ENVIRONMENTAL MANAGEMENT PLAN (EMP) 1. The Contractor submits a detailed environmental management plan for Supervision Design Consultant’s approval (management plans include erosion control plan, dust and noise control plan, etc.) 2. The Contractor employs staffs with qualification and experience to supervise the implementation of safety measures and minimize environmental impacts as specified in EMP.

A GENERAL ENVIRONEMENTATL POLICY FRAMEWORK Some regulations and laws on environment applicable to operations including construction of roads/bridges to which the contractor needs to pay attention include: Law on Environmental Protection 2014 promulgated by the National Assembly on June 23rd, 2014, and coming into effect since January 1st, 2015 Decree No 18/2015/ND-CP promulgated by the Government on February 14 th, 2015 stipulating the environmental planning, strategic environmental assessment, environmental impact assessment and environmental protection plans Circular No 26/2011/TT-BTNMT detailing a number of articles of Decree No 29/2011/ND-CP Safeguard Policy Statement (SPS) of Asia Development Bank in 2009 Lasted standards of the Government on pollution management impacts of the project activities Environmental Objectives Mitigation measures issues 1.Environmental Articles of EMP The Contractor submits a detailed environmental responsibility in shall be fully plan must be approved in writing By Supervision Design Consultant one (01) month prior to construction The Contractor shall perform the terms of the TRP Observe and mark trees which shall not be chopped down with the consent of rangers prior to construction Rangers accept the replacement of chopped trees basing on TRP Minimize the clearance basing on TRP Prohibit to chop down trees for firewood or for the Project In the process of re-planting / re-vegetation, it is not allowed to use strange varieties (seeds currently not grown in the country or the project area) unless re-planting / re-vegetation is performed in a certain framework with introduction purposes Trees tending to invade new environment must not be planted Workers are prohibited to hunt wild animals, fish, or raise, lock, buy and sell wild animals for any purpose, or keep wild animals illegal in tent area Bridge construction activities should be performed in the dry season as many as possible to reduce the negative impacts on the fishery, water quality and other aquatic resources The Contractor shall not use or permit the use of wood as fuel for any phase of the construction, including but not limited to the boiling of tar and Mitigation measures asphalt mixtures, and a more practical issue is to ensure the use of fuel, other than use of wood for cooking and boiling water at all tents and residential areas 10 The Contractor shall not purchase or use wood from illegal sources (illegally imported) 11 Do not build up the tents, asphalt mixing plant, material stockpile areas in forest areas 12 The Contractor shall comply with all necessary guidelines to ensure not to cause any damages to vegetation due to fire and explosion from construction activities If there is a fire in the process of working, the Contractor shall immediately put out the fire and replant destroyed trees Water drainage and impacts on hydrological regime Environmental issues Reducing the damages caused by the flood and riverbank erosion Examine technical design of drainage works crossing the road, assess and agree with the Employer/Supervision Design Consultant in case of re-design, new work commencement The contractor shall perform terms of the DMP Implement the design of bridges and box culverts that have been approved to be suitable to flood control such as absorption design to avoid erosion Protect or install irrigation channels across the project area Quickly repair damaged irrigation channels Protecting natural streams that may be deposited with sediment due to the flow of the construction process, production factory and washing area of vehicles and machinery Minimize the selection of methods of draining surface water in the project corridor Need to build sewers to divert interrupted due to the construction Contact local authorities concerned about the services of electricity, water and the surrounding villages to conduct planning for re-supplying power, water, telecommunications and irrigation systems Installation and re-connection of electricity and water services must be performed immediately prior to commencement of construction The Contractor shall cooperate with companies that provide electricity and water services electricity and water services to repair and install Give prior notices to affected neighborhoods Re-connection of electricity and water services should be done immediately before commencing construction as soon as possible Notify Supervision Design Consultant and management unit of electricity and water services to repair and rehabilitate immediately damaged power and water supply systems during construction Damaged service roads due to transport of construction materials and activities related to the project must be restored immediately after the completion of construction activities in each area Update the draft of MATERIAL MANAGEMENT PLAN (MMP) (including volume chart that is moved) prepared by Supervision crops Store the topsoil for future use Make fence and fence walls around the mine site after use Remove, store excavated soil, topsoil and low quality materials near the site and store them for renovation Use quarries with the highest exploitation rate (in terms of quality) while retaining its best natural state Use mines located near routes easy to travel and with less steep hills 10 Do not quarry in areas having natural forests and near the river – areas supplying nutrients and residence to birds and animals 11 Do not choose quarries, soil mines, and materials in the fertile lands and forest areas 12 In the process of quarrying, exploiting soil and materials, it is required to provide adequate drainage system and avoid stagnancy 13 Avoid or reduce the exploitation of the mines located in the riverbed If it is obligatory to put the quarry in the riverbed, avoid streams or small rivers Prioritize the use of the land created by alluvial deposit or silt in the middle of the river, Objectives Mitigation measures but not submerged in water in the condition of normal water level 14 In mines in hills or steep terrain, hedge exploited land areas, and construct drainage systems and plant trees to improve these areas 15 Make sure that the remaining mines are clean, the slope is stable and drainage system is good in order to prevent flooding – a condition for mosquito breeding 16 After completion of the exploitation of materials, tunnels and quarries must be drained and fenced, and carefully protected to avoid impacts on health and safety of people 17 To avoid flooding when mines are flooded in, it is required to fence and equip with life buoys Environmental issues Waste dump Environmental Objectives Mitigation measures Control the treatment area of construction waste, hazardous waste and grease Update the management of hazardous waste in Objectives Mitigation measures the draft of WASTE ROCK AND SOIL, AND WASTE MANAGEMENT PLAN (VVMSDP) prepared