NĂNG - NHIỆM VỤ CỦA BAN QUẢN LÝ RỪNG VÀ CỘNG ĐỒNG THƠN Chức trưởng ban: Có trách nhiệm tổ chức, đạo phụ trách chung, điều hành hoạt động ban, tổ chức họp xây dựng kế hoạch, hỗ trợ cho hoạt động bảo đảm trì thường xuyên liên tục Chức nhiệm vụ phó ban: Có trách nhiệm thay mặt trưởng ban , đơn đốc đạo, trì hoạt động trưởng ban vắng Đồng thời có trách nhiệm với thành viên khác xử lí, giải tình xảy phạm vi quản lý rừng Ban Chức nhiệm vụ kế tốn: Cùng với thành viên xử lí giải cơng việc đồng thời có nhiệm vụ tổng hợp, theo dõi khoản đóng góp, thu –chi giám sát việc sử dụng nguồn vốn quỹ mục đích, quy định ban quản lí.Có trách nhiệm giao dịch với Ngân Hàng chi trả n khoản chi cho hoạt động Ban theo Quy Chế Chức nhiệm vụ thủ quỹ: Tham gia hoạt động thành viên khác Có trách nhiệm quản lý ngân sách cộng đồng Ban Chức nhiệm vụ bảo vệ : Có trách nhiệm với thành viên khác thường xuyên tuần tra bảo vệ rừng, bắt giữ xử lý đối tượng khai thác trái phép phá hoại rừng phạm vi quyền hạn Trong trường hợp vượt q thẩm quyền thơn phải báo cáo cho quyền xã can thiệp Các thành viên Ban quản lý rừng người dân cộng đồng có nghĩa vụ chấp hành nghiêm chỉnh quy định pháp luật bảo vệ rừng điều kiện quy ước quản lý, bảo vệ rừng cộng đồng thôn xây dựng,tham gia đầy đủ họp, đóng góp ý kiến cho việc quản lý, bảo vệ rừng ngày tốt 106 Đồng thời có trách nhiệm chung việc phối hợp quản lý, bảo vệ,khai thác loại hải sản rừng theo quy hoạch bền vững quy ước quy định Phát hiện, cung cấp thông tin, ngăn chặn, bắt giữ xử lý kịp thời người có hành vi xâm hại tới rừng khai thác trái phép hải sản rừng ngập mặn Điều QUY ĐỊNH VỀ KHAI THÁC RỪNG NGẬP MẶN VÀ XỬ LÝ CÁC HÀNH VI VI PHẠM Ngiêm cấm việc khai thác, chặt phá rừng hình thức hành vi vi phạm bị xử phạt Chỉ khai thác chết, củi khô, củi dạt, mắn làm phân xanh, phục vụ việc trồng rừng Khi khai thác phải động ý n chịu giám sát Ban quản lý thôn xã Đối với hành vi chặt tươi lấy củi, đẽo vỏ (Khi khai thác với số lượng từ 10 trở lên) Vi phạm lần 1: Bị phạt 50.000 đ/cây bị cảnh cáo trước thôn Vi phạm lần trở lên: bị phạt 100.000đ/cây bị cảnh cáo toàn xã Bị tịch thu toàn sản phẩm phương tiện, dụng cụ Đối với hải sản thuộc phạm vi rừng ngập mặn Chỉ khai thác hải sản đạt tiêu chuẩn thương phẩm Nghiêm cấm việc sử dụng chất nổ, xung điện, chất độc để khải thác hải sản Vi phạm lần 1: Bị phạt 50.000 đ/lần bị cảnh cáo trước thôn Vi phạm lần trở lên: bị phạt 100.000đ/lần bị cảnh cáo toàn xã báo cáo với UBND xã, để UBND xã định 107 Bị tịch thu toàn sản phẩm phương tiện, dụng cụ Đối với việc chăn thả gia súc: Nghiêm cấm việc chăn thả gia súc khu rừng tái sinh, rừng non trồng Để gia súc phá lần đầu từ 20 trở lên bị phạt 50.000đ/lần cảnh cáo trước thôn Lần bị phạt 100.000đ/ lần Những người có cơng bắt giữ đối tượng vi phạm trích thưởng 50% số tiền phạt đối tượng vi phạm lần Điều NGUỒN QUỸ VÀ CƠ CHẾ QUẢN LÝ TÀI CHÍNH CỦA BAN QUẢN LÝ RỪNG CỘNG ĐỒNG 1, Nguồn quỹ Ban Quản lý rừng cộng đồng từ nguồn sau: Hỗ trợ cấp trên, khoản vay từ lãi suất cho vay vốn Thu từ người dân hàng ngày trực tiếp tham gia khai thác hải sản n rừng ngập mặn Thu 2000đ/người/ngày Thu từ việc xử lý đối tượng vi phạm Thu từ tài trợ tập thể cá nhân ngồi thơn 2, Bộ máy quản lý tài Chủ tài khoản – Trưởng ban đảm nhiệm Kế toán - phụ trách sổ sách, theo dõi thu chi Thủ quỹ - quản lý quỹ 3, Chế độ chi trả cho thành viên Ban Quản lý rừng cộng đồng thôn: − Trưởng ban: 70.000 đ/tháng − Phó ban: 50.000 đ/tháng − Kế tốn: 50.000 đ/tháng 108 − Thủ quỹ: 50.000 đ/tháng − Bảo vệ: 50.000 đ/tháng Điều 7: CHẾ ĐỘ HỌP HÀNH CỦA BAN QUẢN LÝ RỪNG Tuỳ theo tình hình cụ thể mà Ban quy định họp sau: − Họp giao ban định kỳ: lần/tháng − Họp tồn thơn định kỳ: tháng/lần − Họp bất thường: có việc bất thường cần phải tham khảo ý kiến cộng đồng Điều 8: ĐIỀU KHOẢN THI HÀNH Quy chế thông qua họp thôn ngày 28 tháng 11 n năm 2006 với biểu trí 100% Quy chế có hiệu lực từ ngày phê duyệt Mọi người dân thơn thơn, xã lân cận có trách nhiệm tuân thủ theo điều khoản quy chế Thôn Bốn, ngày 28 tháng 11 năm
