Necessity In the modern era, maritime economic has been growing its important role in the human life The very first benefit it brings about is transportation that is recognized as Silk Road on the sea, handling approximately 90 per cent of commercial merchandise of the international trade.This way of transportation guarantees cargo movement within a region or even from continent to continent The relatively low cost, in comparison with other modes of product shipping, boost up the mass production, particularly outsourcing activity of numerous firms that allows a worldwide products distribution Apart from economics, maritime development has many benefits in larger fields The sea accounts for three-quarter of the global area on the Earth; therefore, taking control of the sea brings much greater power than land power does This special territory not only provides a new economic space but also create a new trend of science, technology research in exploring and exploiting natural resources for fuel, materials, energy, food and living space in the near future However, as a large area with low population density, the sea turns out to be a very vulnerable destination where various threats to individuals, organizations and even governments may occur Once these threats happen, they are likely to cause severe damages in different aspects This is the reason why offshore security has become as a widely concerned topic all over the world As a nation with the coastline of over 3,000 km, Vietnam is also concern about the matter of maritime security According to UNCLOS 1982, the sea area of Vietnam is up to million km2together with approximately 3,000 islands, 48 bays and more than 100 river entrances In term of population, 29 cities and provinces are located nearby the sea with the population of over 20 million people In addition, there are a wide range of economic activities are currently happening there such as port operation, fishery, tourism, salt production, and so on Therefore, the sea has a strong connection to Vietnamese in various fields, which requires a thoughtful care for a comprehensive and secured development in a long run Being connected to one of the most principal trade routes on the sea that passing Strait of Malacca, is an advantage but also a disadvantage to Vietnam To the positive side, this route serves the majority of global shipment, hence, the volume of cargo are likely through Vietnam can be really high According to CIEM – Vu Phuong Thao – GMA0301 Page RecommendationstoenhanceshipandportfacilitysecurityunderISPScodeinQuangNinhportarea 2.4.2.4 Human resources Authority agencies in charge of maritime security, like Maritime Administration of Quang Ninh, Management board of borderland post, Waterway police, QuangNinh customs, local police, PA67 department and so on have experience insecurity warranty as well as got professional working process Actual training for PortFacilitySecurity Officers (PFSO) show some limited aspects The hold of more than one position by PFSOs is also the reason for incapable of performing port facility, particularly, with insecurity incidents that require imminent response As far as being reported, currently there is only one executive in the division is specialized in supervising the maritime security of the whole area However, at the same time he is also in charge of PSC and frequently has to go checking PSC of vessel visiting QuangNinhportarea during working days As a result, it can be realized that the PSC performance is paid much more attention toin the work of maritime Safety and Inspection Division This is a factor triggering the problem of fomalistic work mentioned in the above criteria In conclusion to what has been discussed above, the the evaluation of shipandport faciliti security can be summaried in some following points Strong points - The working flow is in compliance with ISPScodeand regulations in Vietnam - Executives of Maritimes Safety and Inspection Division and other involved parties has been followed the the right order of each procedures, step by step - All related organizations has participated in securing shipandportfacilitysecurityinQuangNinhport area, fulfilling their missions with much experience Weak points - The central point of maritime securityin the region is not well defined and paid attention to - The inspection of designated organization has been formalistic in order to complete documentary procedures - Communication, in term of information transmitting has not been efficient - There is a lack of human resource having experience and knowledge in inpecting the plan implementation in Maritime Administration of QuangNinh Vu RECOMMENDATIONSTOENHANCESHIPANDPORTFACILITYSECURITYUNDERISPSCODEINQUANGNINHPORTAREAInQuang Ninh, there has been record on possible threat toPort Facilities and Ships inport such as: Destruction toPort Facilities and Ships, Robbery/Kidnapping of vessels and her crew, blockages of entrances, gates, port access channels, biological and chemical attacks and so on The port facilities and ships have not been required toenhance the security level (level or 3) However, the security gaps and limited self-protection identified in the port facilities security assessment plus pilferage on board vessels are considered as possible dangers to maritime security 3.1 Compliance with ISPScodeand regulations in Vietnam What should be put in the first priority is to set up strict and comprehensive legal system in an attempt to formalize the relationship between social-economic development and building up defence potential, security, right and obligation of citizens in the national defence After 2010, it is required to draft a new law on Civil Defence, law on Protection of vital targets or Anti-terrorism in line with Resolution no 48-NQ/TW dated May 24 2005 from Politburo regarding strategy to build up and completion of the legal system of Vietnam to 2010, orientation to 2020 It is very necessary to set up a clear definition for maritime security that may become a concrete foundation for further security network being built closely to the framework and not ovelapping other maritime tasks On the other hand, this definition and amendment have to clearly address threats having high possibility to happen in Vietnam, particularly in every single city and province The specific situation of Vietnam needs to be taken into consideration, and the international convention should not be applied just literally The reason why regional and national cases are substantially emphasized is that it may have strong influence on the awareness of all parties involved