MINUTES OF THE REGULAR MEETING OF MAYOR AND COUNCIL OF THE BOROUGH OF STONE HARBOR HELD IN THE MUNICIPAL BUILDING, October 3, 2017 ******************** The meeting was called to order by Mayor Davies-Dunhour at 4:30 p.m ROLL CALL Judith M Davies-Dunhour, Mayor Suzanne c Stanford, Borough Clerk Marcus Karavan, Solicitor Jim Craft CFO Jill Gougher, Administrator PRESENT Councilmembers Joan Kramar Karen Lane, Council President Joselyn Rich Mantura Gallagher Charles C Krafczek Raymond Parzych Mayor Davies-Dunhour announced that the meeting was now open Adequate notice of the meeting was provided by posting a copy of the time and place on the Municipal Clerk’s bulletin board and mailing a copy of same to the Press on January 4, 2017 Mayor Davies-Dunhour read the following statement: After the Pledge of Allegiance please stay standing for a moment of silence for the victims of the terrible shooting in Las Vegas 59 dead, over 500 injured and countless numbers of lives effected forever It is so very difficult to make sense of this tragedy A friend shared this quote from Fred McFeely Rogers (Mr Rogers) who brought Mr Rogers’ Neighborhood to all of use for over 30 years “When I was a boy and I would see crazy things in the news, my mother would say to me “Look for the helpers You will always find people who are helping.” Thank you to all the helpers Every day heroes SALUTE TO THE FLAG DOCK HEARING Channel Marine Construction – James Majeski – 349 – 89 th Street Frank Bowen, President of Channel Marine Construction Inc was sworn in by Solicitor Karavan Frank Bowen stated he was before Council to get approval for putting in a new pier, ramp and float, approved by DEP at 349 – 89th Street Taking out the old stuff and building the new Councilmember Parzych said he can’t read the comments and/or the plan, too small He asked if they were taking out a fixed pier, floating dock and ramp It appears the fixed pier going back in is smaller, is that correct? Frank Bowen said that is correct Councilmember Parzych asked about the floater Frank Bowen said the floater that is going in is probably a little larger than the old one It has been approved for an X 24, there was an X 20 there originally Councilmember Parzych asked the dimensions of the fixed pier Frank Bowen said 10 X 18 What was there was 25 X 18 They are putting in less Mayor asked if there was anyone in the audience to speak for or against the application No one spoke Upon motion of Seconded by Councilmember Karen Lane Councilmember Ray Parzych To approve the dock permit for 349 – 89th Street per plans prepared by Hyland Design Group Inc and presented for 349 – 89th Street Vote Councilmembers AYE COMMUNICATIONS Read during the Work Session Regular Meeting, October 3, 2017 HEARING OF THE PUBLIC ON MEMORIALS, RESOLUTIONS, PETITIONS & COMPLAINTS Bob Ashman 10301 First Avenue commented good discussion during the Work Session He asked who has the responsibility of enforcing our current construction ordinances Mayor said Construction Office and Police Department He asked what process is in place to review the performance of the Police and Construction Office on enforcing them, is there any? Mayor said isn’t any right now, but moving forward there will be Mr Ashman said that is the key to our problem Many ordinances on the books that aren’t enforced Until we get a clear line of enforcement, and what the penalties are for lack of following them are, no matter what we it won’t work Until you get a fix on who exactly is responsible, and who measures if they are doing their job, and if not put someone in who will follow them, we will never solve it If that is not done, we will be talking about this next year at the same time Councilmember Kramar said the police department has already addressed these problems Mayor said enforcement is falling back onto the police department For several years it was not expected of them Nobody was not doing their job, or not aware, it was not their responsibility Mr Ashman said whoever has the reasonability, it has to be clear Administrator doesn’t go out and it, she administrates it Administrator said it is her responsibility to oversee all department to make sure they are enforcement whatever code is on the books She has addressed this with several departments and is monitoring it We have seen an increase in our enforcement of the ordinances and will continue to that Mr Ashman said to tighten up the performance review of whoever is supposed to be doing it, so it doesn’t slip back to how it has eroded Councilmember Kramar said we have hundreds of Ordinances Councilmember Gallagher said each department has to enforce the ones specific to them She said things have fallen through the cracks, and that is the reason the “no parking” signs are still on her street, nobody has seen that In her estimation if there are 30 plus construction sites going on right now, we need to give our construction man a bicycle and tell him to ride around town, he could see them all in the morning Councilmember Lane said she thinks there is a different philosophy now, we have a change of administration, as far as the Mayor and whole new philosophy with new Police Chief on how these issues are dealt with The tenor of everything has changed Now you will start to see the results Dr Walter Finken - 162 – 94th Street reported the NW corner of 96th and Third, bicycles tied up there for years He has gone to the Police, wonders why they are still there It is a hazard, they are rusted, locks are no good, could the police go and get rid of them Said he like to fix thing up and said when we have bulk trash days he puts things out so people can use them There is an ordinance that says you can’t that unless you knock and ask the person Some things are good and people can use them He looked at a fishing rod, that he could have fixed and was stopped by the Police and told unless