Resolution A.8 74(21) Resolution A.899(21) Adopted on 25 November (Agenda item 10) ACCEPTANCE OF ClC INSURANCE 1999 CERTIFICATES THE ASSEMBLY, RECALLINGArticle 15(j) of the Convention on the International Maritime Organization concerning the functions of the Assembly in relation to regulations and guidelines concerning maritime safety and the prevention and control of marine pollution from ships, and legal matters related thereto, RECALLINGalso that at present there are in force two different and distinct regimes of limitation of civil liability in case of oil pollution damage, namely the regime established under the International Convention on Civil Liability for Oil Pollution Damage, 1969 (CLC 69) and that set out in the Protocol of 1992 to amend CLC 69 (the 1992 CLC Protocol), NOTING that Article VII of CLC 69, as well as Article of the 1992 CLC Protocol, make the provision of insurance compulsory for ships carrying more than 2,000 tons of oil in bulk as cargo and require the ships in question to carry a certificate issued by a State Party thereto as proof of compliance with this requirement, UNDERSTANDINGthat a number of CLC 69 States Parties require ships flying the flag of States Parties to the 1992 CLC Protocol (the 1992 CLC ships) to be provided with a certificate issued in accordance with Article VII of CLC 69 (1969 CLC certificates), FURTHERNOTING that, so far, the 1992 CLC ships have been able to call at ports of CLC 69 States Parties, because a number of CLC 69 States Parties were issuing to them, in accordance with their national practices, 1969 CLC certificates, RECOGNIZINGthat, in the near future, as a result of the accession of CLC 69 States Parties to the 1992 CLC Protocol, the 1992 CLC ships will no longer be able to obtain 1969 CLC certificates, BEINGAWARE that the ceiling of limitation of liability established by the 1992 CLC Protocol is higher than that established under the provisions of CLC 69, FURTHERRECALLINGthat resolution of the International Conference on the Revision of the 1969 Civil Liability Convention and the 1971 Fund Convention (the 1992 Conference) established a practice in respect of the issue and the recognition of CLC certificates by the CLC 69 and the 1992 CLC Protocol States Parties, ApPRECIATINGthe efforts of the Organization to strengthen the accountability flag States, and responsibility of States as DESIRINGto assist ships to trade without any unnecessary delays, HAVING CONSIDEREDthe recommendation made by the Legal Committee at its eightieth session: INVITESStates Parties to CLC 69 not to require ships holding 1992 CLC certificates to obtain 1969 CLC certificates, and to accept certificates issued under the provisions of Article of the 1992 CLC Protocol as meeting the requirements of paragraph 11 of Article VII of CLC 69; URGESStates Parties to the CLC 69 to become parties to the 1992 CLC Protocol as soon as possible; INVITESFURTHERCLC 69 States Parties to issue to 1992 CLC ships 1969 CLC certificates only if they are requested to so by the States whose flag these ships are entitled to fly; Resolution A.899(21) - 179 FURTHERURGESMember States of IMO which are not Parties to CLC 69 or 92 to encourage their shipowners to ensure that their Registry is notified of the issue of a CLC certificate to their ships under either CLC regime; and REQUESTSthe Secretary-General of the Organization acceptance of the 1992 CLC Protocol 180 - Resolution A.899(21) to intensify his efforts to ensure the wider Resolution A.900(21) Adopted on 16 November 1999 (Agenda item 8) OBJECTIVESOF THE ORGANIZATION IN THE 2000s THEASSEMBL Y/ RECALLINGthe desire expressed in resolution A.500(XII), Objectives of the Organization in the 1980s, to provide an institutional means to ensure achievement of IMO/s objectives of safer shipping and cleaner oceans, while maintaining flexibility to meet contingencies, RECALLING ALSOthe desire expressed in resolution A.777(18), Work Methods and Organization of Work, to ensure a fuller, more active and more informed participation by all Member States in the work of the Organization, in particular in any decision-making process, RECALLINGFURTHERprevious decisions whereby it assigned the highest priority to the promotion of the implementation of international standards and regulations for the improvement of maritime safety and for the prevention and control of marine pollution from ships adopted by the Organization, and for the resolution of legal matters related thereto, RECALLINGIN PARTICULAR the directions to the Council and Committees provided in resolutions A.500(XII) and A.777(18) whereby the former was asked to co-ordinate the work of the latter through, inter alia, agreeing on work programme goals and assignment of priorities among general subject areas, BEINGAPPRECIATIVE of the stewardship of the Council and of the response of all Committees in adopting and consistently implementing the Guidelines on the organization and method of their work, RECOGNIZINGthe