Suoi Tien Section (Line 1) Employer’s Requirements – General Specifications Package-3: (E&M, Rolling Stock, Trackwork, Maintenance) EMPLOYER’S REQUIREMENTS - GENERAL SPECIFICATIONS INTRODUCTION 1.1 APPLICATION OF THE GENERAL SPECIFICATION (GS) 1.1.1 The provisions contained in the Particular Specifications (PS) and the Employer’s Drawings shall prevail over the provisions contained in this GS 1.1.2 The provisions contained in the GS shall prevail over the provisions contained in, Vietnamese Standards, Japanese Standards, International Standards, and similar standard documents stated in the Contract 1.1.3 This GS shall be read in conjunction with the other documents constituting the Contract ∗ End of Section ∗ Page GS of 200 Final Ho Chi Minh City Urban Railway Construction Project Ben Thanh - Suoi Tien Section (Line 1) Employer’s Requirements – General Specifications Package-3: (E&M, Rolling Stock, Trackwork, Maintenance) DEFINITIONS AND ABBREVIATIONS 2.1 DEFINITIONS: In addition to the words and expressions defined in the General Conditions of Contract (GCC), further following words and expressions shall have the meaning assigned to them except where the context otherwise requires : "As-Built Drawings": means those drawings produced by the Contractor and endorsed by it as true records of construction of the Permanent Works and which have been agreed with the Employer's Representative "Combined Services Drawings" (CSD): means drawings showing the locations, layouts and sizes of all services including those of other contractors co-ordinated so as to eliminate all clashes “Commissioning”: means the process of setting to work the complete transportation system through a series of integrated tests that demonstrate the installation and performance in accordance with the specified criteria "Construction Phase": has the meaning identified in Section of this GS “Consumables”: means those parts that are not repairable and usually have a relatively short life span “Contractor”: means the person(s) named as Contractor in the Contract Agreement and the legal successors in title to this person(s) “Critical Path Method Network”; means a mathematically based algorithm chart set up for scheduling a set of project activities “Day”: means calendar day unless expressly stated otherwise “Defects Liability Period”: means the period during which the Contractor is responsible to remedy any defective work which becomes apparent during the Defects Liability Period The Defects Liability Period for this Contract is 730 calendar days “Defects Notification Period”; means the period during which the Employer is responsible to notify the Contractor of any defective work which becomes apparent during the Defects Liability Period defined above “Defined Area”: means an area within which Works Trains will be operated and the Employer’s defined area working safety rules will apply “Depot and Workshop Equipment” includes Equipment and Plant in depot and workshop, Infrastructure Maintenance Vehicles and related works "Design Manual": means the manual to be prepared and submitted by The Contractor as part of the Definitive Design and as described in the Employer's Requirements – Particular Specifications "Design Package": has the meaning identified in Section of this GS "Design Phase": has the meaning identified in Section of this GS Page GS of 200 Final Ho Chi Minh City Urban Railway Construction Project Ben Thanh - Suoi Tien Section (Line 1) Employer’s Requirements – General Specifications Package-3: (E&M, Rolling Stock, Trackwork, Maintenance) “Extended Preliminary Design”: has the meaning identified in Section of this GS “Factory Acceptance Tests”: means the tests to be performed at the Contractor’s factories prior to delivery to the Site to verify compliance with the Specification and quality standards “Final Design”: has the meaning identified in Section of this GS “First line maintenance”: Inspection and repair work on site for infrastructure, on daily and/or monthly inspection of rolling stock without dismantling which consist of adjustment, replace equipment or part “Headway”: means the time between the departure time of a train and that of the succeeding train “Installation Tests”: means the tests to be performed to verify the conformity of completion of an installation/assembly to the design documents previously reviewed without objection by the Employer’s Representative prior to the start of Commissioning Installation Tests not form part of the Tests on Completion to be performed by the Contractor in order to achieve Employer’s Taking Over of the Works or any Section however they must be successfully completed before the Tests on Completion can commence “Integrated Testing and Commissioning” means those tests that demonstrate the integration of the complete transport system meeting the requirements of the Specification in an operating environment Integrated Testing and Commissioning form part of the Tests on Completion to be performed by the Contractor in order to achieve Employer’s Taking Over of the Works or any Section “Interfacing Contractor”: means the Contractor’s Counterpart from either Contract Package 1, or who has an interface requirement with the