ENCYCLOPEDIA OF PRIVATE INTERNATIONAL LAW

Một phần của tài liệu Law 2917 (Trang 63 - 72)

Bringing together 181 authors from 57 countries the Encyclopedia sheds light on the current state of Private International Law (PIL) around the globe, providing unique insights into the discipline and how it is affected by globalization and increased regional integration.

The role and character of PIL has changed tremendously over the past decades. With the steady increase of global and regional inter- connectedness the practical significance of the discipline has grown.

The third volume describes the PIL regimes of 80 countries in the form of national reports. The fourth volume comprises a collection of national codifications and provisions of PIL translated into English.

• 247 substantive entries

• 80 national reports

• Entries organised alphabetically for ease of navigation

• Fully cross-referenced

• Entries written by the world’s foremost scholars of PIL

• National codifications in English collected together into a single volume for quick reference

Competition and Regulation in Electricity Markets

Edited by Sebastian Eyre, London School of Economics and Michael G. Pollitt, University of Cambridge, UK

Featuring an original introduction by the editors, these carefully-selected essays explore the main issues surrounding competition and regulation in electricity markets. The industry is experiencing irresistible forces of change, driven by energy policy objectives; a reassessment of market regulation in the face of high-energy prices; and

the response to consumer pressure to agree on what constitutes a fair price for energy. This volume identifies the key articles that underpin the debate across the industries supply chain (generation, supply and networks) from a regulatory perspective (including market power and incentive regulation).

The collection then considers the overall impact of liberalisation and future developments.

Risk, Resilience, Inequality and Environmental Law

Edited by Bridget M. Hutter, London School of Economics and Political Science, UK

This insightful book considers how the law has adapted to the environmental challenges of the 21st Century and the ways in which it might be used to cope with environmental risks and uncertainties whilst promoting resilience and greater equality. These issues are considered in social context by contributors from different disciplines who examine some of the experiments tried in different parts of the world to govern the environment, improve the available legal tools and give voice to more diverse groups.

Law’s Regulatory Relevance?

A New Theory for Global Justice

Mark Findlay, Singapore Management University and University of Sydney, Australia

Law’s regulatory relevance is under strain as never before. Focusing on the information economy, free trade exploitation, and confronting terrorist violence, the book critiques law’s commodification in marketing property. It speculates on law as a community resource if it is to effectively order radical transitions in the collective conscience regarding access to property and new forms of valuation.

Conventional legal regulatory modes such as theft and IP are challenged against waves of property use and the rethinking of property ‘rights’.

Hybridization of Food Governance

Trends, Types and Results

Edited by Paul Verbruggen, Tilburg University and Tetty Havinga, Radboud University Nijmegen, the Netherlands

Modern food governance is increasingly hybrid, involving not only government, but also industry and civil society actors. This volume analyzes the unfolding interplay between public and private actors in global and local food governance. How are responsibilities and risks allocated in hybrid governance arrangements, how is legitimacy ensured, and what effects do these arrangements have on industry or government practices? The expert contributors draw on law, economics, political science and sociology to discuss these questions through rich empirical cases.

Contract and Regulation

A Handbook on New Methods of Law Making in Private Law Edited by Hans-W. Micklitz, European University Institute, Italy, Rob A.J. Van Gestel, Tilburg University, the Netherlands and Roger Brownsword, King’s College London, UK

This timely Handbook sheds light on the darker side of contracts. It begins by exploring the ‘regulatory space’ in which projects are planned, deals are done, and goods and services are consumed, then shows how a ‘bottom-up’ approach can be adopted in order to view this transactional space through the eyes of contractors.

The expert contributors explore modes of governance that do not fit nicely into traditional contract theory, paying special attention to three key examples:

governance and codes of conduction, networks and relations, compliance and use.
