INTRODUCTION

1 Rationale of the topic

Public property is an endogenous resource of the country, making an important contribution to the production process as well

as social management It provides financial resources for investment, development, and serves the industrialization and modernization of the country All public property is owned by the state, which assigns the direct management and use of the property

to agencies and units of the state apparatus Public property in Vietnam covers several categories, holds great value, and has been formed and accumulated over many stages It serves as the facility for state management, provides public services, ensures national defense and security, social security, and is an essential resource for socio-economic development and the restructuring of the state budget

Despite achieving slightly positive and comprehensive results in managing public property at higher education institutions (HEIs) under the Ministry of Finance, there are still some shortcomings and limitations These include the maximum efficiency of public property not being fully exploited, equipment

in some types of public property not meeting standards and norms, and the process of organizing equipment and supplies being slow and unable to meet the requirements of schools' training, teaching, and scientific research Additionally, there are instances where equipment exceeds the norm due to the need to rearrange the apparatus of HEIs under the Ministry of Finance The management of public property rental at these institutions also has many shortcomings, including a lack of synchronized guidance from state management agencies and the Ministry of Finance

From practical management experience, the author chose

to carry out the topic “Public Property Management at Higher

Education Institutions under the Ministry of Finance” as a

research topic for the Doctoral Thesis

2 Overview of researches relevant to the thesis topic

A number of previously published domestic and foreign studies directly related to the thesis topic have been selected for

comprehensive assessment of the outcomes of these related studies Furthermore, the author inherits their results and highlights gaps in research, as well as research orientations pertinent to the thesis topic

3 Research objectives and tasks of the thesis topic

3.1 Research objectives

The thesis aims to systematize the theory of public property and its management specifically tailored for Public Higher Education Institutions (PHEIs), while considering the life cycle of asset utilization Through an analysis of the current situation and the scope of the research, this thesis presents viewpoints, orientations, solutions, and recommendations aimed at enhancing public property management at HEIs under the Ministry of Finance, aligning with the ongoing reform process of public finance in Vietnam

3.2 Research tasks

Firstly, to systematize and analyze the theoretical aspects of

public property and its management at PHEIs

Secondly, to synthesize experiences in public property

management at PHEIs from various countries, thereby drawing lessons for enhancing public property management at HEIs under the Ministry of Finance

Thirdly, to synthesize, analyze, and provide examples to clarify

the outcomes, limitations, and causes of the current situation of public property management at HEIs under the Ministry of Finance

Fourthly, to develop viewpoints, orientations, solutions, and

recommendations for improving public property management at

HEIs under the Ministry of Finance

4.1 Subject of the research

Theoretical and practical issues of public property management at PHEIs

4.2 Scope of the thesis

- In terms of content, the thesis focuses on researching public property management within the scope of Higher Education Institutions (HEIs) under the Ministry of Finance

- In terms of scope and timeframe, the research includes four universities under the Ministry of Finance: the Academy of Finance, the University of Finance and Accounting, the University

of Finance and Business Administration, and the University of Finance and Marketing The study examines the current situation during the period of 2018-2022

Firstly, the scientific significance lies in systematizing and

thoroughly clarifying the theoretical and practical foundations of public property management at PHEIs in general, and at HEIs under the Ministry of Finance in particular This is based on the

approach taken by the thesis

Secondly, in terms of practical implications, the objective

is to assess the current situation of public property management at HEIs under the Ministry of Finance This involves evaluating the existing conditions and identifying the causes of limitations Subsequently, solutions are proposed to enhance the efficiency of public property usage management

In addition to the Introduction, List of references, and Appendices, the thesis is structured in 3 chapters:

1.1.1 Public higher education institutions

1.1.1.1 The concept of public higher education institutions

Based on the aforementioned analysis and concepts, according to the viewpoint and research of the postgraduate, Public Higher Education Institutions (PHEIs) are public non-business units (PNBUs) established by the State to provide university and post-graduate education services to the nation They directly or indirectly contribute to the country's socio-economic development PHEIs primarily utilize the State budget as the main resource to invest in facilities, equipment, human resources, and materials to sustain their operations The functions, tasks, organizational structure, management apparatus, services, salaries, and bonus levels of PHEIs all adhere to the principles and regulations issued by competent State agencies

1.1.1.2 Characteristics of public higher education institutions

According to the author, PHEIs have the following characteristics:

Firstly, a PHEI is established and managed by the

government and competent State agencies, with the State acting as

the owner's representative agency

Secondly, the expenses for building and maintaining the

operations of PHEIs primarily come from the State budget

Thirdly, PHEIs operate with the purpose of serving social benefits Fourthly, PHEIs are proactive in educational work

Fifthly, PHEIs have legal status

Lastly, PHEIs are established and come under the

management and control of competent State agencies

1.1.2 Public property at public higher education institutions

1.1.2.1 The concept of public property at public higher education institutions

According to the research and viewpoint of the

postgraduate: Public property at PHEIs constitutes a portion of

the country's public assets, which the State assigns to these units for direct management and utilization in carrying out the task of public higher education training This serves the interests of the State and the people, directly or indirectly contributing to the country's socio-economic development goals PHEIs are responsible for the effective management and utilization of public property, ensuring compliance with legal regulations governing the management and use of such assets

1.1.2.2 Characteristics of public property at public higher education institutions

According to the author, public property at PHEIs possesses the following characteristics:

Firstly, public property at PHEIs is formed from or

originates from the State budget

Secondly, public property at PHEIs is protected by law

Thirdly, the right to use public property at PHEIs is

distinct from ownership rights

Fourthly, public property at PHEIs is abundant, diverse,

and widely distributed throughout the country

Fifthly, the value of public property at PHEIs gradually

decreases during the process of use

Lastly, public property at PHEIs serves as an important

material foundation in ensuring public benefits in education

1.2 PUBLIC PROPERTY MANAGEMENT AT PUBLIC HIGHER EDUCATION INSTITUTIONS

1.2.1 The concept of public property management at public higher education institutions

Based on the viewpoint of management study, from a research and practical perspective, according to the postgraduate, the management of public property at PHEIs is defined as follows:

Management of public property at PHEIs is the general management of activities such as planning, organizing, leading the implementation of plans, controlling, supervising plan implementation and other activities related to the process of forming, using and ending the use of public property, in order to improve efficiency and comply with the provisions of law

implementation of the functions and tasks assigned by the State to PHEIs Activities related to public property management at PHEIs according to the life cycle of property include: the process of

property formation through construction investment and new procurement, the process of using and exploiting property and finally, disposal by liquidation and transfer

Public property formed at PHEIs can result from handover

or transfer, as well as from the construction investment or procurement process Each form of public property formation is subject to corresponding standard conditions and management processes that must be complied with

Managing the process of using public property at PHEIs plays

a crucial role in maximizing the benefits from public resources to provide higher education and scientific research services This management process includes the following components: i) Management of the exploitation and use of public property at PHEIs; ii) Management of wear and tear and depreciation of public property at PHEIs; iii) Management of maintenance and repair of public property

at PHEIs, as well as statistical reporting on public property usage

1.2.4.3 Management of the property ending process

After a certain period of time, the public property that PHEIs have put into use will reach the end of its lifecycle and need

to be replaced by other property (excluding land, infrastructure works, and some other durable constructions) In addition to

property that has been fully depreciated and can no longer be used, there may still be usable property that the PHEI does not need due

to changes in functions or tasks, or because the property was initially invested for short-term purposes At the end of the usage period of public property at PHEIs, it is necessary to evaluate the current situation of the property, both physically and in terms of property value This involves conducting inventory, determining the current value of the property, and developing various disposal plans Management of the end-of-life process of public property at PHEIs entails managing the disposal of the property through various means, such as liquidation, sale, transfer, or transfer to other units

1.3.2 Lessons learned for higher education institutions under the Ministry of Finance of Vietnam

From research on international experience on public property management at HEIs in several countries around the world, the author comes up with six lessons for public property management at subordinate HEIs

2.1 OVERVIEW OF PUBLIC PROPERTY AT HIGHER EDUCATION INSTITUTIONS UNDER THE MINISTRY OF FINANCE

2.1.1 Ministry of Finance and affiliated higher education institutions

The Ministry of Finance is a government agency tasked with implementing state management in finance This includes managing various aspects such as the state budget, public debt, taxes, fees, and other revenues of the state budget, national reserves, state financial funds, financial investments, corporate finance, cooperative finance, and collective economy, as prescribed by law Additionally, the ministry oversees customs, accounting, independent auditing, prices, securities, insurance, and other financial services under its purview It also exercises ownership rights to the state's investment capital in enterprises according to regulations of the law

The HEIs under the Ministry of Finance include:

- Academy of Finance;

- University of Finance - Accounting;

- University of Finance - Business Administration;

- University of Finance - Marketing
