the requirements of Clause 4.11 of the Conditions of Contract, the Contractor will have allowed for everything necessary for the successful delivery of the Project on time and to the quality and standards required by the Contract To achieve this the Contractor undertakes to provide a first class management team experienced in the delivery of projects of similar size and quality including the co-ordination and management of Nominated Subcontractors and Suppliers Pursuant to Sub-clause 6.1 of the Conditions of Subcontract the Contractor is responsible for the co-ordination and management of Nominated Subcontractors and Suppliers including but not limited to the resolution of all interfacing issues and disputes between the parties No claim will be entertained under any circumstances for the nonThe Contractor shall be responsible for the provision of all power, water and other services he may require and shall cooperate with other contractors (if any) and allow their full usage as they may require All claims for Extensions of Time must be submitted to the Engineer no more than twenty-eight (28) days after the commencement of the event leading to such a claim Any Extension of Time claim submitted more than twenty-eight (28) days after the commencement of the event leading to such a claim shall Any action by the Authorises which is aware of and considered causing delay to the Time for Completion by the Contractor, he shall give notice to the Engineer and the Employer in writing The Contractor shall, within his capability, use proper methods to reach the relevant Authorities or the higher level to stop any activity which may cause delay by the Authorities In the event that the Contractor does not promptly give notice in writing or attempt to so, the Employer reserves the right to reject the delay (not considering it as a valid Delay damages for the Works is 0.05% of the Accepted Contract Amount per calendar days up to maximum amount of 10% of the Accepted Contract Amount Within ten (10) days from any request for change from the Engineer, the Contractor shall give notice on variation works The Contractor shall complete the variation works following the instructions to proceed and the Variation valuation will be determined in due course in accordance with Sub-Clause 13.9 of this Contract The contract rates and prices may be used to value any variation works The Employer Engineer shall have the right to determine or interpret the rate(s) to be adopted for any variation works based on the Contract rates and prices In the absence of any rates included in the Contract for such variation works, the Contractor shall submit all information regarding variation works including costs of plant, labour and materials directly associated with the works Percentage of retention is 10% of the Interim Payment Limit of retention money is 5% of the Accepted Contract Amount or 5% of the adjusted Contract Price if the Accepted Contract Amount is adjusted upward or downward by 15% or more due to Variations and Adjustments under Clause 13 of the General Conditions of Contract Minimum amount of Interim Payment Certificates is not applicable 2.15 2.22 QUESTIONS If the Contractor considers himself to be entitled to any extension of the Time for Completion and/or any additional payment, under any Clause of these Conditions or otherwise in connection with the Contract, the Contractor shall give notice to the Engineer, describing the event or circumstance giving rise to the claim The notice shall be given as soon as practicable, and not later than 28 days after the Contractor became aware, or should have become aware, of the event or circumstance If the Contractor fails to give notice of a claim within such period of 28 days, the Time for Completion shall not be extended, the Contractor shall not be entitled to additional payment, and the Employer shall be discharged from all liability in All the term related to Dispute