ceaseless efforts of the Secretary-General to promote: - the objectives of the Organization (in particular, the decisive action and leadership he provided towards enhancing the safety of ro-ro passenger ships and bulk carriers and the expeditious revision of the STCW Convention); and - the world-wide implementation of the standards and regulations adopted by the Organization (in particular, his efforts to ensure wide and effective implementation of the revised STCW Convention, ISM Code, MARPOL 73/78 and the FAL Convention), RECOGNIZINGFURTHER the Secretary-General/s initiative in restructuring the Organization/s budget in such a manner that it now focuses on the Organization/s work programme, thus contributing to the attainment of the objectives of the Organization through increased transparency and accountability, ACKNOWLEDGINGthe invaluable contribution of the Organization/s technical co-operation activities to effective implementation of the various IMO standards, resulting in enhanced safety and environmental protection, ACKNOWLEDGINGALSOthe special contribution of the World Maritime University, the IMO International Maritime Law Institute and the IMO International Maritime Academy to the attainment of the objectives of the Organization, DESIRINGto ensure the Organization's continued promotion of quality shipping in accordance with its status as the world's foremost maritime institution, BEINGCOMMITTEDto ensuring the fulfilment of the Organization/s aims and objectives and to the setting of clear priorities for the purpose of achieving them in a uniform manner on a global basis, Resolution A 900(21) - 181 REAFFIRMSits direction to the Council to co-ordinate the work of Committees and to ensure consistency with the overall goals of the Organization; DIRECTSthe Committees, under the co-ordination of the Council: to take measures to implement the proactive policy agreed in the 1990s more actively than in the past, so that trends which might adversely affect the safety of ships and those on board and/ or the environment may be identified at the earliest feasible stage and action taken to avoid or mitigate such effects In implementing this directive, Formal Safety Assessment should be used to the extent possible in any rule-making process; to focus their attention on: - shifting emphasis onto people; - ensuring the effective uniform implementation of existing IMO standards and regulations relating to maritime safety and environmental protection, placing particular emphasis on the implementation of the revised STCW Convention and the ISM Code and on putting in place the necessary infrastructure for the implementation of the global SAR plan and the MARPOL requirements concerning reception facilities for ship-generated waste; - addressing safety and environmental protection issues, to the extent feasible, by ship types, with particular emphasis on passenger ships (including high-speed passenger craft) and bulk carriers; - ensuring the wide early acceptance of those annexes to the MARPOL Convention which have not yet entered into force; - developing a safety culture and environmental conscience in all activities undertaken by the Organization; - voiding excessive regulation; and - giving priority to and strengthening the Organization's technical co-operation programmes and delivery to achieve sustainable development and effective implementation of the Integrated Technical Co-operation Programme; to promote the intensification by Governments and industry of efforts to prevent and suppress unlawful acts which threaten the security of ships, the safety of those on board and the environment (in particular, terrorism at sea, piracy and armed robbery against ships, illicit drug trafficking, illegal migration by sea and stowaway cases); and to continue observing resolution A.500(XII) and resolution A.777(18), the continuing relevance of which has been reaffirmed on many occasions since their adoption; INVITESMember Governments to bring this resolution to the attention of their representatives who attend meetings of the Organization, advising them to observe the policies and directives of this resolution as well as those contained in resolutions A.500(XII) and A.777(18) 182 - Resolution A 900(21) Resolution A.901 (21) Adopted on 25 November (Agenda item 12) IMO AND TECHNICAL CO-OPERATION 1999 IN THE 2000s THEASSEMBLY, RECALLING Articles 2(e) and 15(k) of the Convention on the International Maritime Organization concerning the functions of the Organization and the Assembly in relation to the facilitation and promotion of technical co-operation, RECALLINGALSO resolution A.873(20), in operative paragraph of which the Assembly reaffirmed that technical co-operation is an essential part of the Organization's work to achieve the ratification and implementation of IMO's global instruments, RECALLINGFURTHERresolution A.900(21) on Objectives of the Organization in the 2000s, through which the Assembly, inter alia: - affirmed