CREW NAME: _CREW CELL # (NOTIFY US OF ANY CHANGES!!) TERMS OF AGREEMENT: The undersigned producer hereby engages the undersigned artist(s) to perform the engagement stated within The artist(s) agrees to so perform the engagement as described within and will include (if applicable) delivery, set-up, operation for event duration, breakdown and removal (equipment to arrive at performance location in “like new” condition) The artist(s) will represent Preferred Systems, Inc./Preferred Entertainment in a professional and showman like manner Artist’s shall have a well-groomed appearance and be neatly dressed in attire appropriate for the occasion The artist(s) shall only distribute materials approved by and containing contact information for Preferred Systems, Inc./Preferred Entertainment The artist(s) will not distribute any information that would permit inquiries of purchaser concerning future engagements or referrals from this engagement to contact performer directly Artist(s) will for a period of no less than 24 months direct any such inquiries to be negotiated through Preferred Systems, Inc./Preferred Entertainment The artist(s) is an independent contractor and assumes all responsibility for withholding Social Security, state, and other taxes; public liability; and worker’s compensation insurance; and also insurance coverage to and from and on engagement for accident or injury to himself and or his equipment Proof of insurance, and Preferred Systems, Inc./Preferred Entertainment included as additional insured yearly or at the request of Preferred Systems, Inc./Preferred Entertainment Proof of insurance and additional insured certificates shall be provided to clients at clients request The artist(s) assumes responsibility for any liabilities arising out of his failure to perform this engagement as outlined If client seeks fee reduction due to non-compliance, reduction will be deducted from fees due to artist(s) The artist(s) authorizes the Preferred Entertainment Agency or representatives thereof to sign in his/her behalf any contractual agreements necessary for the performance of this engagement as outlined herein Such an agreement to be binding on both parties and not subject to cancellation except by mutual agreement or acts of God, proven detention by sickness, accident to means of transportation, riots, strikes, epidemics, or other legal condition beyond the control of the artist(s) and/or producer In the event a legal action should occur between the artist(s) and Preferred Systems, Inc./Preferred Entertainment it is agreed to file solely in the county of Daviess in the State of Kentucky All reasonable expenses occurred by Preferred Systems, Inc./Preferred Entertainment but not limited to court costs and attorney fees will be paid by artist(s) if Preferred Systems, Inc./Preferred Entertainment is not at fault Payments for services will be mailed to artist upon receipt of funds from the agency client Any attachments or addendum to this contract are hereby made a part of this agreement You must obey venue/campus rules DO NOT SMOKE on premises/campus or in vehicles while on premises/campus Under no circumstance are you to have in your possession or in vehicles or be under the influence of illegal substances, drugs or alcohol on premises/campus 10 Security/Privacy- The Artist(s), employees/representatives understands that this is a PRIVATE event & CAN NOT bring or invite on Campus any pets, family, friends, potential clients or media to event unless they are a key part of the performance or management & have been pre-approved by obtaining written permission by University prior to event 11 Publicity– Any and all services rendered SHALL NOT be publicized, published or otherwise disclosed by Artist(s) in anyway to include media, social media, radio or websites without first obtaining written approval from the University Additionally, Artist(s) SHALL NOT use, nor permit Artist(s) to use, in its external advertising, marketing programs or promotional efforts, any trademarks or trade names of University 12 Dress– All Artist(s), employees/representatives must wear identifying clothing and/or official performer stage crew pass 13 Level of Excellence- The Artist(s), employees/representatives are required to perform to the best of their ability using due diligence at all times with their capabilities & skills, at a reasonably satisfactory level of excellence in the services performed Artist(s) shall present him/herself in a professional manner at all times, to include appearance, dress and behavior No foul language or improper statements to include racist, sexist or any other offensive words or remarks PLEASE RETURN A SIGNED COPY OF THIS CONTRACT IMMEDIATELY Carla Williams “Party on Air” Date Signing for Preferred Entertainment Federal ID or SSN: _(SEND A W-9 YEARLY) Date
