Safety and health are very important element of the project - The contrctor will continuosly implement safety measures regarding the public and alll personnel associated with the works - The contractor will perform the work in full compliance with all safety and industrial health legislation and regulations of the Socialist Republic of Vietnam - The Contractor believes that safety is a ine responsibility and expects individual employees to be responsible for his own safety and health and the protection of his fellow employees as well as the environment - The Contractor believes that all accidents are proventable and no undertaking is so important that would endanger the life of a person Regarding preventive measures, the Contractor will provide the proper safety devices such as safety handrails, safety nets, barricades, warning signs, watchman etc - The Contractor will also display safety and industry health posters to raise the awareness of workers - The Contractor will maintanin the existing pedestrian routes in a safe condition or provide alternative routes with the intension of seuring safety of the local population - The Contrctor believes that time and effort shall be spent for the advancement of any operations and undertakings - The Contractor will provide fully cooperate and assist in safety surveillance which will be carried out by the Engineer or the Employer 1.1.2 Statutory regulations and clauses that the Contractor will apply: - Health protection law for people issued in - Labour law of the Socialist Republic of VietNam approved by the Committee of the National Assembly date 22/06/1994 and coming into force on 01/04/1995 - Fire prevention and fighting law issued in 2000 - Circular of the Ministry of Science, Technology and Environment No.490/1998/TT-BKHCNMT dated 29/04/1998, directing to make and assess a report, analyzing environmental effects of investment projects - Decision No 08/2001/QĐ-TTg approved by prime Minister about Management of productive forests, protected forest and particular forests dated 11/02/2001 Besides the Government regulations, the Contractor will date the EMSTCP and apply other regulations, local regulations, local customs and other instructions from Government Agencies, including: - The use of cement from the dredging of off-shore coral reef resources is prohibited and shall not be used in the project; - Although there are no known instances of unexploded ordnance (UXO) within the proposed work Sites, the possibilities of UXO can not be excluded The Contractor shall, therefore, undertake consultations, historical reviews and surveys as warranted in regard to potential UXO issues as determined necessary in consultation with the Supervising Engineer - Before a contractor can begin work, the contractor shall submit to PMU-18 ESU approval from the relevant Provincial Department of Science, Technology and the Environment (PDOSTE) that all borrow materials from river floodplains have been subject to environmental studies approved by MONRE or the relevant PDOSTE - Contractor shall restore areas sitting temporary asphalt plants to their original condition on completion of Project works This shall include the clean-up of spillage and debris before leaving temporary construction sites In addition to the above, when there are any requirements from the Engineer for project safety, these will be met by the contractor 1.2 Contractor Management 1.2.1 Updating information: VINACONEX ENGINEERING CONSTRUCTION AND INVESTMENT JOINT STOCK COMPANY (VINACONEX E&C., JSC) Address: Vinaconex Building - Trung Hoa Nhan Chinh New Urban Area - Nhan Chinh Ward - Thanh Xuan District - Hanoi Capital - Vietnam Telephone: (84-4) 2249305/06/07/08 Fax: (84-4) 2249309 VINACONEX E&C Regulations and documents relating to industrial health will always be observed, updated and made known to all site staff The approved environmental management, safety and traffic control plan will be furnished to subcontractors to be considered as safety and environment protection documents The subcontractors are requested to conform to these plans 1.2.2 Management: Sub-contractors are requested to assign a safety representative, who will be on site at all time during the subcontractor’s execution of the works The contractor will organize safety and environmental training programs for all site staff - Trung Hoa Nhan Chinh New Urban Area - Nhan Chinh Ward - Thanh Xuan District - Hanoi Capital - Vietnam Telephone: (84-4) 2249305/06/07/08 Fax: (84-4) 2249309 VINACONEX E&C ITEM3.0.COMMUNICATE INFORMATION AND REPORTING COMMUNICATE INFORMATION AND REPORTING 3.1 Communicate information: At site, the Contractor will place signs and slogans regarding