The supply of a service through any of the four modes of supply, namely: Commercial Presence: implies that a service supplier of one Member establishes a presence in another Member's territory to provide a service (e.g domestic subsidiaries of foreign insurance companies or hotel chains); and Presence of Natural Persons: consists of persons of one Member entering the territory of another The WTO Dispute Settlement Mechanism (DSM) 2.3 Process of Dispute Settlement 2.3.1 Consultation • Bilateral consultations as the first and mandatory stage of formal dispute settlement (i.e negotiations) • Objective: To obtain satisfactory adjustment of the matter before resorting to panels/AB (Art 4.5 DSU) • Procedure: • Request for consultations: in writing, identify the measure at issue and legal basis for the complaint (Art 4.4 DSU) • Confidential and without prejudice to the rights of any Member in any further proceedings (Art 4.6 DSU) • Timeframe: consultations are held for at least 60 days (unless the parties agree to conclude it earlier) (Art 4.7 DSU) • Outcome: • If successful, any solutions reached must be notified to DSB, relevant Councils and Committees • If unsuccessful, complainant may request the establishment of panel & consultations are still possible at later stages in the proceedings 48 The WTO Dispute Settlement Mechanism (DSM) 2.3 Process of Dispute Settlement 2.3.2 Panel Proceedings • Panel request: in writing, indicate whether consultations were held, identify the measure at issue and legal basis of the complaint (Art 6.2 DSU) Content is important because it defines and limits the scope of the dispute • Panel establishment: at the latest at the DSB meeting following that at which the request first appears on the agenda by negative consensus (quasi-automatic) • Panel’s terms of reference (TOR): to define the jurisdiction of a panel (Art DSU) • A measure/claim falls within the TOR only if that measure/claim is sufficiently identified in the panel request • A panel is bound by its TOR and will not examine measures/claims outside it 49 The WTO Dispute Settlement Mechanism (DSM) 2.3 Process of Dispute Settlement 2.3.2 Panel Proceedings • Panel Procedures: Art 12 and Appendix of DSU • Parties exchange written submissions and participate in oral hearings to present their views • Panel report: • Interim report: issued for comments by parties • Final report: findings of facts, applicability of relevant legal provisions, basic rationale behind findings and recommendations (Art 12 DSU) • Final report: issued to parties, translated into languages, then circulated to all WTO members • Timeframe: • Within months from the date of panel composition and TORs agreed upon (3 months in case of urgency, i.e perishable goods) • Extension allowed, but in no case exceeds months from panel establishment 50 The WTO Dispute Settlement Mechanism (DSM) 2.3 Process of Dispute Settlement 2.3.2 Panel Proceedings • Adoption of panel report: Art 16 DSU • Recommendations in the panel report only become legally binding once adopted by DSB • Within 60 days after circulation of panel report to the Members, the report shall be adopted at a DSB meeting unless: • A party to the dispute formally notifies the DSB of its decision to appeal adoption is suspended until completion of the appeal • Or DSB decides by consensus not to adopt the report Quasiautomatic adoption 51 The WTO Dispute Settlement Mechanism (DSM) 2.3 Process of Dispute Settlement 2.3.3 Appellate Review Proceedings • Who can appeal? Only disputing parties, not third parties • When to appeal? Before DSB’s adoption of a panel report, by notification in writing to DSB and a notice of appeal to AB • Who reviews the appealed report? A division of (out of 7) AB members Deliberations are confidential • Scope of review: Issues of law and legal interpretations developed by the panels (Art 17.6 DSU), not issues of fact • Outcome of review: Uphold, Modify or Reverse the legal findings and conclusions of the panels • AB report (no interim review as with panel report) • Timeframe: Appellate review must be completed within 60 days, in no case more than 90 days from date when notice of appeal was filed (Art 17.5 DSU) • Adoption by DSB: within 30 days after circulation, AB report, together with panel report, as upheld, modified, or reversed are adopted (Art 17.14 DSU) 52 The WTO Dispute Settlement Mechanism (DSM) 2.3 Process of Dispute Settlement 2.3.4 Implementation of Ruling • DSB will supervise the implementation of recommendations and rulings in panel/AB reports The ‘losing’ (non-complying) member must bring its measure into comformity with WTO law promptly (Art 21.1 DSU) or within a reasonable period of time (RPT) (Art 21.3 DSU) • If parties disagree over RPT, they can refer to arbitration (Art 21.3.c DSU) In practice, RPT varies b/w – 15 months • If parties disagree over the existence or WTO-consistency of measures taken to comply with rulings Resort