by Supervision Design Consultant Updated plan includes all issues about cleaning up, storing, treating and monitoring waste rock and soil The plan also includes process of transportation, storage and treatment methods and equipment, routes and transportation vehicles, treatment location and capacity of solid and liquid waste substances, hazardous materials, hazardous substances and excavated rock and soil The plan must be approved by Supervision Design Consultant in writing (01) month prior to construction Contractor shall have to implement the terms of VVMSDP Disposal areas must be approved by landowners and checked by Department of Natural Resources and Environment The Employer / Supervision Design Consultant shall acknowledge and monitor Supervision Design Consultant recorded and monitored Waste soil storage areas must be renovated, managed, listed and marked Do not treat waste in banks of rivers or streams or natural drainage ditches Do not treat waste in weak slopes, roads abnormal incidents, and approved by Supervision Design Consultant in writing Contractor shall have to implement the terms of VVMSDP 2.Disposal areas must be approved by landowners and checked by Department of Natural Resources and Environment The Employer/ Supervision Design Consultant shall acknowledge and monitor Waste soil dumps must be renovated, managed, listed and marked Track the process of sorting garbage The trees, grasses that have been cut off should be provided for the local people to use as fertilizer or firewood Collect organic waste, and not incinerate at construction responsible for management in these areas and ensure they are properly trained for controlling people entering and leaving these areas and this entry must be permitted by a competent person 10 Asphalt construction Supply medical equipment for workers to able to access easily Schedule regularly (eg weekly talk) to orient workers in terms of health and safety issues related to their activities as well as proper use of protective equipment Set up fence around the dug area, material mines and areas with a temporary bridge Provide employees with full free protective equipment such as safety shoes, hard helmets, goggles, earplugs, gloves etc In the areas where workers work entirely in conditions of direct contact with transport activities, barriers must be arranged to protect workers to avoid being affected by means of transport Other measures are to install traffic directional distribution devices (eg cone and cylinder beacons) for delimiting site Supply reliable clean water for workers Arrange adequate drainage channels for camp area to avoid water accumulation Provide sanitation equipment/toilets to camp area in accordance with local regulations to prevent any harm to the community’s health or soil, surface water and groundwater pollution These devices must be maintained well in order to use effectively 10 Ensure to set up reverse signals for all vehicles in the site construction activities interrupting or restricting travelling Coordinate with local agencies of Transportation and Public Works, perform plans for redirecting traffic to avoid inconvenience to people in traffic caused by project activities Ensure smooth traffic and avoid or reduce accidents, traffic jams Coordinate with local agencies of Transportation and Public Works with respect to the plan for transportation of materials to avoid congestion Install clear signs and signposts at the Objectives Mitigation measures road going in and out construction road and bridge to minimize traffic performed by contractor or subcontractor C FIRE PREVENTION & EMERGENCY RESPONSE PLAN The Contractor shall prepare and submit a safety action plan for the Project Activities to the CS Consultant and PMU1 to review and approval This action plan shall include actions response with environmental incident related to sudden leakage, unforeseen toxic gas release, unfavorable weather conditions or fire incidents The plan shall be evaluated and updated if necessary - In case of sudden leakage or spills of oil/chemicals/chemical waste, the following reactive procedures must be complied by the Contractor:  The person who detects the leakage/effusion of chemicals shall immediately check the injured persons and informs the Contractor, Consultant and PMU1;  The Contractor shall guarantee that any injured persons shall be treated, and what is spilled/leaked must be identified;  In case of sudden issues causing critical environmental pollution, the Safety and Environmental Officer of the Contractor shall immediately notify PMU1 In this case, the Contractor shall have simultaneous actions to stop spillage/leakage and direct the spilled/leaked fluid to the invulnerable nearby;  The Contractor shall appoint the maintenance staff with suitable protective equipment to clean such chemical waste/ chemicals Cleaning may attain its effeciency by immerse sawdust (in case of minor spillage/leakage), or sand bag (in case of considerable spillage/leakage), and/or use the shovel to scoop up the surface soil (in case leakage/spillage appears in the open ground);  Depending on the nature and severity level of chemical spillage, it may be deemed necessary to evacuate the site for safety;  It is not allowed to pour down the spilled chemicals into the surface water drainage system of the locality Use the sawdust or sand bag to clean instead and the chemical contaminated soil shall be treated by complying with drainage procedure and waste treatment procedures  Environmental incidents may occur in the course of work execution and operation phases of the Project, which is unpredictable Therefore, the Contractor shall act, depending on specific case, to handle these incidents and implement proper measures for each specific case  The Contractor shall prepare a detail report on the environmental incident, including detailed description of accidents, cleaning activities performed any pollution issues and proposed measures to prevent similar incidents from occurence in the future Afterwards, such report shall be submitted to the Consultant and PMU1 for consideration and records Report on these issues shall also submitted to the Department of Natural Resources and Environment of Thanh Hoa Province if required - Responsing to fire:  Establish the Professional Fire prevention Team, which is selected from the workers engaged in the construction Occupation training courses shall be offered for this team on Fire prevention  Prior to construction, the Contractor (construction unit) shall have a working plan with PMU1 for the implementation of material and equipment protection works, as well as fire prevention and safety, including (1) the Contractor shall provide and install fire extinguisher in the site offices, stores and dangerous flamable sites; (2) water hoses, water tanks shall be allocated on the site plan at convenient regulations and internal rules in construction site, organizes training courses to the staff and workers to seriously comply with regulations and internal rules as well as strictly obey the State safety regulations  Safety department assigns the staff to follow, update weather news for flood fighting and prevention in rainy season  Safety staffs have to appear in construction site,
