Package-1b: Civil (Underground Section from KM 0+615 to KM 2+360) EMPLOYER'S REQUIREMENTS - GENERAL INTRODUCTION These Employer's Requirements are divided into seven sections as follows: (1) General: these apply throughout the Contract (2) Functional: these include the specific requirements for the design, construction, performance and function of the Works (3) Design: these apply in respect of duties relating to the design of the Works (4) Construction: these apply in respect of additional requirements relating to the construction of the Works (5) Manufacturing, Installation and Testing: these apply to the requirements relating to manufacturing, procurement & delivery of plant and equipment and the requirements for testing and commissioning (6) Particular Requirements: these provide general information and particular requirements for Contract Package-1b (7) Appendices: these provide further requirements relating to sections (1) to (6) above DEFINITIONS AND INTERPRETATIONS In addition to the words and expressions defined in the Conditions of Contract, further following words and expressions shall have the meaning assigned to them except where the context otherwise requires: - “As-Built Documents”: means the set of drawings and records, which is submitted during the Construction Phase in accordance with Clause 3(10) of the Employer’s Requirements – Design - "As-Built Drawings": means those drawings produced and endorsed by the Contractor as true records of construction of the Permanent Works The As-Built Drawings are subject to review and issue of a Notice of No Objection by the Employer’s Representative - "Combined Services Drawings" (CSD): means drawings showing the locations, layouts and sizes of all services including those of other contractors co-ordinated so as to eliminate all clashes - "Construction Phase": has the meaning identified in Clause of the Employer's Requirements - General - "Construction Technical Drawings": means those drawings referred to in Clause (2) of the Employer's Requirements – Design - "Construction Gauge": means the profile related to the designed normal co- ERG-2 of 10 October 2012 Ho Chi Minh City Urban Railway Construction Project Employer’s Requirements – General Ben Thanh – Suoi Tien Section (Line 1) Contract Package-1b: Civil (Underground Section from KM 0+615 to KM 2+360) ordinated axis of the track into which no part of any structures or fixed equipment (except for overhead catenary) may penetrate - “Construction Design”: means a set of drawings and documents, which is submitted in accordance with Clause 3(2) of Employer’s Requirements – Design - "Construction Design Pack": comprises the Construction Technical Drawings, Work Specifications, Working Drawings and all other associated documents necessary to supplement the design covered in the Technical Design and to comply with the Contract regarding the construction of the Works such as detailed Method Statement, Safety Risk Assessment etc The contents of the Construction Design Pack are as defined in Employer’s Requirements – Design and further detailed in Appendix 22 - "Design Manual": means the manual to be prepared and submitted by the Contractor as part of the Inception Design and as described in the Employer's Requirements - Design - "Design Segment": has the meaning identified in Clause 2(5) of the Employer's Requirements - Design - "Design Phase": has the meaning identified in Clause of the Employer's Requirements - General - "Employer’s Outline Specification": has the meaning identified in Clause of the Employer's Requirements - General - “Interfacing Contractor”: means the Contractor of an interfacing Contract Package who, in turn, has an interfacing requirement with the Contractor in order to fulfill the Employer’s Requirements of both Contracts in the Project - “Inception Report”: means the set of drawings and documents, which is submitted in accordance with Clause 2(2) of Employer’s Requirements – Design - “Key Date”: means the date by which the Contractor completes a respective Key activity Key Dates are subdivided into two categories: (i) Key Date for the access of the Interfacing Contractor to the Contractor’s Site, (ii) Key Date for Tests on Completion and the Time for Completion Date For all Key Dates, Liquidated Delay Damages will be subjected at the rate given in Appendix to the Letter of Tender for the period of time that the Key Date requirement remains unachieved - "Railway Envelope": means the zone or zones within the Works containing the trackwork and equipment necessary for the operation of the railway - "Services, Electrical, Mechanical Drawings" (SEM): means those drawings produced by the Contractor showing the locations, sizes