Viet Nam during the International Joining Period 2010 - 2015 ABSTRACT As we know, Vietnam’s Economy is developing day after day Vietnam has been estimated as a safe place for investment to foreign investors, not only in economic field but also in political one We also know that Vietnam is a developing country This is true because the economy is healthier now than a decade ago, In that context, businesses of Vietnam and foreign investors played an important role, especially, companies, enterprises, investors in the country and abroad, For keeping process of national economy solid, Vietnamese Government need to havepolicies that encourage businesses in the country and attract foreign investors One of the policies is safe protection of their business activities, and another important problem is to protect intellectual property (IP) right for them, So I am lucky to business about this field and I have seen the importance of IP of nowadays and in future This is also a good chance for my work, a field requesting high specialization skills about IP law At the moment in Vietnam, IP experts are not sufficient to supply for this field While the IP service needs business operations in the society nowadays Beside, Vietnam‘s IP law had been effective, however it still has limits to execution process , so it needs to be more complete in future, With the purpose of researching the concern of companies, enterprises, Investors in protection of their IP right, from that, we draw out lessons for our IP better activities Beside, from the opinion of enterprises given here, it has contributed to the improving better IP law in future With the reasons being put out above, in process to research my thesis, I gave out the questionnaire for businesses relating to the answer of the main problems as follows: Degree concern of businesses about IP and IP service; Degree their know of businesses to our IP operation; Degree their invest of businesses to IP right protection; Businesses‘s difficulty when they apply for IP; Finally, the suggestion of businesses to IP service for it will be better in future II The data of questionnaire from research are collected and processed through the SPSS software so that we are able to know the problems mentioned above In short: Customer development, improving IP law system, training of IP experts source are the purposes of concern to IP are Director of companies (42.5%), next Government official (20.4%), Worker 14.6 % and others (22.5%) This result is correspondent to the structure of our survey This result also showed businesses in Dong Nai province (21.1%), Binh Duong 113 businesses (23.5%), Ho Chi Minh City 139 businesses (29.0%) and some other localities 122 businesses (25.4 %) present It is also correspondent Engineer, 132 persons graduated Law and other careers 105 (21.9%) This result also showed that concern to IP field that most people who has been high educated It is correspondent with subjects concern much (9.8%), 82 people are normal (17.1%), and 317 people from concern to concern very much to IP field, this proves the importance of IP field as we mentioned above 4.3 Degree Concern of Investment is normal, 142 people (29.6%) concern and 163 people (34.0%) concern very much to IP field This is correspondent with content of thesis that we gave out above With result 98 people from don’t concern to concern not at all of IP field, this is a proven fact that although the Vietnamese enterprises developed rapidly, but still some small businesses who didn’t have economic conditions, so that they did not know and not interested in the field of intellectual property much 29 4.4 Degree Concern of Business When Apply for IP Protection Result Table 4-9 Result of Business about Apply for IP number of people (95 people) not care at all to no interest in apply for protection of their intellectual property rights This is equivalent with the number of people they not care and not care at all to area of IP and IP organizations (table 4-2) With result 134 people concern (27.9%) and 154 people concern very much, this also proved that the most of Vietnamese enterprises today also aware of the protection of intellectual property rights of them and it is also correspondent with purpose of thesis we attended above 4.5 Some Suggests of Customers for IP and IP Service Result In this section because of will difference idea of reviewers, so we have arranged them by five groups correspond with five types of content requests and suggestions of the enterprises at the meeting It include :Group1 : Enterprise ‘s requests and suggestions need to simplify application registration of IP; Group : Enterprise ‘s requests and suggestions need to shorten the time to issue intellectual property certificate; Group : The settle of counterfeit goods related to infringing IP rights need to be more radical compared with current IP law providing; Group : Enterprise ‘s requests and suggestions need to have training and education about IP and IP rights for enterprises; Group 5: other requests and suggestions 30 Table 4-10 Result of Business Concern to Simplify Cumulative Valid Group Frequency simplify application registration of IP This also proves that the issue of administrative reform in Vietnam is still a matter of interest, although the Government has a lot of effort in this problem, but the attitude of bureaucracy and cumbersome procedures caused difficulty problems for enterprises in some of state offices in Vietnam With 122 people (25.4%) concern to shorten the time to issue intellectual propertycertificate, this fact also showed that today the certification of IP rights protection granted by the IP of Government is too long , because the regulations state is months for registration of trademark protection , but usually after more than a year level , while their goods were cuonterfei , so they want to shorten the time certification So, this result is correspondent with our study With 140 people (29.2%) suggesting the need to settle counterfeit goods related to infringing IP rights need to be more radical compare with current IP law providing, this result showed that although, government of Vietnam enacted IP law and other legal issues related to handling of fake goods, but it is still limited, counterfeit goods are still appearing in the Vietnam market According to the Ministry of Trade and Industry, the past 10 years the Government has been to make 102,000 cases of counterfeit goods and infringement of IP rights with a fine 124 billion VND, so with result from this research is correspondent with what we studied With 103 people (21.5 %) had requests and suggestions to need training and education about IP and IP rights for enterprises This is correspondent with some people who didn’t concern anything about IP and IP rights as we surveyed in table 4.2 and table 4-10, because they don’t know of IP and their IP rights , so they need to 31 train and education to help them of IP and IP rights , that is also purpose study our thesis attended above Beside, with 24 people (5 %) who gave out their different opinions and suggestions, even as: IP services companies have the support of service charges for small and medium enterprises The registration of IP should apply automatically through the internet We need to publish IP violation cases in the media to alert for consumers to know where is false and where is the real goods Government need to increase penalties for infringement of IP rights compared with the current laws so on … On the whole this is the result of survey research and analysis from the results of this study This helped us provide out some solutions for research that we will mention in Chapter of this thesis 32 Chapter Implications, Conclusions and Recommendations 5.1 Discussion of Research Result As we have discussed above to achieve the purpose of research thesis content on the basis of practice need of the business Vietnam in the context of international economic integration, in which one part is equally important IP rights protection field for businesses The combination of practical and theoretical and add some experience of ourselves who have ever worked in this field In the process of writing thesis, we were given the questionnaire was surveyed by three meetings there we had effort and cost for this survey The result for us with 480 people within 500 people answered to our satisfaction by request of us At the meeting, the total male is less than female They represent type of companies in Vietnam, aged from 18 to over 50 They have different positions in their companies With questions survey, we just want to give problems relate to understanding and the investment of businesses of IP, and we also know the suggestions and comments to the field better IP, since then we have the experience and solutions to help build the IP law and IP services better 5.2 Research Contributions and Implication As discussed above, the result of research by thesis helped us to know the practical needs of enterprises in protecting their IP, especially during periods of international economic integration, also showed us the training of experts on IP in Vietnam is also an urgent need Research result also shows us the shortcomings of IP law in Vietnam should be supplemented and perfected it better in the future Everything was just out here it also carries practical significance on the subject of our research 5.3 Limitation and Future Research Although ourselves are working in the field of IP There are advantages in the process of doing our research, but still has limitations and weaknesses in the research process We did not study depth all aspects of IP, such as the specific objects of the IP laws and service activities of the Organization of IP in other countries to do?
