Để có Nhà nước nhân dân, nhân dân nhân dân dựa tảng liên minh cơng - nơng - trí vững ngày nay, khơng thể khơng kể đến vai trị pháp luật bầu cử, xây dựng, ban hành thực thi năm vừa qua “Tuy nhiên, nước ta đứng trước nhiều thách thức lớn”, “Đòi hỏi bách toàn dân tộc lúc phải tranh thủ hội, vượt qua thách thức, tiếp tục đổi mạnh mẽ, toàn diện đồng bộ”, “Dân chủ xã hội chủ nghĩa vừa mục tiêu vừa động lực công đổi mới” [125-tr.75] Đại hội đại biểu toàn quốc lần thứ X Đảng cộng sản Việt Nam (tháng năm 2006) khẳng định nhiệm vụ trọng tâm nước ta thời kỳ công nghiệp hóa, đại hóa đất nước “Phát huy dân chủ sức mạnh đại đoàn kết dân tộc, hoàn thiện Nhà nước pháp quyền xã hội chủ nghĩa” [125-tr.40] Một phương hướng quan trọng để thực nhiệm vụ chiến lược “Tiếp tục đổi tổ chức hoạt động Quốc hội Hoàn thiện chế bầu cử nhằm nâng cao chất lượng đại biểu Quốc hội…phát huy tốt vai trò đại biểu đoàn đại biểu Quốc hội”[125-tr.126] Định hướng Đảng đổi chế độ bầu cử thể rõ Từ 2001, Đảng rõ cần phải “Nâng cao chất lượng đại biểu Quốc hội, đại biểu Hội đồng nhân dân, hoàn thiện LUAN VAN CHAT LUONG download : add luanvanchat@agmail.com qui định bầu cử, ứng cử, tiêu chuẩn cấu đại biểu Quốc hội Hội đồng nhân dân sở thật phát huy dân chủ”[124-tr.134] Báo cáo Ban Chấp hành Trung ương Đảng khóa IX Cơng tác xây dựng Đảng Đại hội X Đảng (năm 2006) nêu rõ “Ðổi hoàn thiện chế độ bầu cử, thực bầu cử có số dư, mở rộng quyền tiến cử tự ứng cử…giám sát cán sau bầu cử” [125-tr.294] Trong đề tài khoa học mang mã số KHXH 05.05 “Xây dựng Nhà nước pháp quyền xã hội chủ nghĩa Việt Nam lãnh đạo Đảng”, nhóm nghiên cứu, đứng đầu GS.TSKH Đào Trí Úc - Chủ nhiệm đề tài, khẳng định “Trong nội dung dân chủ phải kể đến chế độ bầu cử Lâu nay, bàn đến việc cải tiến chế độ bầu cử, gần yên tâm với chế độ bầu cử hình thành từ trước nhiều năm qua khơng có thay đổi” [111-tr.305, 306] Do đó, để “Phát huy dân chủ, tiếp tục xây dựng hoàn thiện Nhà nước pháp quyền xã hội chủ nghĩa”, “phải đổi từ nhận thức, tư đến hoạt động thực tiễn; từ kinh tế, trị, đối ngoại đến tất lĩnh vực đời sống xã hội”[125-tr.70], “cần đổi thể chế bầu cử: từ qui trình lựa chọn, ứng cử đề cử, hiệp thương lập danh sách ứng cử viên, qui trình tiếp xúc với cử tri chương trình tranh cử ứng cử viên” [99-tr.314] Như vậy, xét sở lý luận sở thực tiễn, định hướng trị Đảng định hướng nghiên cứu khoa học pháp lý khoa học trị, việc đổi nhận thức pháp luật bầu cử hồn tồn phù hợp với mục tiêu trị mục tiêu xây dựng Nhà nước pháp quyền xã hội chủ nghĩa nhân dân, nhân dân nhân dân cần thiết giai đoạn Vì vậy, đề tài “Chế độ bầu cử nước ta - vấn đề lý luận thực tiễn” vấn đề có tính cấp thiết phương diện lý luận thực tiễn, hướng nghiên cứu quan trọng khoa học pháp lý, cần nghiên cứu cách nước ta Tổng quan tình hình nghiên cứu đề tài Vì