corruption, negative effect, degradation of morality and lifestyle of a part of officials and party members are raising the urgent matter among the people; the situation of lodging a complaint to the improperly authorized persons, a long queue of people, protests, strikes, go-slow strikes took place in many places with increasingly fierce nature, many localities have become the "hot spot" causing insecurity and disorder In the context of international developments in a direction unfavorable to the revolutionary movement, taking advantage of the policy of innovation, openness and integration of our Party and State, foreign hostile forces and internal dissidents intensified sabotage activities both in obvious and sophisticated and cunning way in order to cause political instability, eliminate the role of the Communist Party and the socialist regime in Vietnam The reality shows that some countries in the world change from embargo policy to normalizing relation, promoting cooperation in all fields with Vietnam but still not giving up the conspiracy to implement the strategy of "Peaceful evolution", seeking ways to penetrate our internal affairs , affecting, taking direction of economic legal policy, promoting "self-evolution" and "self-transformation" Looking back on our country's legal policy on national security protection over the past years, the requirements for national security protection have made our State's legal policy in this field more specific compared to other fields The transition to a socialistoriented market economy; innovation, opening and international integration have led to the requirement of "openness" in the State's regulations However, the operation of a socialist-oriented market economy, the faster and stronger the process of opening international integration in our country is, the more increasing factors threatening national security, social order and safety are; being one of the objective reasons that have directly led to the complexity of the security and order situation recently Therefore, legal policy on national security protection need to be developed and strengthened in a way that does not hinder but must be unified, facilitating the process of innovation, development and international integration At the same time, it needs to be developed and completed in order to eliminate negative effects from the negative side of "openness" in economic transition, openness and international integration In the face of the above situation, the system of legal policy on national security protection in Vietnam did not keep up with the rapid developments in the domestic and world situation Therefore, in the implementation of legal policy on national security protection, Vietnam is sometimes, somewhere confused and passive to deal with acts and activities that infringe upon the national security It is time to make an objective, in-depth and comprehensive assessment of the implementation of legal policy on national security protection in order to detect shortcomings and inadequacies to promptly supplement in accordance with the new situation Studying the implementation of legal policy on national security protection becomes an urgent requirement in practice Therefore, the PhD student chose the topic: "Implementation of legal policy on national security protection in Vietnam nowadays" to conduct research Purposes and mission of the thesis research 2.1 Purposes In the face of the need to complete the current system of legal policy on national security protection in Vietnam, the author defines the purpose of researching the topic "Implementation of legal policy on national security protection in Vietnam nowadays" is to focus on researching the Current situation of implementation of legal policy on national security protection in Vietnam The conclusions drawn are based on the research comparing the legal policy on national security protection with some countries in the world, thereby clarifying the theory and practice of legal policy on national security protection in Vietnam in a systematic and comprehensive way On this basis and based on specific conditions and circumstances of Vietnam, the topic proposes solutions, contents to develop and complete legal policy on national security protection in Vietnam in order to contribute to firmly protecting national security 2.2 Mission To achieve the above purpose, the author identifies the following basic research missions: - Analyzing and explaining the position and important role of legal policy on national security protection in firmly protecting national security in Vietnam Researching and evaluating legal policy on national security protection in some countries in the world and in Vietnam - Analyzing and clarifying the concept of national security, national security protection, legal policy on national security protection, history and development process of legal policy on national security protection Comparing to the concept, development process of legal policy on national security protection in some countries in the world Determining the basic content of legal policy on national security protection - Doing survey, investigating and analyzing the current situation of implementation of legal policy on national security protection in Vietnam - Proposing directions and solutions to complete legal policy on national security protection in our country today Objects and scope of the thesis research 3.1 Objects: Legal policy on national security protection in Vietnam 3.2 Scope - Scope of content: The legal policy on national security protection is a fairly broad and complex issue Therefore, the thesis does not study all the contents of legal policy on national security protection but only focuses on the interpretation of the implementation of legal policy on national security in some main fields, specifically