MINISTRY OF CONSTRUCTION BUILDING CODE AND STANDARDS OF CONSTRUCTION FOR PEOPLE WITH DISABILITIES CONSTRUCTION PUBLISHING HOUSE Hanoi - 2002 VIETNAM BUILDING CODE QCXDVN 01:2002 BUILDING CODE OF CONSTRUCTION ACCESSIBILITY FOR PEOPLE WITH DISABILITIES (PWD) FOREWORD QCXDVN 01:2002 “Building Code of Construction Accessibility for People With Disabilities” is a legal writing stipulating minimal technical requirements mandatory to be enforced in the construction of buildings. QCXDVN 01:2002 is compiled on the basis of the Ordinance on PWD: Article 26.- “The investment for new construction or reconstruction of dwelling houses, of public amenities and for design, manufacture of domestic furnitures, of transport and communication means . must take into account the needs for convenient use by PWD, firstly of mobility and sight PWD, and at the same time have to comply with construction codes, standards issued by competent state agencies”. QCXDVN 01:2002 is compiled by the Research Institute for Architecture –Ministry of Construction and Panel for elaborating “Building Codes and Standards of Construction Accessibility for People With Disabilities”, submitted by the Department of Science and Technology - Ministry of Construction, has been approved, signed and issued by the said Ministry for enforcement. QCXDVN 01:2002 has been compiled with the cooperation and financial assistance by the President Committee on Employment of People with Disabilities (PCEPD) and the Vietnam Assistance for Handicapped (VNAH). QCXDVN 01:2002 BUILDING CODE OF CONSTRUCTION ACCESSIBILITY FOR PEOPLE WITH DISABILITIES (PWD) Article 1. Scope of application 1.1. This code stipulates requirements to be met in the new construction of works for ensuring the accessibility and use by mobility and sight PWD. Note: People with mobility and sight impairment are called PWD 1.2. In cases of need for reconstruction, upgrade of works with requirements for ensuring accessibility and use by PWD, the stipulations in this Code must be enforced. 1.3. Stipulations in the Code are used for the appraisal, permit granting, approval and takeover of investment and construction projects. Article 2. General requirements 2.1. The following types of building works must ensure accessibility and use by PWD: 2.1.1. Health care buildings: - Hospital; - Orthopedic and functional restoration/ recovery centers; - Disease consultation and treatment units; - Sanatorium centers. 2.1.2. Different levels’ administrative bodies/organs; - Different levels’ executive committees’ offices; - Tribunals, prosecution institutes; - Offices of organizations and bodies for state administration. 2.1.3. Educational buildings: - Primary schools of different levels; - Vocational schools; - Universities - Specialized secondary schools 2.1.4. Gymnastic and sport buildings - Stadiums, sport ground - Sport contest building, premises 2.1.5. Cultural works - Parks, entertainment /leisure places, zoos; - Theaters, cinemas; - Museums, exhibition centers; - Culture palaces, clubs; - Libraries - Tourism areas, heritages, vestiges, picturesque landscapes. 2.1.6. Public service buildings - Hotels, rest houses, boarding houses; - Airports, railway stations, bus stations, passenger harbors; - Restaurants; - Post offices; - Trade centers, supermarkets, markets; - Banks. 2.1.7. Collective houses 2.1.8. Roads and sidewalks 2.2. In detailed planning of open public areas such as municipal squares, parks, tourism areas . it is mandatory to abide by this code. Note: Interior areas in following works, no need for design ensuring accessibility and use by PWD: - Areas for the purpose of security, safety, or of fire prevention/fighting for buildings - Places with restricted space, very narrow walks, intervals between equipment, goods delivery areas, equipment distribution or underground ways. - Areas frequented by equipment maintaining, repairing, controlling agents. 2.3. Permitted solutions are asserted as meeting requirements where houses and buildings are constructed according to this Code and TCXDVN 264:2002 standard – Houses and Buildings – Basic rules for construction accessibility and use by PWD. Article 3. Terminology – Definition. 3.1. In this Code, the sub-mentioned words and terms are interpreted as follows: 3.1.1. Works for ensuring accessibility and use by PWD: are constructional environment created so as PWD could access to and make use of functional space in the said works. 