bầu cử gắn liền với chế độ dân chủ đại diện, nên vai trị đề cao dân chủ đương đại LUAN VAN CHAT LUONG download : add luanvanchat@agmail.com Các học giả tư sản nghiên cứu bầu cử cơng phu đa dạng Có nhiều tác giả cơng trình đề cập bầu cử, như: Giáo sư Guy S Goodwin-Gill với sách “Free and Fair Elections-New Expanded Edition” (2006), Liên minh Nghị viện giới xuất bản, tài trợ International IDEA (International Institute for Democracy and Electoral Assistance) Trên cở văn kiện quốc tế, Tuyên bố tiêu chuẩn cho bầu cử tự công (The Declaration on Criteria for Free and Fair Elections ) Liên minh Nghị viện giới thông qua phiên họp lần thứ 154 vào ngày 26/3/1994 Paris, cơng trình đề cập tương đối toàn diện bầu cử tự cơng bằng, biểu cụ thể dạng quyền, nghĩa vụ ứng cử viên, đảng phái trị, cách thức tổ chức bầu cử, trách nhiệm đảm bảo nhà nước cho bầu cử tự công Các học giả Andrew Reynolds, Ben Reilly and Andrew Ellis With José Antonio Cheibub, Karen Cox, Dong Lisheng, Jørgen Elklit, Michael Gallagher, Allen Hicken, Carlos Huneeus, Eugene Huskey, Stina Larserud, Vijay Patidar, Nigel S Roberts, Richard Vengroff, Jeffrey A Weldon, đồng tác giả chuyên khảo “Electoral System Design: The New International IDEA Handbook”(2005) Đây cơng trình nghiên cứu chun sâu chế độ bầu cử Cuốn sách đề cập hệ thống bầu cử phổ biến giới dựa tiêu chí đơn vị bầu cử; phân tích ưu điểm, hạn chế hệ thống bầu cử Dựa sở đơn vị bầu cử, sách giới thiệu chế độ bầu cử số nước điển hình Tập thể nhà nghiên cứu Mark Anstey, Christopher Bennett, David Bloomfield, K M de Silva, Nomboniso Gasa, Yash Ghai, Peter Harris, Luc Huyse, Rasma Karklins, Michael Lund, Charles Nupen, David M Olson, Anthony J Regan, Ben Reilly, Andrew Reynolds, Carlos Santiso Timothy D Sisk có ấn phẩm “Democracy and Deep-Rooted Conflict: Options for Negotiators”(1998) IDEA xuất Các tác giả cơng trình rõ rằng, việc lựa chọn chế độ bầu cử phù hợp quốc gia có ý nghĩa quan trọng việc giải mang tính gốc rễ xung đột xã hội phương pháp hịa bình Alan Wall, Andrew Ellis, Ayman Ayoub, Carl W Dundas, Joram Rukambe, Sara Staino với cơng trình “Electoral Management Design: The International IDEA Handbook” (2006) đề cập đến cách thức tổ chức bầu cử, nguyên tắc tổ chức, quản lý để bầu cử đảm bảo tính khách quan, trung thực Vai trò chế độ bầu cử việc phát huy dân chủ, xây dựng xã hội đồng thuận, đảm bảo quyền người tác giả Judith với cơng trình “The Third Wave: Democratization in the Late Twentieth Century”(1991) Ấn phẩm “Women and Elections: Guide to Promoting The Participation of Women in Elections”(2005) Liên hợp quốc xuất cẩm nang hướng dẫn việc thúc đẩy, mở rộng tham gia phụ nữ vào bầu cử David Beetham phân tích vai trị Nghị viện - sản phẩm chế độ bầu cử việc thực thi dân chủ thông qua tác phẩm “Parliament and Democracy