Resolution A.903(22) Adopted on 29 November (Agenda item 28) RELATIONS WITH NON-GOVERNMENTAL 200 ORGANIZATIONS THE ASSEMBLY, RECALLINGPart XV of the Convention Article 62, on the International Maritime Organization and in particular RECALLINGthat rule of the Rules Governing Relationship with Non-Governmental International Organizations requires that consultative status granted by the Council to such organizations be subject to approval by the Assembly, RECALLINGFURTHER that rule 10 of the same Rules provides for periodic review by the Council of the list of non-governmental international organizations in consultative status with IMO and for a report to be submitted to the Assembly on the continuation of such status, NOTING the Guidelines on the Grant of Consultative Status established by the Council at its fortieth session, and noting further the decisions of the Council at its eighty-sixth session to amend the introduction in the Guidelines as well as rules and of the Rules Governing Relationship with Non-Governmental International Organizations in order to formalize the grant of provisional consultative status, HAVING NOTEDthe decision of the Council at its eighty-sixth session to maintain consultative status with the organizations enjoying that status with IMO, and in respect of those organizations which did not attend or submit documents to IMO meetings during the past biennium, to maintain the consultative status of the International Association of Producers of Insurance and Reinsurance (BIPAR) and the International Maritime Lecturers' Association (IMLA), HAVING CONSIDEREDthe decisions of the Council to approve the grant of consultative status to the International Harbour Masters' Association (lHMA); the Vessel Operators Hazardous Materials Association (VOHMA); International Christian Maritime Association (lCMA); International Bulk Terminals Association (lBTA); The Royal Institute of Naval Architects (RINA), NOTING the decision of the Council to convert the provisional status granted to the World Nuclear Transport Institute (WNTI) to full consultative status, and to retain the provisional consultative status of the Association of European Shipbuilders and Shiprepairers (AWES), as well as that of the International Ship Suppliers Association (lSSA), which is encouraged by the Council to participate in the work of the Legal Committee as well as the other Committees in which it has an interest, RECALLINGthe concerns of the Council made at its eighty-sixth session that the ships of Greenpeace International are believed to violate the International Regulations for Preventing Collisions at Sea and noting the letter of 25 July 2001 from Greenpeace International, reaffirming and reinforcing the commitment it made at the seventeenth session of the Assembly to comply with the International Regulations for Preventing Collisions at Sea, and noting the decision of the Council that the activities of Greenpeace International be monitored at the next review under Rule 10 of the Rules Governing Relationship with NonGovernmental International Organizations, WELCOMESthe action taken by the Council to remind all non-governmental organizations of the importance of their complying with their undertakings to the Organization under rule of the Rules Governing Relationship with Non-Governmental International Organizations and noting the undertakings expressed by all the non-governmental organizations, - Resolution A.903(22) Resolution A.932(22) Adopted on 29 November (Agenda item 10) IMPLEMENTATION 200 OF THE HNS CONVENTION THE ASSEMBLY, RECALLINGthe adoption of the International Convention on Liability and Compensation for Damage in Connection with the Carriage of Hazardous and Noxious Substances by Sea, 1996 (hereinafter referred to as the "HNS Convention"), RECOGNIZING the dangers posed by the world-wide carriage by sea of hazardous and noxious substances; BEING AWARE of the need to ensure that adequate, prompt and effective compensation is available to persons who suffer damage caused by incidents in connection with the carriage by sea of such substances; HAVING AGREED to adopt uniform international rules and procedures for determining questions of liability and compensation in respect of such damage, NOTING that only eight States are signatories to the HNS Convention and that at 29 November 2001 only two States have become party to it, NOTING FURTHERthat the Legal Committee established a Correspondence Group in October 1999 to monitor the efforts of interested parties to become Party to the HNS Convention and their achievements in implementing it, thus encouraging other States to follow this path, RECALLINGthe importance of Governments being mindful of the time needed for effectively implementing the HNS Convention, and thus of the need for well-planned time schedules for the implementation process; BELIEVING that it is desirable for Member implementation of the HNS Convention, States to take a co-ordinated approach towards the CONSCIOUS that the ultimate effectiveness of any instrument depends, inter alia, upon all States: (a) becoming Party to the instrument; (b) implementing (c) enforcing it rigorously, it fully and effectively; and URGESall Member States to place a high priority on working towards the implementation of the HNS Convention and on resolving any practical difficulties in setting up the new regime, with the aim of ratification of, acceptance, approval or accession to, the HNS Convention, ENCOURAGESall Member States to participate in the ongoing work of the HNS Correspondence