(The Political Barrow-man) had reached unprecedented levels.  Ockerse was certainly right to stress the ready availability of news in the Netherlands. From the early seventeenth century onwards, the young Dutch Republic had established itself as the most important clearing- house of international news. In the late sixteenth century, while still fighting off their Spanish sovereign, the Dutch rapidly developed into the foremost trading nation in the world. In the wake of this they also be- came a great power politically. Interests of war and trade and its central position in seventeenth-century geopolitics worked together to make the Dutch Republic, and particularly the city of Amsterdam, the global nerve- centre for the gathering and dissemination of news.  From  on- wards, we know of the existence of ‘coranto’: printed news-sheets which mainly provided factual information from abroad, obtained from a net- workof foreign correspondents. From about mid-century, in a process of piecemeal innovation, these developed into regular newspapers, first of all in Amsterdam, later also in several other towns in the core province of Holland like Haarlem (  ), The Hague (  ) and Leyden (  ). All of these were commercial enterprises initiated by local printers. Amsterdam had four officially recognised newspapers, appearing on dif- ferent days of the week. However, by the end of the seventeenth century, they had merged into one, which in the eighteenth century was acquired by the city government.  Very gradually during the eighteenth century,

Paxton ’ s application for the writ. Parliament had granted the English Court of Exchequer the power to issue the writ in Great Britain and authorized customs officials to apply for the writ in America. Parliament also gave the Massachusetts Superior Court the same powers as the English Court of Exchequer. Because the Court of Exchequer had been lawfully issuing the writ for years in Great Britain, lawyers for the government argued, the Massachusetts Superior Court enjoyed the same legal authority. Chief Justice Hutchinson and his colleagues agreed with the lawyers for the government. They unanimously voted to grant Paxton ’ s application in this particular case and affirmed the legality of the writ across Massachusetts. Although Otis, Thacher, and their clients lost the case, they transformed the writ into a rallying cry of the American Revolution. Colonial opposition to the writ quickly evolved from civil disobedience to armed resistance. By 1769 many colonial courts had grown reluctant to issue the writ. This series of events prompted JOHN ADAMS to exclaim that the Writs of Assistance case gave birth to the

Impact of world trade organization on demand pattern and opportunities to tea farmers in Nepal

Nepal became member of WTO after it adopted open market and economic liberalization policy. Obviously, this kind of membership to WTO could have some kind of implications on Nepalese market. This article is based on the empirical data generated through intensive field work. This article reveals that after Nepal became member of WTO it has direct impact on the demand pattern of Nepalese market. But there is no influence in the creation of new employment opportunities. However, farmers have got different opportunities of getting trainings and access to formal and informal education. More importantly, access to WTO has transformed tea farming from subsistence to commercial and thus increasing the demand of Nepalese tea in international market.

5- E has indicated a willingness to accept securities in exchange for the land. However, the receipt of any securities is considered boot, and E would be required to recognize gain. The gain may be deferred and reported as payments are received. 2-53 a. Whenever individuals are contemplating the contribution of property in the formation of a corporation pursuant to § 351, the difference in the basis of the contributed property and its fair market value (upon which the stock allocations are based) should be addressed. In the case of a cash contribution, there is no difficulty; the amount contributed equals the fair market value. However, when a contributor transfers low-basis depreciable property with a high fair market value, as H.R. plans, the corporation ’ s tax benefit resulting from depreciation of the property will always be less than the benefit obtained had the corporation purchased the asset with cash contributions and depreciated the higher basis. Under the proposed plan, H.R. is shifting to the corporation the unfavorable tax consequences resulting from the transfer of low-basis property. He receives the benefit of receipt of 50% stock ownership based on the fair market value of the building while the corporation benefits from depreciation based on only $12,000 basis. In order for the deal to be truly equitable, H.R. should agree to either (1) receipt of a lower percentage of stock or (2) an additional cash contribution to compensate for the corporation ’ s future tax costs resulting from the lower depreciation deductions.

encompasses to be of the utmost importance to our understanding of the rule of law. 24 For the moment, I will refer briefly to the explanation of that idea by the author of the Note in 1962 in the Yale Law Journal , that the term Act or Bill of Attainder comes from the practice in sixteenth, seventeenth and eighteenth century England of using statutes to sentence ‘to death, without a conviction in the ordinary course of judicial trial, named or described persons or groups’. 25 In addition, the term came to be used for ‘bills of pains and penalties’, statutes that imposed sanctions less than capital. 26 Both sorts of statute were aimed at revolutionaries and were considered contrary to the spirit of the common law because they attempted to bypass the courts by establishing a system of either legisla- tive or administrative conviction and punishment. The offence is then to an idea of the separation of powers, where the role of the judiciary in determining in an open trial both guilt and appropriate punishment is considered a constitutional fundamental. Thus the framers of the Ameri- can Constitution, in reaction to the use of similar instruments during the revolutionary era, inserted into the Constitution, Article I, Section 9: ‘No Bill of Attainder or ex post facto law shall be passed’.