safety, industrial health and environmental regulations In the office, living quantities, dinning room for the construction team, regulations, slogans about safety and environmental matters will be posted 3.2 Environmental and Safety Reports: The following environmental and safety reports shall be submitted: Initial Environmental baseline report: Report of environmental baseline data included: air quality baseline, water-sediment quality baseline, noise baseline,… Weekly environmental and safety reports: documented safety and environmental audits shall be undertaken on weekly basis Environmental and safety reports summarizing the results of the audits shall be submitted on a monthly basis Monthly report: Summaries of the weekly environmental and safety reports will be included in the Project’s monthly progess report 3.3 Notification of accidents The engineer will be notified immediately of any accidents which occur whether on-site or off-site in which the Contractor, his personnel or construction plant, or those of any subcontractors are directly or indirectly involved and which result in any injuries to any persons Such initial notification may be verbal and shall be followed by a written comprehensive report within 24 hours of the accident 3.4 Communication with sub-contractors All site offices are fully equipped with fax machines, telephones, and there is always someone on duty during office hours If the guard, or the duty and environment inspector are not present when an accident occurs, the site engineer or fore man will phone head offic e for information and guidance The environment & safety staff for the construction teams will report daily about environment/safety at site to the environment & safety officer VINACONEX ENGINEERING CONSTRUCTION AND INVESTMENT JOINT STOCK COMPANY (VINACONEX E&C., JSC) Address: Vinaconex Building - Trung Hoa Nhan Chinh New Urban Area - Nhan Chinh Ward - Thanh Xuan District - Hanoi Capital - Vietnam Telephone: (84-4) 2249305/06/07/08 Fax: (84-4) 2249309 VINACONEX E&C ITEM 4.0.ENVIRONMENTAL MANAGEMENT PLAN 4.1 GENERAL The Contractor will be responsible for the remedy or mitigation measure(s) to counter adverse environment-related effects for construction or construction-related activities, In case of an environmental problem, the Contractor will immediately notify the Engineer who will instruct the Contractor as to the next course of action to be taken Situations which may require such steps, are complaints or legal actions by third parties on matters such as environmental damage to property and people In order to avoid adverse impacts, the following shall ahead to: - The contractor will conform to the Socialist Republic of Vietnam’s Laws on Protection of Environment (NLEP) as well as and other relevant legislation; - No debris will be deposited on public or private right of way as a result of its operations, or arising from the movement of Construction Plant or vehicles - All existing stream courses and drains within, and adjacent to, the Site will be kept safe and free from any debris and any excavated materials arising from the works Chemicals will be prevented from going to the watercourses And washing of concrete agitators will not be allowed on existing watercourses - All water and waste products arising on the Site will be collected, removed from the Site via a suitable and properly designed temporary drainage system and disposed at a location, and not in a manner that will cause neither pollution nor nuisance - In the event of any spoil or debris from construction works being deposited on adjacent land or any silt washed down to any area, then all such spoil, debris or material and silt will be immediately removed and the affected land and areas will be restored to their natural condition 4.2 ENVIRONMENTAL OBSERVATION AND MONITORING PLAN 4.2.1 Standards and Required Equpment 1/ Equipment: - Water monitoring equipment : Multi-parameter measuring machine TOA or HACH, assesing lab by standard solution - Noise monitoring equipment: Integrated Sound Level Meter macine-model RION, NL-21 The equipments are checked according to the producer’s instruction at 90 dBA before measuring - Air quality monitoring equipments: The equipments are checked according to the producer’s at 90 dBA before measuring Lab-checked before and after going to the location 2/ Applied standards: VINACONEX ENGINEERING CONSTRUCTION AND INVESTMENT JOINT STOCK COMPANY (VINACONEX E&C., JSC) Address: Vinaconex Building - For air quality monitoring - TCVN 5937 – 1995 - TCVN 5067 – 1995 3/ Human force: Water monitoring: 02 environmental engineers/site Noise and dust monitoring” 02 environmental engineers/site Lab data processing: 