WORLD TRADE G/SG/N/1/EEC/1/Suppl.2 November 2004 ORGANIZATION (04-4622) Committee on Safeguards Original: English NOTIFICATION OF LAWS, REGULATIONS AND ADMINISTRATIVE PROCEDURES RELATING TO SAFEGUARD MEASURES EUROPEAN COMMUNITIES Supplement The following communication, dated 28 October 2004, is being circulated at the request of the Delegation of the European Commission _ Pursuant to Article 12.6 of the WTO Agreement on Safeguards, please find attached a notification on information received from the new Member States concerning their safeguard legislation G/SG/N/1/EEC/1/Suppl.2 Page NOTIFICATION OF LAWS AND REGULATIONS UNDER ARTICLE 12.6 OF THE AGREEMENT ON SAFEGUARDS Since May 2004, Council Regulation (EC) No 3285/94, on the common rules on imports, applies to the 10 new EC Member States (Cyprus, Czech Republic, Estonia, Hungary, Latvia, Lithuania, Malta, Poland, Slovak Republic, Slovenia) As regards national legislation previously in force in this area, the following information was made available by the new EC Members: CYPRUS Concerning the Notification under Article 12.6 of the WTO Agreement on Safeguards please note that Cyprus did not have such legislation CZECH REPUBLIC After the accession of the Czech Republic to the EU, its national safeguards legislation, i.e Act No 62/2000 Coll., on some measures in the Export or Import of Products and on the Licensing procedures, expired At present, the proposal of the law that will formally repeal the Czech safeguards legislation is going through the governmental and parliamentarian legislative procedure ESTONIA With reference to Article 12.6 of the Agreement on Safeguards, the Republic of Estonia notified in the document G/SG/N/1/EST/2, dated January 2001, the national legislation of the Republic of Estonia relevant to safeguard measures The Rural Development and Agricultural Market Regulation Act, passed on 11 October 2000, contained in Chapter regulations regarding safeguard measures in the agricultural market The above-mentioned Act entered into force on January 2001, after being published in Riigi Teataja (State Gazette) I, 2000, 82, 526 On 21 April 2004 a new Rural Development and Agricultural Market Regulation Act was passed and entered into force on May 2004, after being published in Riigi Teataja (State Gazette) RK, RTI, 28.04.2004, 32, 227 The new Act abolished the previous Rural Development and Agricultural Market Regulation Act in force and does not contain any regulations regarding safeguard measures HUNGARY With reference to Article 12.6 of the Agreement on Safeguards, Hungary informs the Committee on Safeguards that its national legislation on safeguard measures has been repealed by Government Decree No 105/2004 (IV.27.) LATVIA With reference to Article 12.6 of the Agreement on Safeguards, Latvia notifies that its safeguards legislation (The Law “On Safeguards”, notified under G/SG/N/1/LVA/1, G/SG/N/1/LVA/1/Suppl.2, G/SG/N/1/LVA/1/Suppl.2/Corr.1; and The Regulation “Procedures for the Implementation of Measures for Safeguarding the Domestic Market” notified under G/SG/N/1/LVA/1/Suppl.3) has been abolished as of May 2004, following Latvia’s accession to the European Union G/SG/N/1/EEC/1/Suppl.2 Page LITHUANIA With reference to Article 12.6 of the Agreement on Safeguards, Lithuania hereby notifies that the Law Amending the Law on Safeguard Measures of the Republic of Lithuania No IX-626 (the new wording of the Law on Safeguards), adopted by the Parliament of the Republic of Lithuania on December 2001 (see Notification G/SG/N/1/LTU/1 on 12 February 2002 and Notification G/SG/N/1/LTU/2 on 12 March 2002) was repealed by the Law on Repeal of the Law on Customs Tariffs, the Law on Antidumping, the Law on Safeguard Measures and the Law on Countervailing Duties, and the Legislation Amending Thereof, No IX-2146, adopted by the Parliament of the Republic of Lithuania on 20 April 2004 This piece of legislation is published in the "Valstybės žinios" (Official Gazette) No 63-2248 and came into force on May 2004 MALTA In document G/SG/N/1/MLT/1, Malta notified that it does not have any laws and regulations on safeguard measures POLAND Pursuant to Article 12.6 of the Agreement on Safeguards, Poland hereby notifies that its safeguards legislation - the Law of 11 April 2001 on safeguards against excessive imports of products into the Polish customs territory, notification of which was made on 22 January 2002, was repealed by the Law of 20 April 2004, Official Journal of Poland, No.96, item 959, except for the regulations concerning pending cases in the administrative court with regard to past complaints SLOVAK REPUBLIC Pursuant to Article 12.6 of the Agreement on Safeguards, the Slovak Republic hereby notifies that the pre-accession safeguard legislation (Act No 214 of July 1997 on safeguard measures against imports) has not been repealed yet However, the pre-accession legislation is no longer applicable The secondary EU legislation (basic safeguard Regulation of the Council No 3285/1994 of 22 December 1994 and Regulation of the Council No 519/1994 of March 1994) has been applicable since accession of the Slovak Republic to the European Union The repeal of the preaccession legislation is being in the legislative process of the Slovak Republic and it is expected to be finished by the end of 2004 SLOVENIA Pursuant to Article 12.6 of the Agreement on Safeguards, the Republic of Slovenia notified the Decree on Safeguards measures on 10 January 2001 (G/SG/N/1/SVN/2) This decree was repealed by Decree on termination of decree on Safeguards measures which was published in Official Gazette of the Republic of Slovenia No 45/2004 on 29 April 2004 ...