such as internal security, social security, information security, international cooperation in national security protection - Scope of space: Legal policy on national security protection nationwide - Scope of time: from 2005, it was the time when the Politburo issued Resolution No 48-NQ/TW of May 24, 2005 on "Strategy for developing and completing the legal system from now till 2010, with an orientation to 2020" Research methods - The thesis is researched based on the viewpoint of the Marxism-Leninism, Ho Chi Minh thought; undertakings and lines of the Party; legal policy of the State on the development and completion of legal policy on national security protection - The thesis is done by the following specific methods: + Experience summarizing method: The author conducts a review and study of records, documents, synthesizing reports, scientific works, etc on legal policy on national security protection to draw comments, scientific reviews and conclusions + Statistical and comparative methods: The author collects and sorts data according to specific criteria on the status, actual situation of development, implementation of laws and policies on national security protection to create data tables and maps Therefore, it is possible to compare facts and figures with each other; - Clarifying some common theoretical issues about the politicals and laws on national security protection: the concept of legal policy on national security protection, legal policy on national security protection in Vietnam; issues, objectives, solutions, tools of legal policy on national security protection in Vietnam; implementation of legal policy on national security protection; fields of legal policy on national security protection; Legal policy on national security protection are particularly important issues of countries, so they are always concerned and researched by scientists around the world The author tried to review a number of foreign research works; however, national security is a strictly confidential issue of each country, so the scientific research works on the field of national security in general, legal policy on national security protection in particular have little cooperation and exchange on the international scale Accordingly, foreign sources on this issue are not many and relatively scattered 1.3 Assessment of the research situation related to the thesis topic By studying the research works on legal policy on national security protection at both domestic and foreign levels as mentioned above, the author has some comments and assessments on the research results as follows: 1.3.1 Regarding the advantages, the research results that the thesis will inherit, continue to develop The research of domestic and foreign authors provided the author with a comprehensive view of the concept of national security, national security protection and legal policy on national security protection Overview of these documents allowed the author to have a general basis for the concept of legal policy on national security protection in a multidimensional and comparative way One of the significant research results for the thesis is that the author generalized the status of the policy of developing laws on national security protection in some countries in the world, especially confirmed that most of the nations have promulgated the Law on national security protection as a basic and major means of legal 11 policy on national security protection Although this law has different names in each country, it focuses on the legal norms of state management to protect the national security, including provisions on the subjects fighting, participating in the protection of national security, rights and obligations of such entities, functions, duties and powers of the National Security Protection Agencies and other relevant regulations Accordingly, it helps the author have a basis to research and compare with the current situation of the policy of developing laws on national security protection in Vietnam and be able to interprete some solutions to complete legal policy on national security protection in Vietnam Foreign studies have shown a number of countries' experiences in formulating legal policy on national security protection such as emphasizing the role of citizens, other organizations in the state apparatus and society in national security protection, stipulating a separate chapter on the rights and obligations of these entities; legal obligations to ensure the National Security Agency not being abused and infringed upon the legal rights and interests of individuals and organizations, violations of democracy, human rights or uncontrolled activities Studying legislative experiences of national security protection of other countries allows the author to consult and study in order to propose the completion of legal policy on our national security protection in the new situation The research work in Vietnam has also initially approached and analyzed the laws and policies on national security protection in specific fields These analyses continue to be assessed and commented on by the author of the thesis, and thus the author can make her own views on the concept of legal policy on national 12 security protection as well as the analysis of the legal policy on national security protection in the different fields 1.3.2 Issues that have not yet been fully addressed or need to be further research - Currently, theoretical researches on legal policy on national security protection from the concept, characteristics, content, implementation process, affecting factors need to be further research - Contents: Issues, solutions, tools and factors affecting legal policy on national security protection have been mentioned but in separate aspects and fields; there has not been a comprehensive research