MINUTES OF THE WORK SESSION OF MAYOR AND COUNCIL OF THE BOROUGH OF STONE HARBOR HELD IN THE MUNICIPAL BUILDING, FEBRUARY 4, 2014 ******************** The meeting was called to order by Mayor Walters at 4:30 p.m ROLL CALL Suzanne M Walters, Mayor Suzanne C Stanford, Borough Clerk Michael Donohue, Solicitor Jill A Gougher, Borough Administrator PRESENT Councilmembers Joan Kramar Karen Lane Joselyn Rich Judith Davies-Dunhour, Council President Barry Mastrangelo Albert Carusi Mayor Walters announced that the meeting was now open Adequate notice of the meeting was provided by posting a copy of the time and place on the Municipal Clerk’s bulletin board and mailing a copy of same to the Press and the Cape May County Herald on January 8, 2014 SALUTE TO THE FLAG RESOLUTION 2014-S-36 (Appoint Police Sergeant Michael Workman Upon motion of Seconded by Councilmember Al Carusi Councilmember Joselyn O Rich RESOLUTION AUTHORIZING PROMOTION OF MICHAEL WORKMAN TO THE POSITION OF PATROL SERGEANT WHEREAS, the Stone Harbor Police Department, as a result of a recent promotion, is in need of a Patrol Sergeant; and WHEREAS, the Borough’s Public Safety Committee has recommended that Michael Workman be promoted to Patrol Sergeant; and WHEREAS, the Chief of Police has also recommended that Michael Workman be promoted to Patrol Sergeant; and WHEREAS, such promotion would be in accordance with the policies and procedures of the Borough and the Police Department and in accordance with applicable law; NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Stone Harbor, County of Cape May, State of New Jersey, duly assembled in Public Session this th day of February, 2014, that the Chief of Police be and hereby is authorized and directed to promote Michael Workman to the position of Patrol Sergeant for the Stone Harbor Police Department, with all the duties, rights and obligations of such command position Vote Councilmembers AYE SERGEANT MICHAEL WORKMAN WAS SWORN IN BY THE BOROUGH CLERK POLICE OFFICER JUSTIN GLASS WAS SWORN IN BY THE BOROUGH CLERK (Resolution previously approved) JIM HAND – presentation Shiver - Jim Hand owner of Fred’s Tavern asked for permission, just like last year, to use the parking lot behind Fred’s tavern at 314 – 96 th Street for an after the Shiver affair There will be a tent in the parking lot, activities for the kids, food etc Councilmember Kramar asked if next year the Chamber could consider giving back 1/3 to a Stone Harbor based group such as the Garden Club Work Session, February 4, 2014 Motion by Seconded Councilmember Judy Davies-Dunhour Councilmember Joan Kramar That the request be approved Vote Councilmembers AYE COMMUNICATIONS PUBLIC COMMENT Tony Madison, southeast corner of Shelter Haven basin Wanted to understand plans or proposed plans for the waterfront business district, park, lighthouse structure, wanted to understand what proposals are on the table and why and what the benefits might be Mayor Walters said there are no proposals on the table to start, but the Planning Board hired a planner to look into the waterfront business district and the designs that you saw were the planners vision of the future of Stone Harbor It included total access all along the basin on Third Avenue and having a structure in the basin itself There is nothing contemplated happening or the Borough buying property or any of that It is a plan that the planner came up with that he hoped we would in the future None of that is a goal at this point Randall Tourney 9715 Third Avenue Follow up, was here last year and was told to go to the Planning Board, who then drafted a letter to you to the heights because we keep going up and down but it is higher than my house But the long and short is that area is not being afforded the same rights as all the other neighborhoods for building height He is wondering if the Borough would look into that Mayor said that was why we had the Planner look at it because the Borough realized that and we did not know that the planner was going to take it to the extreme that they did and didn’t make any changes to anything other than this whole promenade thing We will be happy to take it back to the Planning Board and see if we can anything Mr Tourney has always been told that his remedy under this new waterfront business district legislation is to go to the Zoning Board He has been there twice and now a member of the Planning Board has got you and me both as co-defendants Is he still doing legislation on the Planning Board? Mayor responded yes Mr Tourney asked if the Planner was still with us Mayor responded yes Mr Tourney said at the last Planning Board meeting there was some discussion about the subcommittee exceeding their amount of money by some or fold Has there been any oversight? Mayor responded we are looking into it Mayor said when we asked the Planner to look into it, we were simply looking into the wording of the ordinance to be able to give the residences