and details for openings in structural elements for MEP building services and other related Interfacing Contracts - “Service Provider”: means a person or entity approved by Implementing agency ERG-3 of 10 October 2012 Ho Chi Minh City Urban Railway Construction Project Employer’s Requirements – General Ben Thanh – Suoi Tien Section (Line 1) Contract Package-1b: Civil (Underground Section from KM 0+615 to KM 2+360) and national HIV/AIDS authority (i.e Ministry of Health, relevant national government to have responsibility for HIV/AIDS prevention) to provide the HIV Awareness and Prevention Programme - "Technical Design": means a set of drawings and documents, which is submitted in accordance with Clause (4) of the Employer’s Requirements - Design - "Works Specification": means the final Specification used for the construction of the Permanent Works The Works Specification shall be developed by the Contractor based on the Outline Construction Specifications issued by the Employer as the minimum requirement CODES AND STANDARDS (1) The design and construction of the Works shall comply with Ministry of Transportation (MOT) approved codes of practice and standards current at the time of submission of Tender (2) The approved codes and standards for this project are the Japanese Ministerial Ordinance providing the technical standards on railways with commentary enacted by the Japanese Ministry of Land, Infrastructure, Transportation and Tourism (Ministerial Ordinance, MLITT-J), Design Standards for Railway Structures and Commentary issued by Railway Technical Research Institute, Japan (RTRI-J), General Specification for Standard Urban Railway System for Asia (STRASYA) issued by Japan Railway Technical Service (JARTS) and Vietnamese Standards Regulations made and requirements issued by the Vietnamese Government and by relevant utility Authorities shall be followed and specified Besides, all the design and construction standards approved for this Project are listed and explained in Appendix 28 to the Employer’s Requirements The Contractor does not need to get approval from Vietnamese competent organizations for the application of those standards (3) In the event of a conflict between the provisions of the following relevant documents the order of precedence will be: (4) - Employer’s Requirements - Outline Design Specifications and Outline Construction Specifications - Vietnamese and other International Standards referenced herein - Vietnamese and other International Standards Alternative or additional codes, standards and specifications proposed by the Contractor shall be internationally recognized codes and shall be, or be equivalent to (5) The Contractor shall be responsible for getting prior approval from the Ministry of Transportation for any alternative or additional codes of practice and standards EMPLOYER’S DRAWINGS (1) The Employer’s Drawings show the Employer’s Requirements in terms of the ERG-4 of 10 October 2012 Ho Chi Minh City Urban Railway Construction Project Employer’s Requirements – General Ben Thanh – Suoi Tien Section (Line 1) Contract Package-1b: Civil (Underground Section from KM 0+615 to KM 2+360) concept, intent, function, purpose, structural form and architectural appearance of the Permanent Works The intended extent and location of structures and facilities, including passenger facilities, is shown In addition to the functional purpose, provision is made for integration with existing roads, buildings and future developments (2) The Employer’s Drawings is a set of reference drawings Unless otherwise specified in the Employer’s Requirements (Vol.3), Outline Design Specifications (Vol.4) and Outline Construction Specifications (Vol.5), the dimensions of specific elements and details and all other dimensions shown on the Employer’s Drawings are indicative only and shall be determined by the Contractor and, where relevant, coordinated with Interfacing Contractors (3) The horizontal and vertical alignments have been developed and the Right of Way has been defined accordingly Minor changes to vertical alignments will be allowed, to provide clearances to critical structures, on consent from the Employer’s Representative (4) Where the Employer’s Drawings indicate the locations of existing utilities these are for information only and are assumed to be approximate It is the Contractor’s sole responsibility to ensure that the precise nature and location of all existing utilities are ascertained prior to undertaking any related design or construction of the Works (5) The Employer’s Drawings are listed in the Appendix to the Employer’s Requirements EMPLOYER’S OUTLINE SPECIFICATIONS In accordance with the provisions of these Employer's