from the perspective of public policy science Particularly, the issues, goals, solutions and tools of national security policies and analysis of subjects of national security policies have only been studied as a content in the works, not mentioned as an independent research object of scientific works These are gaps the author will focus on studying in her thesis - The recommendations and solutions to complete legal policy on national security protection of domestic and foreign studies are mainly at the stage of policy formulation The author will propose solutions to complete the policy at the stage of policy implementation 1.4 Conclusion of Chapter The studies of domestic and foreign authors provided the author with a comprehensive, multidimensional and comparative view of legal policy on national security protection 13 Chapter GENERAL THEORETICAL ISSUES ON LEGAL POLICY ON NATIONAL SECURITY PROTECTION 2.1 Legal policy on national security protection Clarifying the concepts of public policy, national security, national security protection, laws on national security protection, policies of national security protection, and legal policy on national security protection, subjects implementing legal policy on national security protection and subjects protecting national security 2.2 Legal policy on national security protection in Vietnam Clarifying the concept of legal policy on national security protection in Vietnam and the main contents of legal policy on national security protection including issues, objectives, solutions, tools and subjects of legal policy on national security protection 2.3 Implementation of laws and policies on national security protection Clarifying the concept of implementation of legal policy on national security protection and related contents: affecting factors, requirements, steps to organize and implement legal policy on national security protection 2.4 Fields of legal policy on national security protection The comprehensive research shows that in the variety of fields related to national security, based on the scope of the research, the topic focuses on several fields including internal security (internal political security, economic security, cultural-ideological security); social security (ethnic and religious security); information security; international cooperation in the national security protection 14 2.5 Conclusion of Chapter By studying the concept of public policy, national security protection policy, legal policy, the author clarified the concept of legal policy on national security protection, the concept of legal policy on national security protection in Vietnam and the related contents; on the concept of implementation of legal policy on national security protection in the policy cycle and fields of legal policy on national security protection Chapter CURRENT SITUATION OF IMPLEMENTATION OF LEGAL POLICY ON NATIONAL SECURITY PROTECTION IN VIETNAM 3.1 Factors affecting the implementation of legal policy on national security protection Firstly, political factors, including political environment and political consciousness; Secondly, human resources factor; Thirdly, Factors of national consciousness and rule of law state; Fourthly, international integration factors; Fifthly, factors of benefit costs and facilities 3.2 Current situation of implementation of legal policy on national security protection The thesis goes into the analysis and evaluation of the Current situation of implementation of legal policy on national security protection in the fields of internal security (internal political security, economic security, cultural security - thought); social security (national security and religion); information security; international cooperation in protecting national security 15 3.2.1 Current situation of implementation of legal policy on internal security protection 3.2.2 Current situation of implementation of legal policy on social security protection 3.2.3 Current situation of implementation of legal policy on information security protection 3.2.4 Current situation of implementation of legal policy in the field of international cooperation to protect national security 3.3 Advantages, limitations and causes of limitations in the implementation of legal policy on national security protection 3.3.1 Advantages The results of the implementation of legal policy on national security protection have contributed significantly to the success of the national security protection, maintaining political stability, effectively serving the renovation process, creating favorable conditions to bring our country to a period of stepping up industrialization and modernization Regarding the correctness expressed in the implementation of legal policy on national security protection, we have attached great importance to the close combination of the socioeconomic development task with the task of security, defense and foreign affairs; formulating internal coordination mechanisms, ensuring close and effective combination of economic, cultural and social strategies with national security strategies The legal policy on national security protection has really become an important factor contributing significantly to the maintenance of national independence and sovereignty, creating a stable political premise for the cause of national renewal and development The great achievement was affirmed in the Document of the 12th National Party Congress: "… strengthening national defense and security; being resolute and persistent struggle to protect the 16 independence, sovereignty, unity and territorial integrity of the Fatherland, maintaining peace and stability to develop the country” [16, p.58,59] 3.3.2 Limitations In addition to the above-mentioned results, the research results show that the implementation of legal policy on national security