in The TwentyFirst Century a Guide to Good Practice”(2006)… Thành tựu cơng trình nghiên cứu nêu đáng trân trọng Nhìn chung, chế trị cạnh tranh, vai trị bầu cử đề cao; chí, ví “trái tim dân chủ” [233], [142], [199-tr.II], [204] Tuy nhiên, học giả tư sản thường khẳng định bầu cử dân chủ phải gắn với chế trị đa đảng phái trị: “Khơng có nghi ngờ chút chế độ dân chủ ngày chế độ dân chủ phe đảng hệ thống bầu cử phải tham chiếu tới thể chế trị đa đảng, có vậy, nói bầu cử tự bầu cử cạnh tranh Cơ chế trị đảng phái khơng thể chấp nhận, kể phương diện lý thuyết tính hợp pháp bầu cử” [157], “Sự cạnh tranh trị địi hỏi phải có hai đảng phái cân sức ganh đua Nếu hơn, trường hợp tận quyền dân chủ” [202-tr.3] Trên giới chưa có cơng trình nghiên cứu khẳng định dân chủ bầu cử dân chủ “sở hữu” riêng thể chế trị đa đảng phái trị Do vậy, cách nhìn nhận học giả tư sản bầu cử mang tính phiến diện, chưa thấy tính đặc thù bầu cử dân chủ xã hội chủ nghĩa Ở Việt Nam, liên quan đến bầu cử, có cơng trình nghiên cứu như: TS Đặng Đình Tân (Chủ biên) với sách “Nhân dân giám sát quan dân cử Việt Nam thời kỳ đổi mới” (Nhà xuất Chính trị Quốc gia, Hà Nội -2006) khẳng định bầu cử phương thức quan trọng hữu hiệu thơng qua đó, nhân dân giám sát Quốc hội, Hội đồng nhân dân cấp Dưới góc độ trị học, số kết luận bổ ích thực trạng chế độ bầu cử nước ta thể rõ sách Viện nghiên cứu khoa học pháp lý, Bộ Tư pháp với “Chương trình khoa học cơng nghệ cấp Nhà nước LUAN VAN CHAT LUONG download : add luanvanchat@agmail.com KX.02, Nghiên cứu tư tưởng Hồ Chí Minh Nhà nước pháp luật” (1993) phân tích số khía cạnh tư tưởng Hồ Chí Minh bầu cử, bầu cử có vai trị hợp pháp hóa quyền, phương thức thực quyền tự do, quyền làm chủ người dân PGS.TS Nguyễn Đăng Dung với cơng trình “ Sự hạn chế quyền lực nhà nước” (Nhà xuất Đại học Quốc gia, Hà Nội 2006) rõ rằng, bầu cử phương thức quan trọng để ngăn ngừa độc đoán, chuyên quyền thiết chế quyền lực nhà nước Sách chuyên khảo tập thể tác giả GS.TSKH Đào Trí Úc (Chủ biên) “Xây dựng Nhà nước pháp quyền xã hội chủ nghĩa Việt Nam” (Nhà xuất trị Quốc gia, Hà Nội - 2005) khẳng định vai trò quan trọng chế độ bầu cử việc xây dựng Nhà nước pháp quyền nhân dân, nhân dân nhân dân Nhóm nghiên cứu rõ chế độ bầu cử Việt Nam chưa quan tâm mức; vậy, biện pháp tảng để xây dựng Nhà nước pháp quyền xã hội chủ nghĩa dân, dân dân nước ta thời gian tới cần nghiên cứu, đổi để khắc phục bất cập chế độ bầu cử hành Luận án Tiến sĩ Luật học “Mối quan hệ dân chủ pháp luật” (Hà Nội - 2007) tác giả Đỗ Minh Khơi phân tích vai trị bầu cử khẳng định: chế độ bầu cử phận thiếu vắng dân chủ Các cơng trình nói khơng trực tiếp nghiên cứu chế độ bầu cử, mà đề cập đến biện pháp, hoạt động nhằm thực thi dân chủ góc độ tiếp cận khác Các cơng trình, viết trực tiếp bầu cử phong phú đa dạng: Văn phịng Quốc hội - Vụ Cơng tác đại biểu, với đề tài nghiên cứu “Đại biểu Quốc hội bầu cử đại biểu Quốc hội” (TS Phan Trung Lý - Chủ nhiệm đề tài - 2004) nêu, phân tích số bất cập Luật bầu cử đại biểu Quốc hội thực tiễn tổ chức thực gắn với việc nghiên cứu vai trò đại biểu Quốc hội Đề tài đề xuất số giải pháp khắc phục có ý nghĩa định giai đoạn trước mắt, công tác hiệp thương, đơn vị bầu cử PTS.Vũ Hồng Anh với chuyên khảo “Chế độ bầu cử số nước giới” (Nhà xuất Chính trị Quốc gia, Hà Nội - 1997) giới thiệu khái quát số chế độ bầu cử nước giới Tác giả Vũ Thị Loan với Luận án Thạc sĩ “Hoàn thiện chế độ bầu cử đại biểu Quốc hội nước ta nay” (2003) tiếp cận bầu cử đại biểu Quốc hội góc độ Chính trị học TS Thái Vĩnh Thắng có viết “Một số ý kiến đổi tổ chức hoạt động LUAN VAN CHAT LUONG download : add luanvanchat@agmail.com quan quyền lực nhà nước ta giai đoạn nay” (Tạp chí Nhà nước pháp luật, số (157)/2001) rõ cần mở rộng dân chủ, nâng cao vai trò cử tri bầu cử Trên Tạp chí Nghiên cứu lập pháp, số 6, tháng 7/2001 có viết TS Bùi Xuân Đức “Pháp luật bầu cử: số vấn đề cần hoàn thiện” Bài viết phân tích cụ thể hạn chế chế độ bầu cử hành đưa số giải pháp khắc phục bất cập đơn vị bầu cử, tính đại diện, cách thức xác định kết bầu cử Bài viết “Bầu cử vấn đề dân chủ” (Tạp chí Nghiên cứu lập pháp, số 5/2002) đồng tác giả PGS.TS Nguyễn Đăng Dung Chu Khắc Hoài Dương lý giải mối quan hệ bầu cử dân chủ TS Trương Đắc Linh với viết “Cuộc Tổng tuyển cử năm 1946 - Một mốc son lịch sử thể chế dân chủ Việt Nam” (Tạp chí Khoa học pháp lý, số 1(32)/2006) có giá trị tranh khái quát Tổng tuyển cử ngày 6/1/1946 ý nghĩa việc đổi chế độ bầu cử hành Là người làm công tác thực tiễn gắn với hoạt động bầu cử, TS Bùi Ngọc Thanh có viết “Cuộc bầu cử đại biểu Quốc hội khóa XIINhững vấn đề từ thực tiễn” (Tạp chí Nghiên cứu lập pháp, số 7(103), tháng 7/2007) Với tư cách Tổng Thư ký Hội đồng bầu cử đại biểu Quốc hội khóa XII, tác giả viết tồn tại, góc độ thực tiễn tổ chức thực chế độ bầu cử nước ta đề xuất số biện pháp khắc phục Ngồi ra, Giáo trình Luật Hiến pháp Việt Nam Luật Hiến pháp nước Chương trình đào tạo Cử nhân Luật thường có chương (mục) “Chế độ bầu cử” với mục đích chủ yếu giới thiệu cho sinh viên pháp luật thực định bầu cử Các tác giả thơng qua cơng trình, viết nói đề cập trực tiếp chế độ bầu cử Tuy nhiên, cơng trình, viết thường xem xét vấn đề định chế độ bầu cử, đề cập chế độ bầu cử góc độ định, dừng lại mức độ giới thiệu pháp luật bầu cử cho sinh viên trình độ cử nhân luật Cho đến nay, Việt Nam chưa có cơng trình khoa học pháp lý nghiên cứu toàn diện, bao quát chuyên sâu chế độ bầu cử Vì vậy, Luận án “Chế độ bầu cử nước ta - vấn đề lý luận thực tiễn” cơng trình khoa học nghiên cứu toàn diện sở lý luận thực tiễn chế độ bầu cử góc độ phương pháp nghiên cứu Lý
