights and responsibilities of some subjects have not been personalized and have not been mentioned in social insurance law; (2) Regulations on participation in social insurance have not covered all target groups; (3) The current implementation principles of social insurance are not really comprehensive and thorough; 18 (4) Regulations on procedures for implementation of social insurance are still long, the structure of regulations on procedures is not scientific, so it is difficult to look up; (5) Some regulations on the subsidy regime are no longer relevant to reality; (6) Regulations on inspection, examination and handling of violations are still lacking and inconsistent among legal documents From that limitation, the enforcement of social insurance law for women in rural areas faces many difficulties 3.3 SITUATION OF ENFORCEMENT OF SOCIAL INSURANCE LAW FOR WOMEN IN RURAL AREAS OF NORTH CENTRAL PROVINCES, VIETNAM 3.3.1 Advantages in Enforcing social insurance law for women in rural areas of the North Central provinces, Vietnam and causes 3.3.1.1 Advantages in Enforcing social insurance law for women in rural areas of the North Central region, Vietnam * Compliance with social insurance law: most of the subjects have fully complied with the legal provisions on social insurance Acts of appropriating social insurance premiums and entitlements are detected and handled promptly The situation of arrears and late payment has been gradually overcome There were no cases of violation of law among officials and employees of the social insurance industry in the North Central provinces * Comply with social insurance law: In the enforcement of social insurance law for women in rural areas of the North Central provinces, it has been shown that most of the subjects have fully, seriously and effectively complied with the provisions of social insurance law * Use of social insurance law for women in rural areas: The right to access information on social insurance policies; the right to issue and manage social insurance books; The right to enjoy the social insurance allowance of women in rural areas shall be resolved quickly, properly and promptly by the Social Insurance agencies * Applying social insurance law: Inspection and examination are focused and carried out regularly The handling of administrative violations