protection in the past also revealed some specific limitations; details are as follows: Firstly, awareness of advisory work, proposals and formulating of legal policies to protect national security is still not correct Secondly, advisory work on formulation, promulgation and improvement of legal policy on national security protection has been slow, failing to meet practical requirements Thirdly, there are many shortcomings in the laws and policies to protect the national security, resulting in many difficulties and shortcomings in the policy implementation process Fourthly, the process of organizing the implementation of the provisions of law to prevent and handle activities of infringing upon the national security in some areas still reveals the limitations and shortcomings leading to the effectiveness and ineffectiveness Fifthly, the coordination between forces in the implementation of national security protection policies still reveals many difficulties and obstacles 3.3.3 Causes of limitations The above limitations are due to the following basic reasons: (1) The system of legal policy to protect the National Security still has lags, loopholes, overlaps; many contents are not specific, unclear, and not keep up with requirements of reality (2) The process of directing the implementation is the lack of centralized unity; the coordination between the forces, between the central and local levels 17 is still lack of tight and rhythmic (3) There is a lack of inspection and supervision, regardless of practical review It is possible to recognize the above limitations under the following aspects: Firstly, there is inadequate awareness of subjects in implementing legal policy to protect national security and the delay in changing social psychology Secondly, in the process of implementing the law on protection of the National Security, competent subjects have not paid enough attention to scientific research, evaluation and practical review Therefore, there has not been a strategic direction, an overall macrolevel plan clearly identifying the requirements for the content, object, scope of adjustment, priority, appropriate steps and conditions Thirdly, there are no programs and plans to develop comprehensive, basic and long-term legal policy on protection of national security in this field; slowly institutionalizing the Party's resolutions and directives into legal policy Agencies directly implementing the legal policy on protection of national security have not conducted in-depth and comprehensive research to promptly advise, propose supplementary and complete legal policy Therefore, there is not enough unified policy system to meet the requirements of national security protection in the new period of revolution Fourthly, fostering, training, organizing and arranging a contingent of full-time officials in charge of the implementation of legal policy on protection of national security in ministries and branches are not commensurate with the requirements of the renovation process Fifthly, the role of the coordination of related forces and the masses' role in the protection of the National Security has not been highly promoted yet; not yet paying due attention to the propaganda and education of legal policy to attract a large number of people to actively participate in the 18 movement to protect the Homeland security, prevent and fight acts of infringing upon the National Security 3.4 Conclusion of Chapter Chapter has studied and presented the current situation of implementation of legal policy on protection of national security in Vietnam through studying specific areas of national security such as internal security, social security, information security, international cooperation in the field of national security protection From which, the author has pointed out the achieved results, the limitations and the causes of the limitations This will be the basis for us to propose measures to complete the policy and laws to protect the National Security in Vietnam in the following chapter of the doctoral thesis Chapter SOLUTIONS TO COMPLETE LEGAL POLICY ON NATIONAL SECURITY PROTECTION IN VIETNAM TODAY 4.1 Orientation to complete the policy and laws on national security protection in Vietnam today From the research results in Chapter 1, Chapter 2, Chapter of the PhD thesis, we propose some contents for the orientation of complete the legal policy on national security protection in Vietnam today; details are as follows: Firstly, in the completion of legal policy on national security protection, thoroughly grasping the orientation set by the 12th National Party Congress: "Consolidating national defense, maintaining national security, political stability, social order and safety are important and regular tasks of the Party, the State, the 19 political system and the entire population, including The People's Army and the People's Police as the core" [16, p.148] In particular, consistent goals of protecting national security and order determined by the Party are: "Resolutely and persistently fighting for the protection of national sovereignty, unity and territorial integrity, firmly protecting the borders and sovereignty of the sea, islands and airspace of the Fatherland; at the same time, maintaining a peaceful and stable environment for sustainable development of the country Resolving disputes by peaceful means on the basis of respect for international laws" [16, p.148] Secondly, proactively reviewing and proposing to complete the system of legal policies to protect national security; paying special attention to overcoming shortcomings and irrationalities in the provisions of the current national security protection policy system; supplementing legal policy to protect national security in “nontraditional security” fields and new fields due to the strong impact of the industrial