Group and to work together with industry to assist in the implementation process by sharing details of available information on identifying receivers, contributing cargo and other relevant information; and REQUESTSthe Legal Committee, when reporting to the Assembly, specifically to address the progress made and practical issues encountered in accepting and implementing the HNS Convention Resolution A.932(22) - 231 Resolution A.933(22) Adopted SUSTAINABLE FINANCIAL on 29 November (Agenda item 17) SUPPORT 2001 FOR THE WORLD MARITIME UNIVERSITY THE ASSEMBLY, RECALLINGArticles 2(e) and 15(k) of the Convention on the International Maritime Organization concerning the functions of the Organization and the Assembly in relation to the facilitation and promotion of technical co-operation, RECALLINGALSO that the World Maritime University (WMU) was established in 1983 pursuant to Assembly resolution A.501 (XII) of November 1981, for the purpose of (a) providing advanced maritime education and training for senior maritime personnel, in furtherance of the purposes and objectives of the International Maritime Organization; and (b) promoting the achievement of the highest practicable global standards in matters concerning maritime safety, marine environmental protection and the efficiency of maritime transportation, RECALLINGIN PARTICULARthe provisions of resolution A.900(21), Objectives of the Organization in the 2000s, which acknowledged, inter alia, the special contribution of the World Maritime University to the attainment of the objectives of the Organization, RECOGNIZING that the WMU has to date provided specialist maritime education and training to 1,750 men and women from 141 countries around the world, thus benefiting directly the great majority of IMO Member States, RECOGNIZINGFURTHERthat the WMU programme has been a great success, as indicated by the increasing number of WMU graduates in senior positions in the global maritime sector at both the national and international level, the steadily rising demand for study and training at WMU, and the critical acclaim and recognition which WMU has received in the international milieu of higher education; ACKNOWLEDGING the contribution sound maritime industry; that WMU graduates make to a safe, efficient and environmentally ACKNOWLEDGING ALSO that the development and progress of the WMU would not have been possible without the continued generous financial support provided by a small number of countries and organizations since its inception, BEING AWARE that the WMU needs more broadly based and sustainable financial support from IMO Member States and the maritime industry if it is to continue discharging effectively its mandate and service to the global maritime community, HAVING CONSIDEREDthe recommendation session, made by the Technical Co-operation Committee at its fiftieth REAFFIRMSthe importance and continued necessity of the WMU as an instrument of IMO to provide advanced maritime education, training and technical advice in furtherance of the objectives and goals of the International Maritime Organization and its Member States; 232 - 233 Resolution A.934(22) Adopted SUSTAINABLE on 29 November (Agenda item 17) 200 FINANCIAL SUPPORT FOR THE IMO INTERNATIONAL MARITIME LAW INSTITUTE THE ASSEMBLY, RECALLINGArticles 2(e) and 15(k) of the Convention on the International Maritime Organization concerning the functions of the Organization and the Assembly in relation to the facilitation and promotion of technical co-operation, RECALLINGALSO that the IMO International Maritime Law Institute (lMLI) in Malta was established in 1988 as an international centre for the training of specialists in maritime law and for the development and dissemination of knowledge and expertise in the international legal regime of merchant shipping and related areas of maritime law and the general law of the sea, in furtherance of the purposes and objectives of the International Maritime Organization; and to promote greater global implementation of international codes and regulations in order to achieve the Organization's twin goals of safety at sea and marine environmental protection, as well as to increase efficiency of maritime transportation, RECALLINGIN PARTICULARthe provisions of resolution A.900(21), Objectives of the Organization in the 2000s, which acknowledged, inter alia, the special contribution of the IMO International Maritime Law Institute to the attainment of the objectives of the Organization, RECOGNIZING that the Institute has to date provided specialist maritime law education and training to 236 men and women from 90 countries and territories around the world, thus benefiting directly the great majority of IMO Member States, RECOGNIZING FURTHERthat the IMLI programme has been a great success, as indicated by the increasing number of IMLI graduates in senior positions in the global maritime sector at both the national and international level, the steadily rising demand for study and training at the Institute, and the recognition which IMLI has received in the international milieu of higher education; ACKNOWLEDGING the contribution maritime industry; that IMLI graduates make to a safe, efficient and environmentally sound ACKNOWLEDGING ALSO that the development and progress of the IMLI would not have been possible without the continued generous financial support provided by a number of countries and organizations since its inception, BEINGAWAREthat the IMLI needs more broadly based and sustainable financial support from IMO Member States and the