Requirements, the Outline Design and Construction Specifications contained in the Volume and respectively shall be considered as the minimum requirements for the Works The Outline Construction Specifications shall be developed into the Works Specification by the Contractor during the Design Phase and submitted as part of the Technical Design Submission When the Works Specification has received a Notice of No Objection from the Employer’s Representative it shall be used for construction and shall take precedence over other Specifications SPECIFICATIONS IN SI UNITS The Contract shall utilize the SI system of units DESIGN AND CONSTRUCTION PHASES (1) The Contractor shall execute the Works in two phases, the Design Phase and the Construction Phase (2) The Design Phase shall start from the Commencement Date and shall include the completion and submission of the Inception Design and the Technical Design The requirements for the Inception Design and Technical Design are stated in Clause of the Employer's Requirements - Design ERG-5 of 10 October 2012 Ho Chi Minh City Urban Railway Construction Project Employer’s Requirements – General Ben Thanh – Suoi Tien Section (Line 1) Contract Package-1b: Civil (Underground Section from KM 0+615 to KM 2+360) (3) The Design Phase shall be considered complete upon the issue of a Notice of No Objection in respect of the last Technical Design Submission which comprehensively and completely forms the Technical Design for the whole of the Works (4) The Contractor shall be responsible for further development of the conceptual layouts of the stations indicated in the Employer’s Drawing and to develop the architectural, electrical and mechanical building services, station environmental control systems and tunnel ventilation, lifts and escalators Surface works will include station access, shafts, staircases and other facilities, including commerical areas and basic services to cater for bookstalls, telephone booths, etc., landscaping, modal-interchanges with road and pedestrian traffic, illumination, water supply, drainage, electric supply etc (5) The responsibility for design, supply, installation testing and commissioning of lifts and escalators, trackway exhaust and tunnel ventilation is that of the Contractor The Contractor shall also provide for passenger time-space facilities and fire safety modes, etc., including the electrical supply and interfacing control for these items in his design The Contractor shall lead the co-ordination with the contractors who have to execute these items Any related civil works, viz.; construction of sub-station rooms and buildings, shafts, cable gallery, earth mats, inter-modal transfer development, etc., shall also be executed by the Contractor for Contract Package -1b (6) The Contractor shall be responsible for establishing the locations, depths, etc of the existing structures, foundations, utilities etc to such accuracy as to enable the design and construction of the Works to proceed duly protecting these and adjacent structures Immediately on discovering and likely conflict with the Works, the Contractor shall inform the Employer’s Representative (7) The Construction Phase for the whole or a part of the Works shall commence immediately upon the issue by the Employer's Representative of a Notice of No Objection in respect of the relevant Technical Design Submission Such Notice may be issued by the Employer’s Representative in respect of a Technical Design Submission covering a major and distinctive part of the Works in accordance with the Design Submission Programme However, construction shall not be commenced until the appropriate Construction Technical Drawings and other documents forming the Construction Design Pack have been endorsed as "Good for Construction" in accordance with the procedures in Employer’s Requirements Design The Construction Phase shall also include the completion and submission of the Construction Design and the As-Built Documents and other handover records as specified The requirements for the Construction Design and As-Built Documents are stated in Clause of the Employer's Requirements - Design ERG-6 of 10 October 2012 Ho Chi Minh City Urban Railway Construction Project Employer’s Requirements – General Ben Thanh – Suoi Tien Section (Line 1) Contract Package-1b: Civil (Underground Section from KM 0+615 to KM 2+360) PLANNING AND PROGRAMME REQUIREMENTS The Contractor shall prepare and submit his Initial and Final Works Programme to the Employer’s Representative for review in accordance with the Contract and as further described in Appendix 15 to the Employer’s Requirements DOCUMENT SUBMISSION AND RESPONSE PROCEDURE (1) The Contractor shall utilize an efficient Project