In some cases, the overall cost of the courier is shared by participating libraries. This annual cost per library may be calculated through a per-stop cost, the volume of materials moved, indi- rectly paid for as part of an overall membership fee in an orga nization, or some combination of these methods. Often there is a flat fee for the year, but it may be based on some type of hierarchical pricing structure.

consolidated into one case, Krause v. Rhodes. Following a 15-week trial, a federal jury, by a 9 – 3 vote, acquitted all 29 defendants, including Ohio Governor James Rhodes. The decision was appealed and in 1977 the U.S. Circuit Court of Appeals for the Sixth Circuit ordered a retrial, based on evidence that at least one member of the jury had been threatened and assaulted. In January 1979 an OUT-OF-COURT SETTLEMENT was reached in all of the consolidated civil cases and approved by the Ohio State Controlling Board. The $675,000 settlement was dispersed among 13 plaintiffs, the largest amount going to an injured student who was paralyzed in the incident. According to Kent University Library archived documents, the compensation was accompanied by a statement from the defen- dants that the May 4, 1970, tragedy “ should not have occurred. ” The statement also noted that the Sixth Circuit had upheld as “ lawful ” the university ’ s ban on rallies and its May 4 order for the students to disperse. The statement concluded, “ We hope that the agreement to end this litigation will help assuage the tragic moments regarding that sad day. ”

Animals like the great apes, the whales, seals etc thought to be in danger of extinction. But even more important, perhaps, than individuals kinds of animals and plants, whole habitats are in danger of vanishing: marshes are being drained; and the world forests, especially the tropical forests are being cut down to satisfy man's need of timber and paper. 46. THE HISTORY OF ENGLAND A STUDY IN POLITICAL EVOLUTION PPT

unity of Christendom. The miserable reign of his worthless successor, Edward II, illustrated the importance of the personal factor in the monarchy, and also showed how incapable the barons were of supplying the place of the feeblest king. Both parties failed because they took no account of the commons of England or of national interests. The leading baron, Thomas of Lancaster, was executed; Edward II was murdered; and his assassin, Mortimer, was put to death by Edward III, who grasped some of the significance of his grandfather's success and his father's failure. He felt the national impulse, but he twisted it to serve a selfish and dynastic end. It must not, however, be supposed that the Hundred Years' War originated in Edward's claim to the French throne; that claim was invented to provide a colourable pretext for French feudatories to fight their sovereign in a war which was due to other causes. There was Scotland, for instance, which France wished to save from Edward's clutches; there were the English possessions in Gascony and Guienne, from which the French king hoped to oust his rival; there were bickerings about the lordship of the Narrow Seas which England claimed under Edward II; and there was the wool-market in the Netherlands which England wanted to control. The French nation, in fact, was feeling its feet as well as the English; and a collision was only natural, especially in Guienne and Gascony. Henry II had been as natural a sovereign in France as in England, because he was quite as much a Frenchman as an Englishman. But since then the kings of England had grown English, and their dominion over soil which was growing French became more and more unnatural. The claim to the throne, however, gave the struggle a bitter and fruitless character; and the national means, which Edward employed to maintain the war, only delayed its inevitably futile end. It was supported by wealth derived from national commerce with Flanders and Gascony; national armies were raised by enlistment to replace the feudal levy; the national long-bow and not the feudal war- horse won the battles of Crecy and Poitiers; and command of the sea secured by a national navy enabled Edward to win the victory of Sluys and complete the reduction of Calais. War, moreover, required extra supplies in unprecedented amounts, and they took the form of national taxes, voted by the House of Commons, which supplemented and then supplanted the feudal aids as the mainstay of royal finance.

The works at Washington, using a process very similar to that developed at Salindres, produced aluminium from 1860 to 1874. Sodium reduced aluminium was also being produced by James Fern Webster, who began to experiment with the metal in 1867 at his private house in Hollywood near Birmingham. Webster’s aluminium was very much purer than Deville’s, generally containing only about 0.8 per cent impurities. In 1882 he established the Aluminium Crown Metal Company at Hollywood. Hamilton Y.Castner brought his sodium reduction process to England in 1887, and shortly afterwards he established a manufacturing plant at Oldbury near Birmingham. Webster seized this opportunity to obtain cheap sodium and chlorine. He acquired a site adjacent to that of Castner, raised a working capital of £400,000 and established a factory intended to produce 50 tons per year of aluminium. Chlorine was bought by pipeline into Webster’s plant from Castner’s.