he knocks on the door he can’t take anything PW Director said we set up our bulk days when the MUA takes the bulk for free Problem is scrappers that come to town and take the metal materials that we would get credit for Also issues with people coming into town during bulk time and stealing from residents It needs to be controlled RESOLUTION 2017-S-203- (Authorize issuance of $29,250 Bond Anticipation Notes) Upon motion of Councilmember seconded the motion: RESOLUTION AUTHORIZING THE ISSUANCE OF NOT EXCEEDING $29,250,000 BOND ANTICIPATION NOTES OF THE BOROUGH OF STONE HARBOR, IN THE COUNTY OF CAPE MAY, NEW JERSEY BE IT RESOLVED BY THE BOROUGH COUNCIL OF THE BOROUGH OF STONE HARBOR, IN THE COUNTY OF CAPE MAY, NEW JERSEY, AS FOLLOWS: Pursuant to a bond ordinance of the Borough of Stone Harbor, in the County of Cape May (the “Borough”) entitled: “Bond ordinance appropriating $1,700,000, and authorizing the issuance of $1,618,000 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stone Harbor, in the county of Cape May, New Jersey”, finally adopted on March 6, 2012 (#1398), bond anticipation notes of the Borough in a principal amount not exceeding $926,470.59 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section of said bond ordinance, including (to any extent necessary) the renewal of any bond the improvement of the water and sewerage system in and of the Borough of Stone Harbor, in the County of Cape May, New Jersey, appropriating $4,000,000 therefor and authorizing the issuance of $4,000,000 bonds or notes of the Borough for financing such appropriation (Water and Sewer Utility)”, finally adopted on October 21, 2014 (#1450), bond anticipation notes of the Borough in a principal amount not exceeding $77,693 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of recreational facilities in and by the Borough of Stone Harbor, in the County of Cape May, New Jersey, appropriating $140,000 therefor and authorizing the issuance of $133,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on May 5, 2015 (#1463), bond anticipation notes of the Borough in a principal amount not exceeding $133,000 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance making a supplemental appropriation of $5,000,000 for the improvement of beach property in and by the Borough heretofore authorized to be undertaken by the Borough of Stone Harbor, in the County of Cape May, New Jersey, and authorizing the issuance of $4,750,000 bonds or notes of the Borough for financing such supplemental appropriation”, finally adopted on September 1, 2015 (#1465), bond anticipation notes of the Borough in a principal amount not exceeding $4,750,000 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $1,758,000, and authorizing the issuance of $1,670,100 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stone Harbor, in the County of Cape May, New Jersey”, finally adopted on April 5, 2016 (#1478), bond anticipation notes of the Borough in a principal amount not exceeding $1,080,000 anticipation notes heretofore issued therefor Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of the water and sewerage system in and of the Borough of Stone Harbor, in the County of Cape May, New Jersey, appropriating $1,300,000 therefor and authorizing the issuance of $1,300,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on April 5, 2016 (#1480), bond anticipation notes of the Borough in a principal amount not exceeding $1,300,000 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor Pursuant to a bond ordinance of the necessary) the renewal of any bond anticipation notes heretofore issued therefor Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $366,000, and authorizing the issuance of $347,700 bonds or notes of the Borough, for various water and sewerage system improvements or purposes authorized to be undertaken by the Borough of Stone Harbor, in the County of Cape May, New Jersey”, finally adopted on March 3, 2015 (#1456), bond anticipation notes of the Borough in a principal amount not exceeding $325,000 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $553,000, and authorizing the issuance of $553,000 bonds or notes of the Borough, for various water and sewerage system improvements or adopted on April 18, 2017 (#1495-17), bond anticipation notes of the Borough in a principal amount not exceeding $1,764,411 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $3,310,000, and authorizing the issuance of $3,310,000 bonds or notes of the Borough, for various water and sewerage system improvements or purposes authorized to be undertaken by the Borough of Stone Harbor, in the County of Cape May, New Jersey”, finally adopted on April 18, 2017 (#1496-17), bond anticipation notes of the Borough in a principal amount not exceeding $2,556,500 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance making a supplemental appropriation of $1,500,000 for the construction of a new Public Safety Building in and by the Borough heretofore authorized to be undertaken by the Borough of Stone Harbor, in the County of Cape May, New Jersey, and authorizing the issuance of $1,425,000 bonds or notes of the Borough for financing such supplemental appropriation.”, finally adopted on June 20, 2017 (#1499-17), bond anticipation notes of the Borough in a principal amount not exceeding $1,425,000 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of the water and sewerage system in and of the Borough of Stone Harbor, in the County of Cape May, New Jersey, appropriating $1,500,000 therefor and authorizing the issuance of $1,500,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on March 9, 2017 (#1492-17), bond anticipation notes of the Borough in a principal amount not exceeding $1,500,000 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor All bond anticipation notes (the “notes”) issued hereunder shall mature at such times as may be