in the waterfront business district the same that residential could anywhere else in town The Planner didn’t understand what we were giving them Mr Tourney said the people he has talked to on the basin are not too receptive to the idea of the pier in the middle, etc Solicitor Donohue pointed out, so that it is clear, the Planning Board is a separate independent entity although we send representatives from Council, they determine their own course, they are the town planners, they hired the planner, not the Borough The Council does have some oversight but they are independent unto themselves The Mayor, Councilmember Rich and Administrator Gougher have been exercising that oversight and it was a concern to him and to them that the Planner seemed to go beyond the brief that he was given on that project The Council can’t tell the Planning Board what to Mr Tourney said, by the same token their opinion is just advisory to the Council, you not have to take their opinion Solicitor, that is correct And further along those lines rebuilding a house that has been there since 1945 is a conditional use and needs a D variance is a little onerous too, in addition to no allowance for the height to get it up to where you want it for the height regulations He would like to see both of those changed and he is not the only one affected, Joe Kuo has not been able to rent consistently to anyone because they won’t let him have anything but retail, and the Deneka took a very low price because they weren’t allowed to anything , tear their house down and rebuild a house there Everyone is affected and he thinks we maybe have over legislated possibly to the determent of the homeowners there Tony Madison said since the Planning Board and the Zoning Board are separate entities, but how are they elected or appointment, how you become a planning member? Solicitor responded they are appointed by Council Do they have to be residents? Solicitor said yes So both Zoning Work Session, February 4, 2014 and Planning are appointed for a certain length of time, how long? Mayor, the appointments vary years for some years for alternates Does Borough Council have the power to alter or make changes with people that are there or they have to fulfill their terms? Solicitor, I suppose you could for cause under certain circumstances OLD BUSINESS: ORDINANCE 1433 (SALARY) Upon motion of Seconded by Councilmember Barry Mastrangelo Councilmember Joselyn O Rich That Ordinance 1433 be taken up on second reading Vote Councilmembers AYE The Clerk read the title only of Ordinance 1433 on second reading because a copy of said Ordinance was posted on the Clerk’s bulletin board The Public Hearing is now open No one spoke The Public Hearing was closed Upon motion of Seconded by Councilmember Barry Mastrangelo Councilmember Al Carusi That Ordinance 1433 be Vote Councilmembers AYE Work Session, February 4, 2014 ORDINANCE 1440 – Purchase of Real Property Upon motion of Seconded by Councilmember Barry D Mastrangelo Councilmember Joan Kramar That Ordinance 1440 be taken up on first reading Vote Councilmembers AYE The Clerk read the title only of Ordinance 1440 on first reading Mastrangelo, this is to allow us to purchase Site 103 in the amount of $90,000 Solicitor Donohue gave some background It has been the policy of successive Councils for as long as he has been around to try to obtain title to this parcel, one of the very few authorized confined disposal facilities for dredge material The Borough has had control of it for all intents and purposes as a lease holder for at least 10 years From time to time there have been negotiations to try and purchase it, recently the sale was approved by the Boater’s Association that owns the parcel The Mayor and Council for several years have been partnering with the DOT to try to find a way to off-load the site and created capacity for the next dredge project We had an appraisal done and this is just a few dollars over the appraisal, taking into account some of the administrative costs second, third and final reading, and adoption at a meeting of Mayor and Council to be held on the 4th day of March, 2014 Vote Councilmembers AYE RESOLUTION 2014-S-37 (Temp Capital Budget) Upon motion of Seconded by Councilmember Barry D Mastrangelo Councilmember Al Carusi TEMPORARY CAPITAL BUDGET WHEREAS, the Borough of Stone Harbor, County of Cape May, desires to establish a 2014 Temporary Capital Budget to permit various general improvements, NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Stone Harbor as follows: SECTION The 2014 Temporary Capital Budget of the Borough of Stone Harbor is hereby constituted as follows: SECTION The Borough Clerk be and is authorized and directed to file a certified copy of this resolution with the Division of Local Government Services, Department of Community Affairs, State of New Jersey SECTION The aforementioned capital projects shall be included in the 2014 Permanent Capital Budget