Practically, maritime security actions are often neglected by parties in charge due to the noticeably low possibility of mass destructive threats like terrorism or piracy However being different from the U.S.A, where terrorism prevention is the top priority or Malaysia, where piracy is very active, Vietnam should identify the top threat in term of maritime security is pilferage and trafficking Once this is clearly stated in legal documents like Vu Phuong Thao – GMA0301 Page 36 RecommendationstoenhanceshipandportfacilitysecurityunderISPScodeinQuangNinhportarea resolutions, circulars and so on, it becomes official and the attitudes as well as task designation at lower layers is adjusted to the same direction In order to improve the inpection procedure in this region, a recommendation is delivered to the government so as to amend Circular no 27/2011/TT-BGTVT It is essential to add in clear guidance to assess risks of portential threats toport facilities, solutions to handle those risks Thirdly, for the port operator, it is necessary to issue terminal regulations andport facilities security plan that are suitable with the practical situation and popularize in the terminal, make sure that the plan is always implemented properly 3.2 Implementation of the procedure The working processes are very well organized in the two first stage assessment and planning However, when it comes to inspection phase, the task has not been completed truly effectively Take the security inspection as an instance, some stages in the working schedule can be accomplished in advance and online, which can save a great deal of time The list of self-assessment can be sent to all six parties in advance via email or even postal way As a result, they may have more time to thoroughly review the list, detect mistakes occur and figure out suspected errors that the terminal opertor probably hiding In the level of the terminal, portsecurity officers are always on duty 24/24 at the entrance areas, loading/unloading areaand other places that are prone to pilferage or rebellion There must have strict control on the entrance to guarantee that no strangers or employees that are not in charge to enter in Additionally, the security officer at the terminal has to guarantee that port staff not to steel cargo from the ship, which may affect the reputation of the terminal as well as the whole port 3.3 The cooperation of related organizations The first recommendation should be made is for the Governmen to establish central point to local organization model, maritime security administration in line with regulations of Law in force To draft Regulation on Co-operation among central and local forces –securities forces inport for proper and effective response to act of terror or vandalism Vu Phuong Thao – GMA0301 Page 37 RecommendationstoenhanceshipandportfacilitysecurityunderISPScodeinQuangNinhportarea There is a recommendation to amend some item in Circular 47/2011/TT-BGTVT in the aspect of co-operation among related parties, namely: - Item in section 5: The time for foreign vessels to inform should be added For the vessels having voyage less than 24 hours, the crew have to inform immediately after leaving for the destination - Item in section 8: The practice of connecting, transmitting maritime information should be managed by Maritime Administration 3.4 Human resources What shoul be put in priority is keep training and build up human resource that specialize in maritime securityand is enthusiastic with the work It is necessary to provide deep training/education on administration and implementation of maritime security The trained/educated resources are then capable of drafting and exercising security plans effectively The ship crew also need training in order to raise their awareness of ship security, the meaning and how to follow security levels, how to detect weapon, dangerous devices or materials, how to recognize behaviours of a subject that may threat the shipsecurity Apart from awareness, those saefarers also need being equiped with essential knowledge and skill to use security deviced available on board the vessel The shipsecurity officer needs to guarantee those security devices are properly operated, checked regularly, and suit with the vessel Vu Phuong Thao – GMA0301 Page 38 RecommendationstoenhanceshipandportfacilitysecurityunderISPScodeinQuangNinhportarea CONCLUSION After finishing the dissertation with the topic “Recommendations toenhanceshipandportfacilitysecurity at port of QuangNinh from 2014 to 2015”, I have accomplished the following points: - Understanding and building up theoretical background of shipandportfacilitysecurity - Collecting data and evaluating the maritime status at port of QuangNinh - Giving some recommendationstoenhance the security of ships andport facilities at port of QuangNinh According to the data and analysis in the dissertation, the maritime security for the time being inQuangNinh is relatively stable even though there have been some reported cases, principally pilferage that did not cause serious damages to human or to the development of maritime economics of this province Nonetheless, it does mean that these incidents can be neglected Furthermore, these crimes are causing a bad image of the portinQuang Ninh, which specially leads to negative impact on commercial activities The reputation of the terminals as well as QuangNinh province can be worsened gradually In addition to the point above, when researching about maritime security management inQuang Ninh, I realized that plans shipsecurityandportfacilitysecurity are approved by two different authority organizations Moreover, the Maritime Administration of QuangNinh mainly pays attention to supervising the implementation of portfacilitysecurity plan and just check the shipsecurity carrying out when the Administration of QuangNinh authority requests The involvement of different parties in the procedure of supervising security plan implementation has triggers many obstacles, particularly in information transferring between the ship, portand the authority in charge This has prevented the security incidents from being solved effectively so far It is very necessary to achieve a consistency of security assessment, security plan and supervision The dissertation has reported key points of maritime security at port of QuangNinh from 2010 to 2014 The recommendations are principally based on the subjective opinion of the author, practical issues and analysis of advantages and disadvantages when applying the ISPScodeinto the local situation inQuangNinh I truly hope Vu Phuong Thao – GMA0301 Page 39