Management Information System to transmit formal project correspondence, documents and information For this purpose, the Contractor shall apply Aconex, a web-based information management system, as required in Appendix 21 to the Employer’s Requirements (2) The Contractor shall transmit all submissions to the Employer’s Representative according to the procedure laid down in Appendix 21 to the Employer’s Requirements 10 QUALITY ASSURANCE REQUIREMENTS The Contractor shall establish and implement a Quality Management System for the design and construction of the Works as described in Appendix 11 to the Employer’s Requirements This Quality Management System shall be applied without prejudice to, or without in any way limiting, any Quality System that the Contractor already maintains 11 ENVIRONMENTAL PROTECTION REQUIREMENTS (1) During the design and construction of the Works the Contractor shall conform to all requirements relating to the environmental protection as detailed in Appendix 12 to the Employer’s Requirements All applicable Vietnamese Environmental Laws and Codes and all current national standards established by the Ministry of Natural Resources and Environment (MONRE), Government of Socialist Republic of Vietnam and other government agencies for control of environmental pollutants such as air, water, noise and visual impacts/aesthetics shall be strictly followed for compliance during the design and construction phases (2) The Contractor shall prepare and submit the Site Environmental Management Plan (SEP) to the Employer’s Representative as a part of the Inception Report submission SEP shall be consistent with the provisions of the Employer’s Outline Environmental Management Plan given in Appendix 13 to the Employer’s Requirements Upon receipt of the Notice of No Objection, the Contractor shall implement his SEP for the duration of the Contract 12 REQUIREMENTS FOR SITE SAFETY PLAN (1) The Contractor shall take all measures necessary to safeguard the health and welfare of the general public, employees and all other persons entitled to be upon the Site and shall ensure that the Works are carried out in a safe and efficient manner (2) The Contractor, his Sub-Contractors and all persons employed by him on the Site ERG-7 of 10 October 2012 Ho Chi Minh City Urban Railway Construction Project Employer’s Requirements – General Ben Thanh – Suoi Tien Section (Line 1) Contract Package-1b: Civil (Underground Section from KM 0+615 to KM 2+360) shall comply in every respect with the provisions of any relevant statutory regulations and/or with the requirements of Vietnamese Law as may be considered applicable to the Works (3) As part of the Inception Report Submission, the Contractor shall prepare and submit to the Employer’s Representative for consent his proposed Site Safety Plan which shall be based on and expanded from his Outline Site Safety Plan submitted with his tender and which shall address the requirements described in Appendix 14 to the Employer’s Requirements 13 SOFTWARE MANAGEMENT AND CONTROL To ensure the quality of software development process, the Contractor shall comply with the requirements of the BS EN ISO 9000-3:1997 “Guidelines for the Application of ISO 9001 to Development, Supply and Maintenance of Software” Where the software is to be supplied by an organization other than the Contractor, the Contractor shall pass on all requirements in their entirety and without modification The Contractor shall, however, remain responsible for the execution of the Works 14 CONTRACTOR’S CO-ORDINATION WITH OTHERS The Contractor’s attention is drawn to the requirement that access to the Site or parts of the Site will, from time to time, have to be shared with interfacing contractors carrying out works on, or in the vicinity of the Site including, without limitation, works relating to: - Contract Package 1a: Civil (Ben Thanh Central Station) - Contract Package 2: Civil (Elevated and Depot); - Contract Package 3: E&M, Rollingstock, Trackwork, Maintenance; Contract Package comprises the following Sub-Systems: Train Control and Signalling and Maintenance Telecommunication and Maintenance Platform Screen Door and Maintenance Facility SCADA and Maintenance Rolling Stock and Maintenance Power Supply System and Maintenance Overhead Contact and Maintenance Trackwork and Maintenance Depot Workshop & Equipment and Maintenance 10 Automatic Fare Collection and Maintenance 11 Signage and Graphics and Maintenance The Contractor shall fully integrate and coordinate the Design and Construction of the Works with all Interfacing Contractors and Interfacing Bodies and Entities and shall ERG-8 of 10 October 2012 Ho Chi Minh City Urban Railway Construction Project