maritime industry if it is to continue discharging effectively its mandate and service to the global maritime community; HAVING CONSIDEREDthe recommendation made by the Council at its twenty-first extraordinary session; REAFFIRMS the importance and continued necessity of the IMLI as an instrument of IMO to provide advanced education, training and technical advice in maritime law in furtherance of the objectives and goals of the International Maritime Organization and its Member States; URGESMember States to: 234 - 235 Resolution A.935(22) Adopted on 29 November 2001 (Agenda item 17) SUSTAINED SUPPORT FOR THE IMO INTERNATIONAL MARITIME ACADEMY, TRIESTE THE ASSEMBLY, RECALLINGArticles 2(e) and 15(k) of the Convention on the International Maritime Organization concerning the functions of the Organization and the Assembly in relation to the facilitation and promotion of technical co-operation, RECALLINGALSO that the IMO International Maritime Academy in Trieste, Italy, was established in 1988 as an international centre for the provision of specialized short courses in the maritime field and the implementation of IMO model courses, and to help achieve the Organization's twin goals of safety at sea and marine environmental protection as well as to increase efficiency of maritime transportation, RECALLINGIN PARTICULARthe provisions of resolution A.900(21), Objectives of the Organization in the 2000s, which acknowledged, inter alia, the special contribution of the IMO International Maritime Academy to the attainment of the objectives of the Organization, RECOGNIZINGthat the Academy has to date provided specialist maritime education and training to 542 men and women from 108 countries and territories worldwide, thus benefiting directly a vast number of IMO Member States, ACKNOWLEDGING the contribution maritime industry, that the Academy makes to a safe, efficient and environmentally sound ACKNOWLEDGING ALSO that the development and progress of the IMA would not have been possible without the continued generous support provided by the Government of Italy and other donors since its inception, HAVING CONSIDEREDthe recommendation made by the Council at its twenty-first extraordinary session, REAFFIRMSthe importance and continued necessity of the IMA as an instrument of IMO to provide advanced education, training and technical advice in cartography, hydrography flag State implementation, marine accident and incident investigation, and other aspects of maritime transport in furtherance of the objectives and goals of the International Maritime Organization and its Member States; URGESMember States to: (a) consider committing themselves to pledging continued support to the Academy with respect to the provision of fellowships; and (b) encourage the shipping and related maritime industry in their countries effectively to use and support the IMA programme; and ALSO URGESthe direct beneficiaries of the education and training provided by the Academy to act as a catalyst within their own countries for the achievement of the objectives listed under operative paragraph 236 - Setting the Organization's policies and objectives and expressed its appreciation to Mr G Dubbeld (Netherlands), outgoing Chairman of the Council, for his outstanding contribution to the work of the Organization DIPLOMATIC CONFERENCES 22 November 2001 Agenda item 15 (a) Conference on International Co-operation on Preparedness and Response to Pollution Incidents by Hazardous and Noxious Substances (b) International Conference on the Revision of the International Convention on the Establishment of an International Fund for Compensation for Oil Pollution Damage (c) International Conference on Liability and Compensation (d) International Conference on the Control of Harmful Anti-fouling Systems on Ships for Bunker Oil Pollution Damage The Assembly noted the successful conclusion of the above-mentioned decisions taken by the Council in respect of each Conference Diplomatic Conferences and the MARITIME TRAINING PROGRAMMES 22 November 2001 Agenda item 17 The Assembly urged Administrations to encourage the use of IMO model courses as appropriate, invited Governments to provide funding for, and otherwise assist in, the revision and updating of the model courses and expressed its appreciation for the Secretary-General's continuing efforts to promote the success of the model course programme JOINT INSPECTION UNIT 22 November 2001 Agenda item 26 The Assembly took note of the reports of the Joint Inspection Unit and the information action taken on those reports as far as IMO was concerned RELATIONS WITH INTERGOVERNMENTAL provided on the ORGANIZATIONS 22 November 2001 Agenda item 27 The Assembly took note of the change of name of two intergovernmental organizations with which IMO had concluded an agreement of co-operation: the name of the Ministerial Conference for the States of West and Central Africa (MINCONMAR) had changed to Maritime Organization for West and Central Africa (MOWCA) and the name of the Asian African Legal Consultative Committee (AALCC) had been changed to the Asian African Legal Consultative Organization (AALCO) These changes were now reflected in IMO's records 238 - Other decisions RELATIONS WITH NON-GOVERNMENTAL ORGANIZATIONS 22 and 29 November 2001 Agenda item 28 The Assembly approved the grant of consultative status to the following non-governmental organizations: _ International Harbourmasters' Association (IHMA); _ Vessel Operators Hazardous Materials Association (VOHMA);-International Christian Maritime Association (ICMA); _ International Bulk Terminals Association (IBTA); and _ Royal Institution of Naval Architects (RINA) The Assembly also approved the conversion of the provisional status of the World Nuclear Transport Institute (WNTI) to full status and noted with appreciation the action undertaken by the Secretary-General to remind all non-governmental international organizations in consultative status with IMO of the importance of complying with their undertakings to the Organization under Rule of the Rules Governing Relationship with International Non-Governmental Organizations ELECTION OF MEMBERS OF THE COUNCil 23 November 2001 Agenda item 29 The Assembly decided to elect, at its current session, the eight additional Members of the Council, as provided for under the amended versions of Articles 16 and 17 of the IMO Convention, on the understanding that they would take their seats on the Council on November 2002, upon the entry into force of the 1993 amendments In accordance with Articles 16 and 17 of the IMO Convention, as amended, the Assembly first elected the 32 regular Members of the Council as follows: Under Article 17(a): China, Greece, Italy, Japan, Norway, the Russian Federation, the United Kingdom and the United States Under Article 17b): Argentina, Brazil, Canada, France, Germany, India, the Netherlands and Sweden Under Article 17(c): Malta, Bahamas, Republic of Korea, Cyprus, Singapore, Philippines, South Africa, Australia, Spain, Indonesia, Mexico, Panama, Turkey, Poland, Algeria and Egypt The Assembly then elected to the Council two additional States with the largest interest in providing international shipping services as follows: Under Article 17(a), as amended: Republic of Korea and Panama The Assembly then elected to the Council two additional States with the largest interest in international seaborne trade as follows: Under Article 17(b), as amended: Spain and Bangladesh The Assembly then elected to the Council four additional States not elected under categories A or B, which had special interests in maritime transport or navigation, and whose election to the Council would ensure the representation of all major geographical areas of the world, as follows: Under Article 17(c), as amended: Chile, Denmark, Kenya and Venezuela Finally, the Assembly elected to the Council three additional States as a result of vacancies due to Members of the Council changing category These additional Members would take their seats on November 2002: Ghana, Lebanon, Honduras Other decisions - 23 ELECTION OF MEMBERS TO THE IMO STAFF PENSION COMMITTEE 23 November 2001 Agenda item 30 In accordance with Article of the Regulations of the United Nations Joint Staff Pension Fund, the Assembly elected Mr J Aguilar-Salazar (Mexico) as member and Miss U Moetzel (Germany) as alternate member of the IMO Staff Pension Committee for the 2002-2003 biennium RELATIONS WITH THE UNITED NATIONS AND THE SPECIALIZED AGENCIES 29 November 2001 Agenda item 25 The Assembly renewed the request to Member Governments to take appropriate steps to brief their representatives to other United Nations organizations and bodies regarding the competence and responsibilities of IMO, to ensure that the decisions and programmes of those organizations and bodies took full account of IMO's work, in order to prevent unnecessary duplication or overlapping between the work of IMO and that of the respective organizations and bodies The Assembly noted with satisfaction the action taken by the Secretary-General on 14 February 2000 to deposit on behalf of IMO an act of formal confirmation of the Vienna Convention on the Law of Treaties between States and International Organizations or between International Organizations, which had been concluded on 21 March 1986, and further noted that IMO had become a signatory of the Convention on that date The Assembly commended the initiative of the Secretary-General and his report to the Administrative Committee on Co-ordination on IMO's proposal to establish an inter-agency group on persons rescued at sea and/or asylum seekers and refugees and to identify any existing gaps, inconsistencies, duplications or overlaps in the relevant legislation, for which IMO would act as the lead agency MEMORIAL TO SEAFARERS Agenda item 34 29 November 2001 The Assembly expressed appreciation to all Governments, organizations and individuals who had responded favourably to the Secretary-General's appeal for funds to enable the Memorial to be erected as planned and encouraged all those entities already approached, or to be approached, to contribute generously to the achievement of the Fund's second objective, namely the establishment of a Chair of maritime safety and marine pollution prevention at the World Maritime University, and invited the Secretary-General to continue his efforts to promote the Seafarers Memorial Trust Fund scheme, and to report on developments to the twenty-third session of the Assembly APPROVAL OF THE REPORTS OF THE MARITIME SAFETY COMMITTEE Agenda item 29 November 2001 The Assembly approved the reports of the Maritime Safety Committee on its seventy-second to seventyfourth sessions, subject to decisions taken in connection with the matters raised in these reports under the relevant agenda items APROV AL OF THE REPORTS OF THE LEGAL COMMITTEE Agenda item 10 29 November 2001 The Assembly approved the reports of the Legal Committee on its eighty-first to eighty-third sessions,subject to decisions taken in connection with the matters raised in these reports under the relevant agenda items 240 -