its commitment to ensuring the fulfilment of the Organization's aims and objectives and to the setting of clear priorities for the purpose of achieving them in a uniform manner on a global basis; and - directed the Committees, under the co-ordination of the Council, to focus their attention on, among other subjects, strengthening the Organization's technical co-operation programmes and delivery to achieve sustainable development and effective implementation of the Integrated Technical Co-operation Programme (lTCP), ACKNOWLEDGINGwith appreciation the initiative of the Secretary-General in proposing technical cooperation as a clear priority for the Organization during the 2000s, ALSOACKNOWLEDGINGwith appreciation the work of the Technical Co-operation Committee: - in reforming comprehensively the technical co-operation work of the Organization in order to increase its effectiveness in supporting the uniform implementation and enforcement of global maritime standards; and - in adopting technical co-operation priorities and principles for the future, as illustrated at annex, as well as a realistic and pragmatic ITCP that will provide assistance to developing countries, RECOGNIZING,in this context, that a comprehensive policy statement on technical co-operation would complement resolution A.900(21), support the related work of the Organization and provide guidance to the global community on the purpose and impact of IMO's technical co-operation activities, BEINGAWAREthat the series of global United Nations conferences held during the 1990s has brought about significant reforms in the United Nations system's operational activities for development, with the aim of increasing the effectiveness of the system's support for sustainable development, RECALLINGthat several IMO instruments contain provisions on the promotion of technical co-operation which urge the Parties thereto to support other Parties requesting technical assistance for their effective implementation and enforcement, AFFIRMSthat technical co-operation is an essential means of supporting the efforts of developing countries to strengthen the reliability and performance of their maritime activities, in compliance with global maritime standards; Resolution A.901 (21) - 183 DECIDESthat the key objective of IMO's technical co-operation programme during the 2000s shall be maritime capacity-building, as a major contributor towards ensuring safer shipping and cleaner oceans; DECIDES ALSOthat IMO's mission statement, in relation to technical co-operation in the 2000s, shall be to help developing countries improve their ability to comply with international rules and standards relating to maritime safety and the prevention and control of marine pollution, giving priority to technical assistance programmes that focus on human resource development, particularly through training, and institutional capacity-building; AFFIRMSthat IMO's work in developing global maritime standards and in providing technical cooperation for their effective implementation and enforcement, can and does contribute to sustainable development, as illustrated at annex; URGES (a) the Organization's development partners to acknowledge and respond to the direct relationship between IMO's regulatory and technical co-operation work and the promotion of sustainable development and, accordingly, to give increased priority to the maritime sector within national and multilateral development aid programmes; and (b) Member States to take that linkage into account in the preparation and delivery of their national development plans; URGESParties to IMO instruments including provisions on technical co-operation to respond to their commitments; INVITESMember States and partner organizations to use IMO as the mechanism for co-ordination in relation to technical co-operation in the maritime sector, so as to prevent the duplication of effort and resources, and thereby ensure the maximum impact of the assistance being provided and the effective promotion of IMO objectives; REAFFIRMS its mandate to the Technical Co-operation Committee to devise effective and innovative means of attracting and securing further financial and in-kind support for the ITCP, and, in this context, invites Member States and the Secretariat to contribute to such work; and INVITESMember States, the industry and partner organizations to continue, and if possible increase, their support for the ITCP and maritime technical co-operation generally Annex PRIORITIES FOR THE FUTURE OF IMO'S TECHNICAL CO-OPERATION PROGRAMME PRIORITIES Advocacy of global rules and standards RESULTS maritime International treaty instruments ratified, and implementing national legislation put in place Institutional capacity-building Public sector departments capable of ensuring the effective exercise of flag, port and coastal State jurisdiction Human resource development Trained male and female experts to develop and manage national programmes for: • • • • • • 184 -