BÁO CÁO TOÁN HỌC: "A GENERALIZATION OF SOME HUANG–JOHNSON SEMIFIELDS" POT

V belongs to family K.I and system W belongs to all four families. In 1990 Huang and Johnson exhibited seven sporadic semifields of order 64, with left nucleus F 2 3 and center F 2 : the Huang–Johnson semifields of type II , III , IV , V , V I , V II and V III [8]. These were constructed in the geometric setting of translation planes. In fact, in [8], the authors were mainly interested in the complete determination of all translation planes of order 64 with kernel isomorphic to F 2 3 admitting a subgroup of order 2 · 64 in their linear translation complement. These translation planes turned out to be semifield planes and the semifields which coordinates them are the above mentioned semifields of Huang and Johnson. In [11, p. 281], the authors posed the question whether these seven examples could be extended to larger, possibly infinite, families. We answer this question by proving that some of Huang–Johnson semifields are contained into infinite families as in the case of systems V and W . Precisely, we prove that Huang–Johnson semifield of type V I is isotopic to a cyclic semifield of type ( q, 2 , 3) introduced by Jha and Johnson in [9] and Huang–Johnson semifields of type V II and V III belong to the infinite families F IV and F V recently constructed in [6]. Nevertheless, we construct new infinite families of semifields containing examples for any even and odd prime power q , proving that semifields of type II and III belong to such families.

Unless the pardon expressly states that it is issued because of a determination that the recipient was innocent, a pardon does not imply innocence. It is merely a forgiveness of the offense. It is generally assumed that acceptance of a pardon is an implicit acknowledgment of guilt, for one cannot be pardoned unless one has committed an offense. Generally speaking, a commutation of sentence usually reduces the length of a sentence, but does not erase the consequences of conviction, such as voting bars, prohibitions from office-holding, and restric- tions on future gun ownership. Pardons typically remove the consequences of criminal conviction. The Constitution allows two other pardon powers besides the power of commutation. It expressly speaks about the president ’ s power to grant “ reprieves. ” A reprieve differs from a pardon in that it establishes a temporary delay in the enforcement of the sentence imposed by the court, without changing the sentence or forgiving the crime. A reprieve might be issued for the execution of a prisoner to give the prisoner time to prove his or her innocence. A related power is the power to grant “ amnesty, ” which is also implicit in the pardon power. AMNESTY is applied to whole classes or communities, instead of individuals. The power

He evaluated that three divisions would be enough to attack Singapore considering naval and air backup. These forces would land in Singora, Kuantan or Mersing. After landing, they would advance to Johor. From Johor, they would cross Johor Strait near the Causeway, and after crossing it, they would advance along Bukit Timah Road to Singapore city. He wrote that, if people with military knowledge observed Singapore, every one would agree that this was the only practical way to attack it. Considered with the coastal defence of Singapore, it was impossible to attack from the south. After spending four days in Singapore, he visited the Dutch East Indies and British Borneo and then he returned to Singapore on 6 October. This time, he reported to British Army Headquarters at Fort Canning to pay his respects and explain his official purpose. He wrote that British Army Headquarters welcomed him more warmly than he anticipated. During his second visit to Singapore, he travelled to the Malay Peninsula several times. One day he visited Mersing to observe the coast. He regarded the coast between Endau and Mersing as landing sites for either main forces or a part of forces. He noticed that the condition of the coast was not good and inland areas were muddy and too heavily forested. The number of roads was too small. As a result, he concluded that the conditions of these areas were not easy for mobilising large forces. During the times he stayed in Singapore, he crossed the Causeway on seven round trips. 62 Even though he observed in Mersing

Thus, this syntactic sugar is probably a good idea; at the least, it is a well-entrenched idea. In C++ you can overload the operators, such as + and == , so that they work with oper- ands in the classes you define. The way to overload an operator is very similar to the way you overload a function name. The details are best explained through an example.

Corbin’s legal realist views are strongly evident in his approach to contract law. The main purpose of a contract, he stated in his treatise, is “the realization of reasonable expec- tations that have been induced by the making of a promise.” Reasonableness, he maintained, is an expression of customs and mores, which in turn could be discerned from what he called the operative facts of judicial decisions. To solve a contractual dispute, Corbin believed, a judge should first determine the intention of the parties, and thus the terms of the promise or agreement; then analyze the intention in terms of reasonableness; and finally apply rules, doctrines, or other principles to determine what remedy should be offered. Above all, Corbin believed that the reasonable expectations of the parties should be protected. Thus, according to Corbin, even if the price term were left open in an agreement that otherwise had been concluded, the court should consider whether the parties had intended to be bound by the contract. The court, he maintained, should make every effort to fill in the gaps of an agreement by looking to reasonable terms consistent with what the parties had previously agreed upon. The contract should fail only if it appears that the parties did not intend to be bound, or if reasonable terms cannot be ascertained.

As indicated in the figure above, to have a unit side-sway angle takes − 6 EK of a pair of member-end moments, while holding nodal rotation to zero at both ends. The member- end shear forces are not shown. We can easily develop a moment distribution process that includes the side-sway. The process, however, is more involved than the one without the side-sway and tends to diminish the advantage of the moment distribution method. A better method for treating side-sway is the slope-deflection method, which is introduced next after the derivation of the key formulas which are central to both the moment distribution method and the slope- deflection method.
