The due process provision protects persons from being "deprived of life, liberty, or property, without due process of law" and the provision goes on to give the steps that must be followed to make sure the process is "fundamentally fair." Before photography was invented in 1839, painted portraits, and engravings based on them, were one of the few ways to record likenesses.