Contractor in order to fulfil the Employer’s Requirements “Key Dates”: means the date by which the Contractor completes a Key Date activity Key Dates are subdivided into two categories: (1) Key Date for the access of the Contractor CP-3 to the Contractor’s Site, and (2) Key Date for Tests on Completion and the Contract Completion Date For Key Dates Types and 2: Liquidated Damages will be imposed at the rate given in Appendix to the Letter of Tender for the period of time that the Key Date requirement remains unachieved “Maintenance”: includes Maintenance, Consumables, Training of O&M Company’ staff and related works “Maintenance Contract”: Contract between the Contractor and the Employer or his O&M Company on maintenance of Railway Systems including Train Control and Signalling System, Traction and Auxiliary Power Supply System and Substations, Telecommunication System and Operation Control Centre facilities, Rolling Stock, Track work, Depot and Workshop Equipment, Infrastructure Maintenance Vehicles, Automatic Fare Collection System and relevant works during five (5) years starting from the Page GS of 200 Final Ho Chi Minh City Urban Railway Construction Project Ben Thanh - Suoi Tien Section (Line 1) Employer’s Requirements – General Specifications Package-3: (E&M, Rolling Stock, Trackwork, Maintenance) commencement of revenue service of the Line between Ben Thanh Station and Suoi Tien Terminal Station "Notice": means a Notice of No Objection “Operation & Maintenance Company (the)”: means the organization to be settled by HPC (Ho Chi Minh People's Committee) or MAUR (Management Authority for Urban Railway) for the purpose of railway operation and maintenance of Ho Chi Minh City Urban Railway System including the Line “Partial Acceptance Tests”: means the functional tests to be performed on components and parts of systems to meet the specified criteria Partial Acceptance Tests form part of the Tests on Completion to be performed under the Contract in order to achieve Employer’s Taking Over of the Works or any Section “Peak Load”: means the biggest volume of the passengers per hour in a day at a section “Preventive maintenance”: means maintenance that will be carried out periodically not to have the facility or rolling stock failed at the operation “Quality Control Point”: means a point in time when a notice or other document is to be submitted to the Employer’s Representative in accordance with the Contract before the Contractor can commence, proceed with or terminate an activity “Quality Hold Point”: means a point in time when a notice of no objection by the Employer’s Representative is required “Railway Core System”: is a general name showing the system consisting of subsystems; signalling, train control, telecommunication, power supply, track, rolling stock, AFC, depot and workshop equipment, etc "Railway Envelope": means the zone or zones within the Works containing the trackwork and equipment necessary for the operation of the railway “Recovery/corrective maintenance”: Maintenance activity to restore the performance and faculty of the system or equipment by adjusting, repair or replacement of part after failure “‘S’ curve”: means the graphical relationship between the planned (and actual where appropriate) quantity of completed work (or resources) and time The curve produced is to be illustrated on an accumulative basis where the slope of the line indicates the rate of undertaking the work or rate of expenditure of the resources “Scheduled maintenance”: Maintenance activity to prevent failures by doing inspection, checking and adjustment, etc periodically “Second line maintenance”: Inspection and repair work on workshop with dismantling or disassembling which consist of replace equipment or part, and repair "Services, Electrical, Mechanical Drawings" (SEM): means those drawings produced by the Contractor showing the locations, sizes and details for openings in structural elements for Mechanical and Electrical facilities and other related contracts “Trial Run”: means the phase after completion of the System Acceptance Tests where Page GS of 200 Final Ho Chi Minh City Urban Railway Construction Project Ben Thanh - Suoi Tien Section (Line 1) Employer’s Requirements – General Specifications Package-3: (E&M, Rolling Stock, Trackwork, Maintenance) the training and operating procedures are validated through the running of the trains to the published timetable Trial Run form part of the Tests on Completion to be performed under the Contract in order to achieve Employer’s Taking Over of the Works or any Section “Software maintenance”: Activities on debagging, improvement, modification or replace of software “Spare parts” means those parts which are generally repairable and have normally a service life of several years “Specification (the)”: means the aggregate sum of the documents and any amendments thereto, issued to Tenderers by MAUR as part of the Tender process before the final date for submission of Tenders “Specification (this)”: means the particular document within which the reference is made "Structure Gauge": means the profile related to the designed normal co-ordinated axis of the track into which no part of any structures