3.1.2. People with disabilities (PWD): are people lacking body part(s) or function(s) under the form of different infirmities reducing their power of action, making it difficult for daily activities, study and labour. 3.1.3. Mobility handicap/disability: state of body being defected, thus reducing the power of motion in normal walking, studying, operating, conducive to partial or total relying on aid by tools/devices or by another person. 3.1.3.1. Defect: the missing, lacking or abnormality in functional-surgical- physiological structure of human body caused by diseases or accidents. 3.1.3.2. Functional reduction/decrease: the partial missing, reduction of function(s) of some body organ caused by defect: multilation, crippling of members engendering difficulties in walking, paralysed hand, blindness. 3.1.4. Wheelchair user: people unable to walk by oneself, having recourse to wheelchair. 3.1.5. People with difficult displacement: people who could move by the aid of crutches, walking sticks (canes) sustained cages. 3.1.6. Building works: The whole or any part, any structure or land area in which there are services rendered or activities implemented. Note: the term “building works” in this code should be understood as comprising public works, houses, routes and sidewalks. 3.1.7. Public entrances: Main entrances for visitors coming in the works 3.1.8. Entrances for service activities: Entrances mainly utilized for delivery of goods or services. 3.1.9. Areas for public activities: Internal or exterior spaces reserved to public activities . 3.1.10. Warning signs that could be identified /recognized: Characteristic signs of a standardized surface put in or placed on superficies of pedestrian’s way or other structures for warning blind people about unexpected hazards on the way. 3.1.11. Slope: Path is sloping when one changes from a height to another. 3.1.12. Sidewalk slope: Portion of slope from the road level to the sidewalk. 3.11.13. Pedestrian way: Way reserved to pedestrians 3.1.14. Mechanized vehicles’ road: Road reserved to mechanized vehicles. 3.1.15. Road crossing way: Part of road reserved to pedestrians across mechanized vehicles’ road. 3.1.16. Lateral slope: Slope perpendicular to walking direction. 3.1.17. Longitudinal slope: Slope parallel to walking direction. 3.1.18. Space for one wheelchair: Clearing space for one wheelchair to move. 3.1.19. Space for a cluster of wheelchairs: clearing space for two and more adjoining wheelchairs. Article 4. Requirement for design 4.1. Entrance to buildings 4.1.1. A building or a part of building must have at least an entrance for ensuring accessibility and use by PWD. The entrance to building for PWD must coincide or be in the same way with the common entrance of the building. Where the building has only a unique entrance, it should not cross kitchen, storage, rest room, toilet or similar spaces. Note: 1. Entrance to building comprises the gate and the way to access to buildings. 2. In an apartment, the entrance could pass through kitchen or storage premise. 4.1.2. There must be at least one entrance for PWD at stop spots of public transport, at bus stops and up/down paths, at roads and sidewalks leading to works’ entrance. 4.1.3. In a plot of land, there must be at least an entrance way for PWD accessing to buildings, works, works’ parts. Note: Where in between of works there is only a unique entrance for transport means, that entrance must also ensure accessibility and use by PWD. 4.1.4. As per building with different levels, there must be at least one way accessible to each level, including attics of houses and high rise buildings. 4.1.5. Solutions for design of entrance to buildings are assessed as matching requirements when they are in accordance with standard TCXDVN 264:2002 - Houses and Building works - Basic rules of construction accessibility for PWD. 4.2. Entrance 4.2.1. Buildings or a part of building must have at least an entrance way ensuring accessibility and use by PWD Note: Entrance way for goods reception or for goods and services delivery is not the unique entrance of buildings or a part of buildings. 4.2.2. At bus stops, bus stations, roads and sidewalks, tunnels or passing- over bridges, transport means’ ascending/descending devices, or interior building’s elevators, it is necessary to design accessibility entrance for PWD. 4.2.3. In entrance ways for ensuring accessibility and use by PWD, there must be sign post or indication post as per international convention. Sign post or indication post must be arranged at easily visualized places. Note: Regarding building works where all entrances could ensure accessibility and use by PWD, there is no need for sign post or indication post. 4.2.4. In building works or parts of buildings, at least there must be an entrance/exit way ensuring PWD accessibility to all rooms and spaces of buildings . 