03 technicians Report writing: 02-03 researchers 4.3 OTHER ENVIRONMENTAL PROVISIONS 4.4.1 Air quality Major items that may affect the air during construction are the following with their respective countermeasures; Heavy equipments Proper maintenance and checked up of every equipments that will emit gases thru the air will be implemented Air emission levels from Vietnamese standards will be followed The road base materials During dry seasons, road bases will become dry and dusts will probably mix into the air by the wind To minimize these cases, appropriate watering will be performed on affected areas VINACONEX ENGINEERING CONSTRUCTION AND INVESTMENT JOINT STOCK COMPANY (VINACONEX E&C., JSC) Address: Vinaconex Building - Trung Hoa Nhan Chinh New Urban Area - Nhan Chinh Ward - Thanh Xuan District - Hanoi Capital - Vietnam Telephone: (84-4) 2249305/06/07/08 Fax: (84-4) 2249309 VINACONEX E&C Materials on site Dusts from the cement silo, aggregates bin, and access roads will be controlled to avoid air pollution, cement and bentonite must be covered during windy weather To prevent dusts from aggregates and access roads, the following practice should be followed - The access road will be wet by water during dry and windy season - The aggregates bin and yard will be wet during dry and windy seasons But it should be coordinated with the quality control group for their mixed design adjustments 4.4.2 Water quality Water pollution control within the sites will be implemented The basic plan will be the following; - Provision of toilets on site Mobile Toilets will be provided on site for proper sanitation control Workers will be educated about environmental matters which will be implemented - Prevention of lubricants and fuels on the site coming from heavy equipments - A water monitoring system will be provided if necessary - Pollutants will not be discharged into watercourses - Control of site 4.4.3 Unexploded Ordnance (UXO): Prior to the commencement of construction, mine sweeping shall be carried out surrounding the construction Site and confirmed for safety by the Defense Agency specializing in disarming of explosive ordnance 4.4.4 Biodiversity Compensation: - No vegetation of any type shall be removed from lands outside the construction limits - Fencing shall be erected at the edge of all construction sites, storage areas etc, to avoid unnecessary off-site damage to vegetation, trees and the landscape in general - Construction personnel, equipment and vehicles shall be confined to the work areas as defined by site fences/hoardings erected at the boundary of the works - All trees within the works boundaries shall be preserved if they are outside the permanent works areas and not interfac with construction or operation of the project - Nhan Chinh Ward - Thanh Xuan District - Hanoi Capital - Vietnam Telephone: (84-4) 2249305/06/07/08 Fax: (84-4) 2249309 VINACONEX E&C - Trees will be replaced at a ratio of one to one 4.4.5 Noise and Vibration: The type of construction that will be used is equpment oriented hence the following measures are recommended to minimize plollution from this type of construction Large machines (for breaking concrete, drilling concrete etc) shalll only be operated during day time - Scheduling of “too much noise activity” such as demolition of concrete structures, during daytime - Equipments with uncommon noise will be dealt properly by proper checked up and maintenance - Noise monitoring system will be provided if necessary - noise barriers at schools and hospitals 4.4.6 Waste Construction waste will be controlled to the utmost to prevent from going through the existing urban area and long time storage of unsuitable materials within a dense populated area The following are measures on how to properly control the discharge of expected construction wastes; - For Unsuitable materials Prior to start of work, disposal area for unsuitable soil, sands and the likes will be proposed to the Engineer for approval Criteria for the selection of disposal area will include consideration of the area’s ecosystem As much as possible, these materials will be transported by barge And small quantities will be transported by dump trucks; in this case the dump truck will be sealed to minimize spills during transportation A washing area will be installed on site to clean the tires of every truck that will be sent to dispose these materials - For construction materials waste Waste will be collected and stored at one location on site When a truck form Sanitary Company arrives at site the Environmental Manager will assign some one to deliver wastes to that truck which will be sent to an approved disposal area - For other waste such