or fixed equipment may penetrate “System Acceptance Tests”: means those tests that demonstrate the performance of the installation/equipment to the specified requirements as detailed in the PS SATs form part of the Tests on Completion to be performed under the Contract in order to achieve Employer’s Taking Over of the Works or any Section “Systemwide Contractor”: means a Railways System Package Contractor “Third line maintenance”: Inspection and repair work done for replaced equipment or part including identification of cause of the failure “Validation”: means the process of confirmation by examination and provision of objective evidence that the application produced achieves the particular requirements specified “Verification”: means the process of confirmation by examination and provision of objective evidence that the specified requirements have been incorporated within design "Works Specification": means the combined specifications prepared by the Contractor format which combines the Employers Design Criteria, the Employer's Outline Construction Specifications and those parts of the Contractor's Technical Proposals which specify standards for design and construction which are developed during the Design Phase 2.2 ABBREVIATIONS 2.2.1 Common abbreviations used in the GS and in the PSs shall have the following meanings: ACB : Air Circuit Breaker AFC : Automatic Fare Collection ATO : Automatic Train Operation ATP : Automatic Train Protection Page GS of 200 Final Ho Chi Minh City Urban Railway Construction Project Ben Thanh - Suoi Tien Section (Line 1) Employer’s Requirements – General Specifications Package-3: (E&M, Rolling Stock, Track Work, Maintenance) EMPLOYER'S REQUIREMENTS APPENDIX 17 CONTRACTOR’S ROLE IN HIV/AIDS PREVENTION PROGRAMME ROLE OF CONTRACTOR The Contractor shall undertake the following role as part of the Contractor’s responsibilities to cooperate with the Service Provider in implementing the HIV/AIDS Prevention Programme: (a) Cooperate with the Service Provider in implementing the HIV/AIDS Prevention Program among the Contractor’s Employees for the duration of the Contractor’s contract and commencing as soon as practicable after the Contractor’s Employees arrive at the Site/s in conjunction with occupational health staff of the Contractor and the local health authorities involved in HIV/AIDS prevention; (b) Establish on-site health clinics to provide to the Contractor’s Employees without charge: information and counseling on STI/HIV/AIDS, first aid services by universal precaution for HIV/AIDS prevention, and condoms supplied by the Service Provider (c) Give any representative of the Service Provider and the Employer all reasonable access to the Site in connection with the HIV Prevention Program; (d) Instruct the Contractor’s Employees to participate in the HIV Prevention Program in the course of their employment and during their normal working hours or any period of overtime provided for in the relevant employment contracts; (e) Do nothing to dissuade the Contractor’s Employees from participating in the HIV Prevention Program; (f) Promote workers/employees to work as peer educators/BCC (Behavioral Change Communication) volunteers on HIV/AIDS prevention after being trained by the Service Provider; (g) Instruct the Contractor’s occupational health staff to participate in the Task Team organized by the Service Provider, and co-work with other members of the Task Team in carrying out the Program; (h) Facilitate and ensures the smooth operation of the Program especially awareness raising activites conducted for all Contractor’s employees including health staff; (i) Support the distribution of condoms through BCC volunteers trained by the Service Provider; (j) Support the distribution of BCC/IEC (Information, Education and Communication) materials provided by the Service Provider; (k) Organize HIV/AIDS prevention campaigns Page APP 17 / of for the Constructor’s Final Ho Chi Minh City Urban Railway Construction Project Ben Thanh - Suoi Tien Section (Line 1) Employer’s Requirements – General Specifications Package-3: (E&M, Rolling Stock, Track Work, Maintenance) ROLE OF KEY STAKEHOLDERS Key stakeholder Roles Joint Coordinating Committee (JCC) The Joint Coordinating representatives from: Committee (JCC) will consist of - HCMC Health Department (taking role as chairperson of JCC), - HCMC AIDS Committee, - MAUR/PMU, - AIDS Committees of project-affected districts, - Employer’s Representative, - Service provider, - Prime contractors, - JICA Hanoi Office, - Other members (as agreed upon by the chairperson) JCC will meet at least (two) times a year or whenever necessity arises, and work to: (1) Authorize an annual work plan of the Project (2) Monitor and evaluate the progress of the Project and the results of the annual work plan (3) Discuss and provide advices on major issues that arise during the implementation period of the Project MAUR/ PMU - Designate an HIV/AIDS Division to work closely with relevant experts of Employer’s Representative Employer’s Representative - Formulate the HIV/AIDS Prevention Program - Make TOR for hiring service provider - Contract out a service provider - Assist MAUR/PMU HIV/AIDS Division in