determined by the treasurer, the chief financial officer or the acting chief financial officer of the Borough (the “Chief Financial Officer”), provided that no note shall mature later than one year from its date The notes shall bear interest at such rate or rates and be in such form as may be determined by the Chief Financial Officer and shall be signed and sealed by officials and officers of the Borough in any manner permitted by N.J.S.A §40A:2-25 The Chief Financial Officer shall determine all matters in connection with the notes issued hereunder, and the Chief Financial Officer’s signature upon the notes shall be conclusive evidence as to all such determinations All notes issued hereunder may be renewed from time to time subject to the provisions of N.J.S.A §40A:2-8 The Chief Financial Officer is hereby authorized to sell part or all of the notes at not less than par from time to time at public or private sale and to deliver them to the purchasers thereof upon receipt of payment of the purchase price The Chief Financial Officer is directed to report in writing to the governing body of the Borough at the meeting next succeeding the date when any sale or delivery of the notes hereunder is made Such report must include the principal amount, interest rate and maturities of the notes sold, the price obtained and the name of the purchaser Any note issued pursuant to this resolution shall be a general obligation of the Borough, and the Borough’s faith and credit are hereby pledged to the punctual payment of the principal of and interest on the notes and, unless otherwise paid or payment provided for, an amount sufficient for such payment shall be inserted in the budget and a tax sufficient to provide for the payment thereof shall be levied and collected The Chief Financial Officer is hereby authorized and directed to all other matters necessary, useful, convenient or desirable to accomplish the delivery of the notes to the purchasers thereof as promptly as possible, including (i) the preparation, execution and dissemination of a Preliminary Official Statement and Final Official Statement with respect to the notes, (ii) preparation, distribution and publication, if necessary, of a Notice of Sale with respect to the notes, (iii) execution of a Continuing Disclosure Undertaking, with respect to the notes in accordance with Rule 15c2-12 promulgated by the Securities and Exchange Commission and (iv) execution of an arbitrage and use of proceeds certificate certifying that, among other things, the Borough, to the extent it is empowered and allowed under applicable law, will and perform all acts and things necessary or desirable to assure that interest paid on the notes is not included in gross income under Section 103 of the Internal Revenue Code of 1986, as amended All action heretofore taken by Borough officials and professionals with regard to the sale and award of the notes is hereby ratified, confirmed, adopted and approved This resolution shall take effect immediately Upon motion of , seconded by , the foregoing resolution was adopted by the following vote: Vote Councilmembers AYE Regular Meeting, October 3, 2017 RESOLUTION 2017-S-204– (Purchase LUKE II Kiosk Machines – COOP The name of the COOP was not correct in the agenda….it will be changed to NJPA Cooperative Pricing System Upon motion of Seconded by Councilmember Joan Kramar Councilmember Karen Lane AS AMENDED: WHEREAS, the Borough of Stone Harbor entered into the NJPA Cooperative Pricing System (#1112014-NWY) by Resolution 2015-S-118 in June, 2015 for the purpose of purchasing equipment; and WHEREAS, the Public Works Department will be using this System to purchase seven (7) new Kiosk Machines as per quote attached, (Integrated Technical Systems, Inc.) (1) for $12,133 and six (6) for $67,904 for a total of $80,037 each along with equipment listed in the quote NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Stone Harbor, County of Cape May, State of New Jersey on this rd day of October, 2017 that the purchase of seven (7) Kiosk Machines for the Stone Harbor Public Work Department for a total price of $ 80,037 be approved Vote Councilmembers AYE RESOLUTION 2017-S-205– (Fee for 2017 Floating Docks) Upon motion of Seconded by Councilmember Karen Lane Councilmember Ray Parzych WHEREAS, the Borough Council of the Borough of Stone Harbor in the County of Cape May and the State of New Jersey has ordained that certain fees may be established from time-totime by Resolution of the Borough Council; and WHEREAS, the Administration and Finance Committee of Borough Council has recommended that certain fees be established by Resolution; and NOW, THEREFORE, BE IT RESOLVED by Borough Council of the Borough of Stone Harbor, in the County of Cape May, duly assembled in public session this rd day of October, 2017, that the following fee be set at the following level for the year 2017: - Floating Dock Storage Vote $250.00 per floating dock Councilmembers AYE RESOLUTION 2017-S-206 (Duplicate Tax Payment - McClelland) Upon motion of Seconded by Councilmember Charles Krafczek Councilmember Joan Kramar Council Meeting: October 3, 2017 REFUND DUPLICATE TAX PAYMENT WHEREAS, duplicate tax payments were received for the third quarter installment by Wells Fargo Bank and the homeowners for Block 121.03 Lot 217, A.K.A 218 122 nd Street; and WHEREAS, the homeowners, Regis and Jodi McClelland requested a refund be issued to them; and, Regular Meeting, October 3, 2017 NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Stone Harbor, in the County of Cape May and State of New Jersey that a refund check in the amount of $2,858.87 be issued to Regis & Jodi McClelland, 1819 Murdstone Rd, Pittsburg PA 15241; and BE IT FURTHER RESOLVED that the Tax Collector make the proper adjustment in her records Vote Councilmembers AYE RESOLUTION 2017-S-207 (Refund CTT & Fire Inspection Fee –