as food scraps, etc Plastic garbage bags will be used and they will be placed daily at designated collection area by the garbage collectors 4.4.7 Dangerous materials With the advancement of science and technologies, a lot of materials have been introduced in the construction works Some of these materials will become dangerous if improperly handled or used The following are steps to be taken which will help to minimize the effect of these materials; 10 VINACONEX ENGINEERING CONSTRUCTION AND INVESTMENT JOINT STOCK COMPANY (VINACONEX E&C., JSC) Address: Vinaconex Building - Trung Hoa Nhan Chinh New Urban Area - Nhan Chinh Ward - Thanh Xuan District - Hanoi Capital - Vietnam Telephone: (84-4) 2249305/06/07/08 Fax: (84-4) 2249309 VINACONEX E&C SAFETY PLAN 1.1 ORGANIZATION CHART Project Manager Safety Officer Safety Supervisor Flagmen Security Guards The Safety Department headed by the Safety Officer with the assistance of the Safety Supervisors To maintain interactive communication between construction personnel and safety staff, a safety meeting will be arranged once a month Site safety report will be submitted and examined during the meeting Safety records will be prepared and maintained by the Safety Officer 1.2 TASKS FOR EACH ORGANIZATION AND PERSONNEL Obligations and duties of each personnel in Safety Organization will be follows Project Manager Project Manager will take overall responsibility for establishing safety policy and program to be observed by each individual employed in the life of this contract Project Manager will coordinates with Safety Officer for the development of safety system to be applied to each phase of construction Safety Officer 14 VINACONEX ENGINEERING CONSTRUCTION AND INVESTMENT JOINT STOCK COMPANY (VINACONEX E&C., JSC) Address: Vinaconex Building - Trung Hoa Nhan Chinh New Urban Area - Nhan Chinh Ward - Thanh Xuan District - Hanoi Capital - Vietnam Telephone: (84-4) 2249305/06/07/08 Fax: (84-4) 2249309 VINACONEX E&C Safety & Security Officer of Project Management Board (PMB) should facilitate the company’s safety and security program His primary obligation is to protect the interest of the company through an efficient safety program, health working environment and customer’s satisfaction Safety Supervisor Safety Supervisors will assist the safety officer in all manners to conduct the safety system Safety Supervisors are required to check daily safety compliance of the workers with the company safety rules and regulations They should strictly enforce the company safety policy They are required to submit safety observation and other report pertaining problems on safety and security in the job site Safety watchmen will remarkablly contribute record and performance of the Contractor during the construction of the Project Security Guard Security guards have reponsibilities and duties to protect company resources both human and property from danger, pilferage and damages They are task to enforce the company safety & security policy It is the policy of company to impose sanctions against and erring security guards Offenses such as sleeping, drunkenness in work time, assisting un-authorize entry of un-authorize personnel in station/post, connivance with thieves, burglary will be penalized according to the degree of crime committed COMPLIANCE WITH LEGISLATION The Contractor shall comply with all safety and industrial health legislation including, but not limited to, the Rules and Regulation of the Socialist Republic of Vietnam and the authorities having jurisdiction SAFETY OF THE PUBLIC The Contractor will be responsible for the safety of the public legitimately passing through the site All excavations, plant or items of potential danger to the public must be barricaded and sign-posted to the satisfaction of the Engineer and the Contractor shall provide sufficient watchmen to ensure the safety of the public at all times All existing pedestrian routes shall be maintained in safe condition unless an alternative route is provided to the satisfaction of the Engineer AVAILABILITY OF SITE-RELATED DOCUMENTS The contractor shall comply with the Engineer’s requirements insofar as displaying in each of its site offices, workshops and canteens a copy of such safety and industry health posters and keeping on the Site copies of safety and industrial health regulations and documents 15 VINACONEX ENGINEERING CONSTRUCTION AND INVESTMENT JOINT STOCK COMPANY (VINACONEX E&C., JSC) Address: Vinaconex Building - General Items - Work Plan - Things the Foreman should - Group meeting before starting to work - Worker’s Clothing - Electrical Safety - Enclose Space Entry - Emergency/ Evacuation Procedure - Fall Protection - Illumination / Lighting - Signage 1/ General Items a Site Rules and Regulations SITE REGULATIONS Clause 1: Only people who are working at site shall be allowed to go in work areas Clause 2: While working at site staff shall be equipped with safety equipment such as identification cards, protective clothes, choes and safety helmet Clause 3: Before taking valuable euipment and materials to the site, they shall be registered at the guard house and checked before transporting to te site Clause 4: 16 VINACONEX ENGINEERING CONSTRUCTION AND INVESTMENT JOINT STOCK COMPANY (VINACONEX E&C., JSC) Address: Vinaconex Building - Trung Hoa Nhan Chinh New Urban Area - Nhan Chinh Ward - Thanh Xuan District - Hanoi Capital - Vietnam Telephone: (84-4) 2249305/06/07/08 Fax: (84-4) 2249309 VINACONEX E&C Ensuring regulations of working time Sevurity guard shall be notified if staff are requested to work over time If work men are required to stay at site, the fore man (contractor) will register at the guard house and give suitable reasons and strictly implement the guard and management regulations Clause 5: Comply with fire and explosive regulations Clause 6: Not allowed to drink alcohol, or have parties at site Clause 7: Strictly forbid illegal actions such as drunkenness, addition, gambling, gighting at the site Clause 8: All working staff and visitors at site have the responsibility to adhere these regulations 17 VINACONEX ENGINEERING CONSTRUCTION AND INVESTMENT JOINT STOCK COMPANY (VINACONEX E&C., JSC) Address: Vinaconex Building - Trung Hoa Nhan Chinh New Urban Area - Nhan Chinh Ward - Thanh Xuan District - Hanoi Capital - Vietnam Telephone: (84-4) 2249305/06/07/08 Fax: (84-4) 2249309 VINACONEX E&C REGULATIONS PERTAINING TO FIRE PREVENTION AND FIRE FIGHTING Clause 1: Preventing and fighting fires is every one’s duty Clause 2: Everyone should be aware of fire prevention, Regulations and Equipment for fighting fire should be at hand when necessary Clause 3: Being careful when using fire, heat sources, chemical and explosives, poisons, and radio active and material Abiding with all regulations Clause 4: Electric lines will not be strung randomly, Electric equipments will be checked before beginning works materials will not be stored near light bulbs or electric wires Clause 5: Materials and equipments should be arranged tidily and kept a safe distance apart Workers shall guard against fires and fight fires if necessary It is forbidden to use keys or steel objects to open petrol covers Clause 6: It is forbidden to start engines in areas which contain inflammable materials while dispatching and receiving materials, goods, and vehicles should be parked so that they are facing of the site Clause 7: Objects should not block emergency exits Clause 8: Any groups or personal who engage in fire fighting will be rewarded If any one does not adhere with the above regulation, they will receive administrative penalties 18 VINACONEX ENGINEERING CONSTRUCTION AND INVESTMENT JOINT STOCK COMPANY (VINACONEX E&C., JSC) Address: Vinaconex Building - Safety Helmet - Safety Belt - Shirt - Long Pants - Shoes Site workers shall be allowed entry in the construction site unless wearing the proper work attire c Following are serious violations and subject to outright suspensions or termination : -  Fighting -  Possession of firearms, deadly weapons and explosives -  Entering work area under the influence of liquor, prohibited drugs and/ or other intoxicating substances -  Others d Traffic -  Maximum speed limit in the construction site is 15 km/h - Emergency Procedure in Confined Space It is recommended that the cleaning crew demonstrate their escape procedures before starting the cleaning operations As a minimum, the safety observer must have an air horn plus a spare charged air cylinder to raise the alarm should compressor failure occur Methods of signaling such as tugging airlines or lifelines can easily be mistaken due to the frequency of false alarms triggered by normal movement The preferred method is of teams working in sight of each other The custodian must satisfy himself that a practicable system of alarming is in operation 9/ Fall Protection a.) Satelite Office with fresh water Sterilizing equipment Medicine box Recovery room with chairs and footrests 11 PLANT AND EQUIPMENT The Contractor will provide proper Safety Devices with all construction plant and equipment, which will be used for the work These Safety Devices will be installed by qualified personnel and inspected regularly In case of deficiency are recognized in any of these, the Contractor will cease the operation and take immediate action to rectify the situations Safety Devices will include but not limited to;