revolution 4.0 but lack of adjustment laws Thirdly, People's Public Security organizations must be a competent core force, coordinate with ministries, departments, branches and mass organizations in advising, proposing the completion and implementation of legal policy to protect the National Security, ensuring firmly national security, creating a clear change in order, social security, ensuring safety for the life of the People, actively contributing to the protection of independence, territorial sovereignty, maintaining political stability, peaceful environment, security and safety for the country to develop quickly and sustainably Fourthly, improving the quality of forecasting and analyzing 20 the situation; detecting early and remotely threats to national interests and security to take initiative in advising and proposing the completion of legal policy on protection of the National Security; thoroughly overcoming the situation of violations without sanctions to prevent and handle; Since then, deploying measures to firmly protect the national security in the spirit of "keeping the country from afar" and "keeping the country since it is not yet dangerous" 4.2 Solutions to complete legal policy on national security protection in Vietnam today Based on the research results in Chapter 2, Chapter 3, the results of surveys and in-depth interviews, the author proposes to synchronize the following solutions to improve the effectiveness of the implementation of legal policy on national security protection in Vietnam today: 4.2.1 Promoting information, propaganda and dissemination on the role of advising, proposing planning, formulating legal policy to protect national security 4.2.2 Identifying key national security issues that need to be prioritized in order to complete relevant laws and policies 4.2.3 Overcoming irrationalities in the provisions of the system of laws and policies to protect national security 4.2.4 Improving the effectiveness of the implementation of legal policy on national security protection of state agencies 4.2.5 Improving the quality of coordination between the national security protection forces 4.3 Conclusion of Chapter From the results of the research in Chapter 1, Chapter 2, Chapter of the PhD thesis, Chapter proposes a number of 21 orientations for completing the current national security protection laws and policies in Vietnam At the same time, it has proposed basic solutions to improve the legal policy on national security protection in Vietnam today CONCLUSION The legal policy on national security protection plays an important role in public policy science in our country today, showing the attitude of the Party and State towards national security, one of the most important issues in social life The research results in Chapter show that there are still many shortcomings in the implementation of laws and policies to protect national security such as: Awareness on advisory work proposed, formulating legal policies to protect national security is still not correct; advising on the formulation, promulgation and finalization of laws and policies on national security protection is still slow, failing to meet practical requirements; There are still many shortcomings in the laws and policies to protect the national security, resulting in many difficulties and shortcomings in the policy implementation process; the process of organizing the implementation of the provisions of law to prevent and handle activities of infringing upon the national security in some areas still reveals the limitations and shortcomings leading to the effectiveness and efficiency is not high; The coordination between forces in implementing the national security protection policy still reveals many difficulties and obstacles The transition to a socialist-oriented market economy; innovation, openness and international integration have led to the requirement of "openness", "ventilation" in State regulations, the increasing complexity of relations in the social system, and international relations; being synonymous with increasing factors 22 threatening national security, social order and safety and being one of the objective reasons directly leading to the complexity of the security situation and order over time Therefore, the legal policy to protect the national security need to be planned and built to continue the goal of maintaining the stability and sustainable development of the socialist regime and the Socialist Republic of Vietnam, the inviolability of independence, sovereignty, unity and integrity of all territorial forms of the Fatherland, at the same time, consolidating in the direction of not obstructing but having to unify and facilitating the process of innovation and development, international integration At the same time, it is necessary to develop and perfect legal policy to aim to eliminate the negative effects from the negative side of "openness" and "ventilation" in transforming the economy, opening up and international integration The PhD student has completed a research project with a PhD thesis in public policy of "Implementation of legal policy on national security protection in Vietnam nowadays" The thesis has completed the research objectives and successfully solved the research tasks: Firstly, overview of domestic and foreign researches related to legal policy on national security protection The author does not present projects by listing but approaching the principles of public policy science from the basic implications of public policy such as policy issues, policy objectives, policy solutions and tools Secondly, systematizing theoretical issues about the legal policy on protection of national security to conduct research such as legal policy to protect the national security, legal policy to protect the national security in Vietnam;