establishing and strengthening the - Co-work with other stakeholders to revise the PDM, the action plans, etc and explain to the JCC for approval during its regular meetings - Suoi Tien Section (Line 1) Employer’s Requirements – General Specifications Package-3: (E&M, Rolling Stock, Track Work, Maintenance) conduct mid-term evaluation and terminate evaluation - Determine contractors’ obligations to facilitate the HIV/AIDS Prevention Program, and incorporate these obligations in the tender document and contracts - Supervise contractors’ obligations Service Provider - Sign contract with Employer’s Representative - Establish the Task Team - Prepare HIV/AIDS prevention action plans (long-term, mid-term, and short-term) - Implement HIV/AIDS prevention action plans - Make monthly narrative and financial reports to Employer’s Representative Content of the reports will be determined by Employer’s Representative - Assign one full-time Program Manager (PM) to oversee all program activities - Set up an office with proper location, space, staffing, and equipment to facilitate all community-based activities - Collaborate with the AIDS Committees to develop the network of Voluntary Counseling and Testing (VCT) Centers and further treatment referrals - Conduct internal monitoring based on the key indicators described in the Project Design Matrix (log frame) HCMC AIDS - Provide advices and supports to the Task Team Committee - Instruct local staff to cooperate with the Task Team - Collaborate with the Task Team to develop the network of Voluntary Counseling and Testing (VCT) and further treatment referrals Contractors (a) Cooperate with the Service Provider in implementing the HIV/AIDS Prevention Program among the Contractor’s Employees for the duration of the Contractor’s contract and commencing as soon as practicable after the Contractor’s Employees arrive at the Site/s in conjunction with occupational health staff of the Contractor and the local health authorities involved in HIV/AIDS prevention; (b) Establish on-site health clinics to provide to the Contractor’s Employees without charge: information and counseling on STI/HIV/AIDS, first aid services by universal precaution for HIV/AIDS prevention, and condoms supplied by the Service Provider Page APP 17 / of Final Ho Chi Minh City Urban Railway Construction Project Ben Thanh - Suoi Tien Section (Line 1) Employer’s Requirements – General Specifications Package-3: (E&M, Rolling Stock, Track Work, Maintenance) EMPLOYER'S REQUIREMENTS APPENDIX 18 PUBLICITY AND PUBLIC RELATIONS GENERAL The responsibilities of the Contractor shall without limitation include: (1) Inform and explain to the public on the background, the need and the development of the project; (2) Promote the project to the public and the parties concerned with a positive message; (3) Raise the community’s awareness on the current situation and problems caused by overload of urban traffic and congestion; (4) Educate the public on the importance and the appreciation of how the project protects the community from the inconvenience and pollution due to traffic congestion; (5) Highlight how the project improves the environment and transport condition of the people and brings about the benefits to the people; (6) Ensure adequate transparency of the project to the public and key stakeholders; (7) Gain support and minimize objections from the community and the parties concerned; (8) Establish a sense of partnership among the Government and stakeholder groups in the development of the project; (9) Solicit views, comments and suggestions and hence foster community consensus on the project objectives; (10) Provide proper responses to comments, criticism and complaints during the construction stage; (11) Resolve issues and crises arising during the course of construction; (12) Communicate with the concerned parties and to show them the team is keen to prevent and/or mitigate any nuisance due to the construction of the project at the earliest possible time; (13) Attend and answer queries for the purpose of public consultation including but not be limited to HCMC-PC, Employer, related competent agencies, NGOs or individual members of the public, local authorities and people in the affected areas, during or outside normal office hours; (14) Prepare and supply all necessary drawings, photomontages, documents, consultation papers, presentations, display materials for public consultations; Page APP 18 /1 of Final Ho Chi Minh City Urban Railway Construction Project Ben Thanh - Suoi Tien Section (Line 1) Employer’s Requirements – General Specifications Package-3: (E&M, Rolling Stock, Track Work, Maintenance) (15) Provide assistance and information to facilitate all PR activities as instructed by the Project Quality plan; PUBLIC CONSULTATION The Contractor shall carry out with the guidance of the Employer’s Representative, but not be limited to, the following public consultation works: (1) Inform and consult the relevant Government departments concerning the project, local residents, property management offices, shops, schools and sensitive receivers at least three months prior to the start of construction works; (2) Attend all public consultations and at