dedicates fees to coastal 11fishing research 12 13CURRENT VERSION OF TEXT 14 As introduced 15 A2284 ANDRZEJCZAK 1AN ACT establishing “Recreational Fishing” license plates, and supplementing chapter of Title 39 of the Revised Statutes BE IT ENACTED by the Senate and General Assembly of the 5State of New Jersey: a Upon proper application, the Chief Administrator of the 8New Jersey Motor Vehicle Commission shall issue recreational 9fishing license plates for any motor vehicle owned or leased and 10registered in the State In addition to the registration number and 11other markings or identification otherwise prescribed by law, the 12recreational fishing license plate shall display words or a slogan and 13an emblem indicating support for, or interest in, recreational 14fishing The chief administrator shall select the design, in 15consultation with the New Jersey Agricultural Experiment Station at 16Rutgers, the State University of New Jersey and any advocacy 17groups having an interest in recreational fishing Recreational 18fishing license plates shall be subject to the provisions of chapter 19of Title 39 of the Revised Statutes, except as hereinafter otherwise 20specifically provided 21 b Application for issuance of a recreational fishing license 22plate shall be made to the chief administrator on forms and in a 23manner prescribed by the chief administrator In order to be 24deemed complete, an application shall be accompanied by a fee of 25$50, payable to the New Jersey Motor Vehicle Commission, which 26shall be in addition to the fee otherwise prescribed by law for the 27registration of motor vehicles The chief administrator shall collect 28annually, subsequent to the year of issuance of the recreational 29fishing license plate, a $10 fee for the license plate in addition to 30the fees otherwise prescribed by law for the registration of a motor 31vehicle The additional fees required by this subsection shall be 32deposited in the “Recreational Fishing License Plate Fund” created 33pursuant to subsection c of this section 34 c There is created in the Department of the Treasury a special 35non-lapsing fund to be known as the “Recreational Fishing License 36Plate Fund.” There shall be deposited in the fund the amount 37collected from all license plate fees collected pursuant to subsection 38b of this section, less the amounts necessary to reimburse the 39commission for administrative costs pursuant to subsection d of 40this section Monies deposited in the fund shall be appropriated 41annually to the New Jersey Agricultural Experiment Station at 42Rutgers, the State University of New Jersey and shall be used to 43fund research on coastal fishing Monies deposited in the fund shall 44be held in interest-bearing accounts in public depositories as 45defined pursuant to section of P.L.1970, c.236 (C.17:9-41), and 46may be invested or reinvested in such securities as are approved by 47the State Treasurer Interest or other income earned on monies 48deposited in the fund, and any monies which may be appropriated A2284 ANDRZEJCZAK 3 1or otherwise become available for the purposes of the fund, shall be 2credited to and deposited in the fund for use as set forth in this act d Prior to the deposit of the additional fees collected pursuant 4to subsection b of this section into the fund, amounts thereof as are 5necessary shall be used to reimburse the commission for all costs 6reasonable and actually incurred, as stipulated by the chief 7administrator, for: (1) producing, issuing, renewing, and publicizing the 9availability of the recreational fishing license plates; and 10 (2) any computer programming changes that may be initially 11necessary to implement the recreational fishing license plate 12program established by this act, in an amount not to exceed 13$150,000 14 The chief administrator shall annually certify to the State 15Treasurer the average cost per license plate incurred in the 16immediately preceding year by the commission in producing, 17issuing, renewing, and publicizing the availability of the 18recreational fishing license plates The annual certification of the 19average cost per license plate shall be approved by the Joint Budget 20Oversight Committee, or its successor 21 In the event that the average cost per license plate as certified by 22the chief administrator and approved by the Joint Budget Oversight 23Committee, or its successor, is greater than the $50 application fee 24established in subsection b of this section in two consecutive fiscal 25years, the chief administrator may discontinue the issuance of 26recreational fishing license plates 27 e The chief administrator shall notify eligible motorists of the 28opportunity to obtain recreational fishing license plates by 29publicizing the availability of the license plates on the website of 30the Motor Vehicle Commission Rutgers, the State University of 31New Jersey, and any other individual or entity designated by the 32university, may publicize the availability of recreational fishing 33license plates in any manner the university deems appropriate 34 f The chief administrator and Rutgers, the State University of 35New Jersey shall develop and enter into an interagency 36memorandum of agreement setting forth the procedures to be 37followed in carrying out their respective responsibilities under this 38act 39 g Rutgers, the State University of New Jersey, shall appoint a 40representative who shall act as a liaison between the organization 41and the commission The liaison shall represent the university in 42any and all communications with the commission regarding the 43recreational fishing license plates established by this act 44 45 a No State or other public funds shall be used by the 46commission for the initial cost of: 47 (1) producing, issuing, and publicizing the availability of 48recreational fishing license plates; or A2284 ANDRZEJCZAK 4 (2) any computer programming changes which may be 2necessary to implement the recreational fishing license plate 3program established by this act b The New Jersey Agricultural Experiment Station at Rutgers, 5the State University of New Jersey, or other individual or entity 6designated by the university, shall contribute monies in an amount 7to be determined by the chief administrator, not to exceed a total of 8$25,000, to be used to offset the initial costs incurred by the 9commission for producing, issuing, and publicizing the availability 10of recreational fishing license plates, and any computer 11programming which may be necessary to implement the program 12To further help offset the initial costs incurred by the commission 13for the special license plates authorized by this act, other concerned 14organizations and individual donors may contribute monies to 15Rutgers, the State University of New Jersey, or an individual or 16entity designated by the university, for this purpose Any amount 17remaining after the payment of the initial costs shall be deposited in 18the “Recreational Fishing License Plate Fund” established pursuant 19to subsection c of section of this act 20 c The commission shall not begin designing, producing, 21issuing, or publicizing the availability of recreational fishing license 22plates, or making any necessary programming changes, until the 23following requirements have been met: 24 (1) Rutgers, the State University of New Jersey, or the 25individual or entity designated by the university, has provided the 26commission with the money necessary, as determined by the chief 27administrator pursuant to subsection b of this section, to offset the 28initial costs incurred by the commission in establishing the 29recreational fishing license plate program; and 30 (2) The liaison appointed by Rutgers, the State University of 31New Jersey, pursuant to subsection g of section of this act has 32provided the commission with not less than 500 completed 33applications for recreational fishing license plates These 34applications shall constitute the initial order for recreational fishing 35license plates and shall be accompanied by a fee representing the 36total cost of the initial order Such fee shall be determined by 37multiplying the number of sets of plates being ordered by the 38applicable initial fee for each set of plates as set forth in subsection 39b of section of this act 40 41 This act shall take effect immediately, but shall remain 42inoperable until the first day of the seventh month following the 43date on which the conditions set forth in paragraphs (1) and (2) of 44subsection c of section of this act have been satisfied The chief 45administrator may take such anticipatory acts in advance of that 46operative date as may be necessary for the timely implementation of 47this act This act shall expire if the conditions set forth in A2284 ANDRZEJCZAK 1paragraphs (1) and (2) of subsection c of section of this act are 2not satisfied by the last day of the 12th month following enactment STATEMENT This bill authorizes the Motor Vehicle Commission to issue a 8recreational fishing license plate The additional fees generated 9through the sale of these plates, less the amounts necessary to 10reimburse the commission for its costs, are to be deposited in a 11special fund and used by the New Jersey Agricultural Experimental 12Station at Rutgers to fund research on coastal fishing ...
