arbitration This course considers the following topics: the nature of commercial arbitration, the types of arbitration, applicable law in international commercial arbitration, the agreement to arbitrate, judicial enforcement of the agreement, the powers of arbitral tribunal, the conduct of arbitration and challenges to and enforcement of arbitral awards CONTENT OF THE COURSE Unit 1: (CLOs) * Knowledges K1 Have general knowledge of commercial arbitration: the nature, the historical development and different forms of commercial arbitration and international arbitration, the advantages and disadvantages of arbitration in settling disputes, in particular international commercial disputes K2 Be aware of the legal and procedural regime for arbitration in Vietnam and other countries K3 be familiar with the procedures of some of the major international arbitration institutions (eg ICC, SIAC, HKIAC, VIAC) K4 understand the relationship between domestic courts and arbitration and the growing autonomy of the arbitral process; and K5 be able to advise clients on the drafting and enforcing of arbitration agreements and awards and the conduct of arbitral proceedings * Skills S6 Investigate, analyze and assess legal documents on commercial arbitration; S7 Analyze practical cases and providing solutions to deal with legal issues in these cases; S8