4.2.5. For public works and houses with elevators, these elevators must ensure accessibility and use by PWD. Note: For building works without elevators, priority arrangement must be given to rooms and service areas in the ground floor for PWD accessibility and use. 4.2.6. Regarding historical monuments, by preservation requirements, it is unlikely to design access for PWD, so mobile or fixed elevators should be designed and installed. 4.2.7. Requirements for design of entrances, sign posts, lifts or elevators in buildings’ entrances are assessed as adequate when they abide by regulations of the standard TCXDVN 264:2002 - Houses and buildings - Basic rules of accessible design and construction for PWD. 4.3. Car parking grounds and car waiting spots. 4.3.1. In public car parking grounds and in public buildings parking grounds, there must be places for PWD’s vehicle parking - Requirement on number of places for PWD’s vehicle parking is stipulated in table 1. Note: PWD’s vehicle parking comprises places for car, motor bike, bicycle, wheelchair. 4.3.2. Regarding collective residential quarters with public parking ground, there must be at least 2% of parking places for PWD. Table 1: Number of places for PWD’s vehicle parking in a parking ground. Total number of parking places Minimum number (for PWD’ use) Over 5 to 30 1 31 - 60 2 61 - 100 3 Over 100 3+1 for every 100 vehicles Note: Where parking ground comprises no more than five (05) places, there is no need for design PWD’s parking place. 4.3.3. PWD’s vehicle parking place must be arranged near the entrance of buildings. Regarding public parking ground, the place for PWD’s vehicle parking must be arranged near the pedestrian way. Where buildings comprise several entrances and car stopping spots, PWD’s vehicle parking places must be dispersed and arranged near entrances accessible to PWD. Note: Where parking ground comprises different levels, PWD’s parking places must be arranged in the same level with entrances accessible to PWD. 4.3.4. Car waiting spots on down - town traffic lines must ensure accessibility and use by PWD. Note: 1) Car waiting spots are car-stopping places for passengers ascending and descending on down-town traffic lines. 2) Beside regulated car waiting spots on down town traffic lines, at medicinal consultation/treatment units, at least a car waiting spot should be arranged. 4.3.5. The space dimensions of car parking grounds and car waiting spots for PWD are assessed as meeting requirements when they abide by regulations of the standard TCXDVN 264:2002 - Houses and Building - Basic rules of accessible design and construction for PWD. 4.4. Public spaces in buildings 4.4.1. Toilet/bath room 4.4.1.1. In toilet/bathroom of buildings as per regulations of article 2.1, there must be at least one (01) toilet ensuring PWD’s accessibility and use. 4.4.1.2. The ratio of toilet room for PWD is no less than 5% of the total number of toilet rooms. In areas reserved to PWD, there must be sign post according to international convention. Note: 1) It is possible to arrange a common toilet room for male and female PWD regarding reconstructed buildings, or when PWD need helper. 2) In toilet room, it is possible to install at one and the same time washbasin, water closet, shower or bathtub. 4.4.1.3. Public amenities such as health care facilities, office, sport contest hall, stadium, swimming pool, hotel, rest house, boarding house must be designed with bath room for PWD accessibility and use. Bathroom must be arranged in convenient entrance and exit. In bathroom area, there must be sufficient clearance space for wheelchair moving. 4.4.1.4. Solutions for design of toilet and bathroom are assessed as meeting requirements when they abide by regulations of the standard TCXDVN 264:2002 - Houses and Buildings - Basic rules of accessible design and construction for PWD. 4.4.2. Reception place 4.4.2.1. At areas such as waiting place, queuing place for registration or payment procedure, money exchange, entertainment area, sale and purchase, area of public telephone, eating and drinking services or .