as adopted Vote Councilmembers AYE RESOLUTION 2014-S-38 – (Summer Trash Schedule) Upon motion of Seconded by Councilmember Joan Kramar Councilmember Al Carusi SUMMER TRASH COLLECTION SCHEDULE 2014 WHEREAS, Section 466-4, Collections – Frequency, of the Revised General Ordinances of the Borough of Stone Harbor 2005 provides that the Borough shall have the right to set the dates for trash collection; NOW, THEREFORE, BE IT RESOLVED, by the Members of Council of the Borough of Stone Harbor that the following schedule will be in effect from June 15, 2014 through September 13, 2014 for the year 2014: TRASH AND RECYCLE WILL BE COLLECTED ON THE SAME DAY, TWO TIMES PER WEEK Solid Waste/Recycle Summer Schedule as follows: 80th to 93rd including Linden, Pennsylvania and Sunset – Monday, Thursday 94th to 104th (300 & 400 Blocks) including Berkley, Charles, Corinthian, Golden Gate, Sunrise, Sunset and Seng – Tuesday, Friday 104th (100 & 200 Blocks) to 122nd, including Chelsea, Bower, Paradise, Stone, Sunset and Weber – Wednesday, Saturday Work Session, February 4, 2014 Beach & Street receptacles – Daily Commercial – days (Sunday by request) Vote Councilmembers AYE RESOLUTION 2014-S-39 – (RiGi Amusement License) Upon motion of Seconded by Councilmember Davies-Dunhour Councilmember Al Carusi A RESOLUTION APPROVING AN AMUSEMENT GAME LICENSE FOR RIGI’S ARCADE WHEREAS, the Borough Clerk has, at the direction of the Borough’s Amusement Licensing Board, issued permits to Rigi’s Arcade for its operations in the 200 block of 96 th Street; and WHEREAS, at this time the State of New Jersey Legalized Games of Chance Control Commission requires the passage of a Resolution by Borough Council in connection with the Commission’s oversight responsibilities for redemption activities at such operations; and WHEREAS, Rigi’s Arcade has submitted the proper application and paid the appropriate fee, under and subject to the rules and regulations established by the Commission; and WHEREAS, the Borough of Stone Harbor is a seashore resort community and State law allows such redemption activities within such operations in such towns; and NOW, THEREFORE, BE IT RESOLVED, by the Borough Council of the Borough of Stone Harbor, County of Cape May and State of New Jersey, duly assembled in public session this 4th day of February, 2014, that Rigi’s Arcade be and is granted an Amusement License by and from the Borough of Stone Harbor for the period January 1, 2014 through December 31, 2014; that the Borough of Stone Harbor has no objection to the State of New Jersey licensing and/or regulating redemption activities at Rigi’s Arcade, and that such licenses shall be kept on file for public review in the Borough Clerk’s Office BE IT FURTHER RESOLVED that this Resolution shall be effective only upon the affirmative vote of not less than two-thirds of the members of Borough Vote Councilmembers AYE RESOLUTION 2014-S-40 – (Policy for Centennial Logo) Upon motion of Seconded by Councilmember Joan Kramar Councilmember Joselyn O Rich RESOLUTION ESTABLISHING A POLICY FOR USE OF THE BOROUGH’S CENTENNIAL LOGO WHEREAS, the Borough of Stone Harbor in the County of Cape May and State of New Jersey is celebrating its Centennial in 2014 and as part of that celebration the Borough has developed a “Centennial logo” being utilized in advertising and posting of event information; and WHEREAS, local businesses have inquired about the use of the logo on products; and WHEREAS, the Centennial Committee has recommended the allowance of the logo for such purposes with remuneration to the Borough and has drafted a image use policy, a copy of which is attached hereto and made a part hereof by reference; and WHEREAS, the Borough has determined that the commercial use of the logo will help to create interest in Centennial events as well as assist the business community in promoting the Centennial and benefiting from the celebration; Work Session, February 4, 2014 NOW, THEREFORE, BE IT RESOLVED, by the Borough Council of the Borough of Stone Harbor duly assembled in public session this th day of February, 2014, as follows: That the attached image use policy is hereby adopted for use in connection with requests for the use of the Borough’s Centennial logo; and The Centennial Committee is hereby authorized to allow such use consistent with the aforementioned policy and to report to Stone Harbor is subject to certain requirements of the Open Public Meetings Act, N.J.S.A 10:4–6, et seq., and WHEREAS, the Open Public Meetings Act, N.J.S.A 10:4–12, provides that an Executive Session, not open to the public, may be held for certain specified purposes when authorized by Resolution, and WHEREAS, it is necessary for the Borough Council of the Borough of Stone Harbor to discuss in a session not open to the public certain matters relating to the item or items authorized by N.J.S.A 10:4–12b and designated below: Matters Relating to Contract Negotiations and/or the
