A patent give the patent owner a monopoly on the terms of the patent, for a certain number of years. The patent owner can prevent other people from manufacturing or selling anything covered in the patent. So, avoid selling anything with an existing patent! 2. Patent Pending “Patent Pending” means that someone has applied for the patent, but it has not been granted yet. Avoid these products, too! You can monitor the patent to see whether or not it gets approved, however, this is likely to be a long wait, and may not be worth your time. 3. When and What to Search Do not start your patent search until AFTER you have your list of hot opportunities. We recommend waiting until you have narrowed your list down to your final three products.