least another one representative of the rank of Site Agent or equivalent; (3) Gain support, ease concerns and minimize objections from the public affected by the construction works during the public consultation; (4) Address public concerns and feedbacks as far as possible to minimize disturbance to the public during construction at the Constructor’s own expenses; (5) Report and give presentation to the concerned Employer’s Representative, HCMCPC, Employer, related competent agencies, NGOs and local authorities of the affected areas, etc., about the progress of the construction works and other information as requested The Contractor shall ensure proper communications to the public by establishing an effective communication channel The communications shall be open and transparent in the form of an interactive two-way system Stakeholders and parties concerned shall be updated regularly on the progress of Works and development of the projects in particular during construction stage on matter relating to ground movement, vibration and special traffic arrangement, etc by an easily accessible system Queries, feedbacks and comments from the stake holders and parties concerned shall be considered and handled properly in an effective manner An effective communication system of on-site notices, website and hotlines shall be set up PR TOOLS The Contractor shall provide and make use of, but not be limited to, the following PR tools in carrying out his PR duties: 3.1 Newsletter The Contractor shall design and produce newsletters with the guidance of the Employer’s Representative at three months interval throughout the construction period and distributed to concerned Government departments, HCMC-PC, Employer, related competent agencies, NGOs or individual members of the public, local authorities and people in the affected areas, etc The newsletters shall be published in both English and Vietnamese providing in depth descriptions of the project and the latest development and construction progress of the project The highlight shall on the benefits of the project, milestone events of the construction activities and mitigation measures taken to minimize Page APP 18 /2 of Final Ho Chi Minh City Urban Railway Construction Project Ben Thanh - Suoi Tien Section (Line 1) Employer’s Requirements – General Specifications Package-3: (E&M, Rolling Stock, Track Work, Maintenance) the impact to the public Ways of communication channels shall also be published in the newsletters such as the phone numbers of the enquiry hotline, RSS team and the email address for enquires, etc 3.2 On-site Notice The Contractor shall post on-site notices with the guidance of the Employer’s Representative with clear description of the Works and indication of anticipated completion date together with the enquiry hotline and internet website information Advance notices shall be given in carrying out the Works with great impact on local residents The design of this notice should be well considered to keep the good landscape 3.3 Hotline The Contractor shall set up a 24-hour hotline with the guidance of the Employer’s Representative to provide enquiry services to the public and the contractor should ensure queries and enquiries regarding the project are taken seriously and dealt with swiftly Whenever complaint is received, response shall be made within calendar days If a longer processing time is needed, an interim reply shall be served to the complainant within calendar days 3.4 Construction Site Tour The Contractor shall cooperate for having periodical tours for construction sites to the public during the construction period The main target audiences are ordinary families and students Site visitors become resources for advertising and promoting the benefit of the project, as well as future customers In addition, site tours aimed at students have further benefits in terms of recruiting future staff for the UMRT system The tour should be planned at least once in every three months with the instruction of the Employer’s Representative PR PLAN The Contactor shall produce a Public Relations (PR) Plan The PR Plan shall include the methodology specific ways and actions to be carried out for proper informing and consulting the public and promotion of the project The PR Plan shall also include the methodology specific ways and actions to handle reactions from the public, in particular issues relating to congestion, pollution, vibration, ground movement, noise, nuisance (during construction stage), compensation, etc The PR Plan shall give proposals and details on effective liaising, consulting, informing, meeting, contacting, clarifying with the public and gaining their support and understanding on the importance and benefits of the project and the mitigation measures to reduce the impacts which may generate during the construction stage of the project The Contractor shall update quarterly and submit the PR Plan including a summary of PR events conducted and complaints/ queries handled in the past quarter and PR events to be conducted and complaints/ queries envisaged in future throughout the Contract Period Page APP 18 /3 of Final Ho Chi Minh City Urban Railway Construction Project Ben Thanh -
